The Nebraska Youth Justice Initiative program will operate as follows:
A. Zoning: The property on which the facility will locate is in an R-1 zoning district. The goal is to
proceed under the existing zoning.
B. Facility: The new facility will be used for the Nebraska Youth Justice Initiative program located
at 5020 Grand Avenue. The new facility will be located on the west half of the 10-acre campus
near the intersection of 50th and Grand Avenue comprised of 2 new buildings totaling
approximately 40,000 gross square feet.
The new residential building will operate 24 hours a day, 7 days a week, 365 days a year and will
include 3 separate living units each with 8 single occupant bedrooms, (2) flexible pods with 2 single
occupant bedroom units, a kitchen and dining facility for the meals and cooking activities, areas
for group activities, family visits and recreation, administrative offices for the facility, and a lobby.
There will be space in the building for offices for Nebraska Youth Justice Initiative staff to support
the operations of the facility as well as educational space to allow residents to continue their
education on site. The residential facility will accommodate 24 youth between the ages of 12 and
18.
The second building, a roughly 6,500 square foot outpatient behavioral health clinic will operate
8am to 5pm with some evening and weekend hours available as needed. This outpatient clinic will
provide behavioral health services to the youth residing in the residential building and their
families.
Youth receiving services at the facility will no longer be required to leave the community for
education, treatment, and rehabilitation. This fills a gap in the continuum of behavioral health
programs for youth and families in one location inside of the community that they reside in.
These uses fall within three use types under Section 55-43 of the City of Omaha Municipal Code.
1. “(f) Large group living. A dwelling unit housing, on a weekly or longer basis, more than
eight unrelated persons, not defined as a family (multiple units will allow more than eight persons).”
This encompasses the residential portion of the facility as well as the uses accessory or ancillary
thereto such as administrative offices.
2. “(aa) Secondary educational facilities. A public, private or parochial school offering
instruction at the junior and senior high school levels in the branches of learning and study required
to be taught in the public schools of the state.” This encompasses the educational aspects of the

facility, including the physical education and activities, which Metro Area Youth Services
(“MAYS”) currently provides. This also includes accessory uses such as accessory uses.
3. “(k) Emergency residential care. A facility or use of a dwelling to provide a protective
sanctuary for victims of crime or abuse, including emergency housing during crisis intervention for
victims of rape, child abuse, or physical beatings.” This encompasses the behavioral health aspects
of the facility and any health care services provided in conjunction therewith.
Large Group Living and Emergency Residential Care are special uses in the R-1 zoning district.
Secondary Educational Facilities are a conditional use in the R-1 zoning district. We anticipate
processing these together, except that only the special permit uses will require a decision from the
City Council.
C. Staffing: The Nebraska Youth Justice Initiative, at full capacity and peak hours, will staff the
residential building with 24 staff including administrators, direct care staff, and educators working
directly with youth. Residential staff will provide 24/7 on site coverage across three shifts each
day. Approximately 10 staff will provide services at the outpatient clinic when the residential
program is at full capacity during peak hours. A team of 15 in-home services staff will work
primarily off-site with the families of youth living in the residential building, intermittently
attending on-site meetings, or utilizing workspace throughout the day and evening hours.
D. Population: The Nebraska Youth Justice Initiative will accept most of its referrals from juvenile
probation. Other referral sources may include child welfare, education, mental health professionals,
and directly from legal guardians. Thus, we have developed our residential, education and
behavioral health program to effectively serve and work with this population.
Significant and chronic gaps in Douglas County’s current mental health service delivery system
often prevent local youth from receiving the right prevention and treatment support at the right time
for the right duration. Currently many youth are housed in juvenile detention waiting for treatment
services. This is caused by a combination of factors, including demand for residential services for
youth with complex issues exceeding local capacity. As a result, a shortage of treatment options
forces many to find services outside of Nebraska. When youth are forced to be alone and receive
services outside of family relationships without local support networks and educational providers
it contradicts emerging research. Effective recovery relies on direct access to family relationships
and local support networks.
E. Services: The Nebraska Youth Justice Initiative (NYJI) is a new 501(c)(3) created with the primary
purpose to provide residential care, education, outpatient treatment, and in-home services to justice
system involved adolescents who have experienced significant trauma and need treatment for
mental health and/or substance use disorders. Nebraska Youth Justice Initiative proposes to provide
a full array of services:
a. Residential Care: Nebraska Youth Justice Initiative will operate a licensed and nationally
accredited residential care facility serving youth ages 12-18. Length of stay will vary based
on the needs of the youth but is expected to be 9-12 months. The goal of the program is to
create a safe and therapeutic environment providing treatment and education until it is
determined youth may return home without creating a community safety issue. Treatment
and education activities include a regular and special education curriculum, therapeutic
groups, and a variety of recreation opportunities.

