Conditions:
1. Providing for the improvement of Decatur and Seward Streets, East of 85th Street to City
standards.
2. Providing a 5-foot by 5-foot right-of-way dedication at all street intersections.
3. Obtaining a permit from the Papio-Missouri River Natural Resources District and the
Corps of Engineer for any storm sewer work.
4. Providing a signature line on the final plat for the Papio-Missouri River Natural
Resources District.
5. Providing a drainage study for review.
6. Providing the necessary drainage easements.
7. Installation of all sediment and erosion control measures prior to grading.
8. Providing minimum finished floor elevations on the subdivision plat for all lots adjacent

WHEREAS, the preliminary plat entitled CAMDEN CREEK, a cluster
subdivision, located at 8410 Seward Street and 8407 Decatur Street, attached hereto and made a
part hereof as Exhibit "A", with a request for a waiver of Section 53-8, to reduce the minimum
horizontal curve radius from 100 feet to 50 feet has been approved by the City of Omaha
Planning Board along with the conditions set out in Exhibit "B" attached hereto and made a part
hereof; and,
WHEREAS, Section 53-6 of the Omaha Municipal Code requires the submission
of preliminary plats to the City Council for its consideration; and,
- WHEREAS, the acceptance of this preliminary plat with a waiver of Section 53-8,
to reduce the minimum horizontal curve radius from 100 feet to 50 feet is tentative in nature and
• does not constitute or require approval of the final plat of this subdivision by the City of Omaha
Planning Board or City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:

THAT, the preliminary plat entitled CAMDEN CREEK, a cluster subdivision,
located at 8410 Seward Street and 8407 Decatur Street with a waiver of Section 53-8, to reduce

Gentleman:
On the agenda for Tuesday, December 20, 2005, is the final reading and public
hearing on the Preliminary Plat for Camden Creek, a cluster subdivision located at 8410
Seward Street and 8407 Decatur Street. We believe the proposed subdivision is
consistent with the City's Master Plan and the City's subdivision regulations upon
granting of the requested waiver. The proposed subdivision promotes infill housing in an
established Omaha neighborhood.
Also, we have met with the surrounding neighbors to address any questions they
may have concerning the subdivision and have discussed with them the following aspects
of the project:
1) The Natural Resource District does own the parcel labeled Outlot B on the
Preliminary Plat and this parcel will be removed from the Final Plat. The exact
boundary, which has been verified by ALTA survey, will be adjusted for the Final
Plat.
2) The average square foot per lot for the Camden Creek subdivision will increase
slightly based on the adjusted lot line and will continue to meet all R-4 zoning
requirements. The Preliminary Plat includes thirty-five homes for the
subdivision, a substantial reduction from the original proposal (see attached). You
will note that the developer's original concept was to build 80 town homes. When
Mr. Bilyeu, the developer, walked the neighborhood and met several of the
neighbors last August, he was told that if he could create a subdivision of

exclusively single family detached homes, then the neighbors would be
supportive. In direct response to the neighbor's requests, the subdivision will now
consist entirely of single family detached housing. The approximate 60%
reduction in density from approximately 80 to 35 percent represents a substantial
concession from the developer.
3) The Camden Creek subdivision will consist of single family homes with fee
simple ownership in a price range that will most likely equal or exceed the recent
sales prices of the immediate neighborhood.
4) We are enclosing the Estimated Street Improvement Assessment Schedule for
your review. Please note that the approximately $300,000 cost includes paving,
sewers and related improvements. The allocations for the neighboring non-
Camden Creek lots range from $3,749.00 to $16,930.00 per lot. The City of
Omaha Public Works Department is requiring these street improvements as a
condition of the development. These street improvements will substantially
enhance the neighborhood and add to the value of all homes in the area.

Dear Members of the Omaha.City Council:
This letter is written related to the Camden Creek Subdivision, a proposal which is on the
City Council Agenda today on a preliminary plat. On behalf of the neighbors in the area(near 85'
Street, Decatur and Seward.) this is a list of the very major concerns with the subdivision as it is
proposed.
1. The lots for this development are already platted. The replat proposed as Camden Creek •
would turn five or six lots into thirty-five. The current residents purchased and built houses,
investing in the neighborhood, relying on the neighborhood as platted. One entrepreneur
purchased the platted lots over a three of four year period. Now instead of four or five
additional houses, a developer proposes thirty five new houses, a huge increase.
2. The surrounding zoning is R-2. With R-2 zoning. 12-16 units would be allowed on the
project site. The developer proposes tripling what would he allowed if the existing
subdivision plat and zoning were followed.
3. The streets are unimproved in this neighborhood. The thirty-five new units will cause the
unimproved streets to have to he improved at the expense of the abutting homeowner. The
neighbors get to pay so one developer can make a large profit.
1. An additional street problem is that this subdivision has access only from the West. Seward
and Decatur streets would be the only access for people to get cars in and out of their new
neighborhood. This plan is flawed because it is far too dense given the way the
neighborhood has developed and the fact there are no north-south connecting streets. There

are no sidewalks and the neighborhood that exists there now the neighborhood along Seward
and Decatur east of 85th street is developed as a neighborhood of single family houses on
larger lots.
5. The surrounding homeowners note that the word `Cluster" is at the top of the subdivision
plat. Many of the lots are not 5,000 square feet as required by the R-4 zoning designation.
This subdivision does not cluster around anything. The developer has told the city planning
department that he wants to use the"Cluster"word on this plat in order to vet waivers from
applicable zoning regulations. This cannot be allowed by the city council. This is just the
way to squeeze more lots into the development that is already far too dense for the
neighborhood.
6. These citizens are also concerned about Outlot B shown on this subdivision plat. Looking
at the map showing elevations, it is obvious that Outlot B is actually the Papio Creek bank.
Outlot B belongs to the Papio-Missouri River Natural Resource District. Why is it included
in the subdivision plat? Perhaps only to make it appear a larger area is being developed.
Again.one person is trying to profit at the expense of these neighbors.. The Papio Missouri
River Natural Resource District should not allow the hank of the Papio Creek to be included
in the subdivision.
