ORDINANCE NO. (1 /
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65
of the Omaha Municipal Code,by changing certain boundaries of the official zoning map of
the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to
rezone property located at 6901 Irvington Road from R1-Single Family Residential District
(Large Lot) and DR-Development Reserve District to LI-Limited Industrial District.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code
be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha
Municipal Code so that:
Part of Lot 1,Evergreen Place, a subdivision in Douglas County,Nebraska,together
with part of the Southeast '/4 of the Southwest '/4 of Section 27, Township 16 North,
Range 12 East,of the 6th P.M., said Douglas County,all more particularly described
as follows: Beginning at the Northwest Corner of said Lot 1, thence N53°04'39"E
(assumed bearing), 289.38 feet on the North line of said Lot 1 and its easterly
extension;thence S37°17'23"E, 132.13 feet;thence S00°50'23"E, 121.51 feet to the
Southeast corner of said Lot 1;thence S87°30'34"W,253.25 feet on the south line of
said Lot 1 to the east line of Irvington Road;thence northwesterly on the east line of
Irvington Road on a 62.53 foot radius curve to the right, chord bearing
N54°42'38"W, Cord distance 26.51 feet, an arc distance of 26.71 feet; thence
N39°12'46"W, 12.34 feet on the east line of Irvington Road;thence S53°11'36"W,
2.06 feet on the east line of Irvington Road to the west line of said Lot 1; thence
N35°54'55"W, 49.57 feet on the west line of said Lot 1 to the point of beginning,
containing 1.07 acres, as surveyed and recorded in Douglas County, Nebraska, is

Gentlemen,
I would like to request that an item scheduled for the next City Council meeting be postponed until June.
The issue to which I am referring is the rezoning of property located at 6901 Irvington Rd. from R1 to LI.
This was last discussed at the April 26th City Council meeting but a vote was deferred so that a
neighborhood meeting regarding the rezoning could be held; that was accomplished on May 17th
During that meeting, a legal question was discovered regarding the deed restrictions on that lot. I am
requesting a postponement so that we may obtain legal counsel regarding this issue. If the zoning is
changed prior to the resolution of this concern, the matter will later be determined in a court of law.
I am aware that a postponement request requires the agreement of four out of six council members. Prior to
Tuesday, May 2441, I would appreciate a reply to this email from each council member indicating his
willingness to vote in favor of a delay. This will allow adequate preparation time if the public hearing is to
proceed as currently scheduled.
If you have any questions regarding this request, please do not hesitate to contact me.
