ORD 36900 - Amendment to MUD agmt at 302 N 168th Circle ORDINANCE NO. 3�9oO AN ORDINANCE to approve a Major Amendment to a Mixed Use Development Agreement for property located at 302 North 168th Circle between the City of Omaha and Dodge Retail, LLC,providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health safety, and welfare, desires to assure that the property located at 302 North 168th Circle is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Major Amendment to a Mixed Use Development Agreement is hereby approved. Section 4. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage. WITNESSETH: WHEREAS, the City and Developer have entered into a certain Development Agreement (Agreement), approved by the City Council of the City of Omaha on January 28, 2003 setting forth certain conditions with respect to the development of property owned by the Developer known as Lot 1, Town Center at Pacific Springs,Lots 1 through 5,Town Center at Pacific Springs Replat One; and WEHREAS, the Developer desires to amend Section IV, Paragraph A of the Agreement by allowing automotive rental as a proposed use permitted on Lot 1,Town Center at Pacific Springs Replat One,part of Phase I of the Project. NOW THEREFORE,the following is agreed between the parties hereto: Section IV,Paragraph A of the Agreement is hereby revised to include the following permitted use in the Project: "4. Automotive Rental Services are permitted on Phase I, Lot 1, Town Center at Pacific Springs Replat One." In all other respects,the Agreement shall not be affected hereby,and it is hereby ratified and confirmed In witness whereof,the undersigned have executed this Agreement the day and year first written above.