b. Education: Nebraska Youth Justice Initiative will operate a Rule 18 school approved by
the Nebraska Department of Education. School staff will be professional educators holding
a current teaching certification in Nebraska employed by Nebraska Youth Justice Initiative
under the supervision of certified school administrator. The goal of the education program
is to continue academic progress, including credit recovery if appropriate, until youth can
transition to a school in their community or receive a high school diploma or GED. The
Nebraska Youth Justice Initiative school will provide a full array of special education
services to students in conjunction with their resident school district.
c. Outpatient Mental Health and Substance Use Treatment: Nebraska Youth Justice
Initiative will operate an outpatient behavioral health clinic in a separate facility
immediately adjacent to the residential care facility. The outpatient behavioral health clinic
will provide outpatient psychiatry, psychology, and individual, group and family therapy
for mental health and substance abuse disorders. The goal of the outpatient behavioral
health clinic is to provide treatment services as indicated by evaluation and diagnosis while
the youth reside in the residential program and after returning home, if necessary. All
clinicians providing outpatient treatment will hold applicable degrees and licensure as
required by the Nebraska Department of Health and Human Services and be paneled by a
variety of insurance funders including Nebraska Medicaid.
d. In-Home Services: The families of youth in residential care at NYJI preparing for the
youth’s return home will receive in-home services. The goal of in-home services is to assist
families in developing sustainable support systems which allow youth transitioning home
to remain safe, at home, attending school, and out of trouble. In-home service staff will
utilize evidence-based practices for family engagement, support, and skill development.
The primary service location will be within the family home where the youth is returning,
but family engagement activities may occur in other locations as needed.
F. Community Outreach and Facility Safety: Nebraska Youth Justice Initiative will have staff monitor
the facility 24 hours a day. Through the use of visually appealing fences, camera surveillance, staff
safety and de-escalation training and other methods, safety will be a top priority.
Nebraska Youth Justice Initiative has begun working with a third-party security consulting firm
and the Omaha Police Department to ensure the safety of our youth, staff, and the surrounding
community. These partnerships will improve operations at the facility as well as strengthen
relationships in the neighborhood.
G. Neighborhood Collaboration: Nebraska Youth Justice Initiative will meet with the neighbors of
the campus on a recurring basis to discuss any concerns and to share information regarding
operations to create and maintain partnerships.
H. Hours of Operation: Nebraska Youth Justice Initiative will provide residential services 24 hours a
day, 7 days a week, 365 days a year. Nebraska Youth Justice Initiative will not discriminate or

I. Visitor Guidelines:
Residential program – Visitors to the residential program will generally be between 8AM and
8PM and may include family members, faith leaders, mentors and volunteers, student interns, and
probation officers. Visits will occur 7 days a week. Visitors will need to be checked in to the
facility.
Outpatient clinic – Visitors to the outpatient clinic will be patients of the healthcare providers on
site. Youth from the residential program will enter through a private entrance, while others will
enter through the public facing entrance. In addition to patients, visitors may include student
interns and probation officers of the youth residing in the residential program. The clinic will
primarily operate Mon-Friday 8am – 8pm with some weekend hours as needed. Visitors will need
to be checked in to the facility.
J. Parking: Expected parking counts when the programs are at full capacity are approximately 30
staff and 5-7 visitors on site between 8am and 8pm and approximately 10 staff on site between
8pm and 8am, with likely no visitors during that time.
K. Resident Driving Privileges: Youth will not have driving privileges, nor will they park personal
vehicles on the property.
L. Licensing:
The residential building will be licensed as a Residential Child Caring Agency (RCCA) by the
Nebraska Department of Health and Human Services. RCCAs are governed by the Children’s
Residential Facilities and Placing Licensure Act (see statutes attached – Neb. Rev. Stat. 71-1924 to
71-1951). The regulations for RCCAs are set forth at 391 NAC 7. The Act, 71-1926(7), defines a
“residential child caring agency” as an organization that “provides care for four or more children
and that is not a foster family home as defined in 71-1901.” Several other agencies operate similar
facilities under this licensure including Omaha Home for Boys, Uta Halee, and Boys Town. No
clinical or healthcare services will be provided in the residential building.
The clinic will be licensed as an outpatient clinic providing primary care, medical, dental, and
behavioral health. As treatment is provided on an outpatient basis, youth from NYJI will receiving
outpatient services will live in a separate residential facility next door.
NYJI will seek national accreditation once eligible to apply after 18 months of operation. While a
best practice, this accreditation is not required for the above licensure.

church building. Property in the vicinity is developed with a mix of
commercial, civic, and residential uses.

Development
Proposal:
The applicant (Nebraska Youth Justice Initiative (NYJI)) is a new
organization created with the primary purpose to provide residential care,
education, outpatient treatment, and in-home services to adolescents
involved in the justice system who have experienced significant trauma
and need treatment for mental health and/or substance use disorders.
Nebraska Youth Justice Initiative proposes to provide a full array of
services.
The applicant recently submitted an associated request to allow for a
Large group living, Emergency residential care, and Secondary education
facility to be constructed and operated on the west part of the subject
property. The Conditional Use Permit for Secondary education was
approved by the Planning Board on July 7, 2021. The Special Use Permits
for Large group living and Emergency residential care are pending city
council approval. This request would allow for the Metro Area Youth
Services (MAYS) program to operate out of the former church on the east
half of the site.
The former church is located on the east half of the 10-acre campus near
the intersection of 50th and Grand Avenue and comprises one building
totaling approximately 29,000 gross square feet.
MAYS had previously operated the same programming at 5150 Ames
Avenue, in a building located one block away from this site. Despite
COVID, the youth assigned to the Metro Area Youth Services still need to
continue programming during the pandemic. To safely continue to
operate, Metro Area Youth Services relocated to this facility to allow youth
and staff to responsibly social distance. This requested use permit would
bring the operation into compliance with the zoning ordinance.
The program will continue to operate from 8am to 7pm, 5 days a week and
includes a gym, classrooms, a kitchen and dining facility for meals and
cooking activities, areas for group activities, recreation, administrative
offices for the facility, and a lobby. There will be space in the building for
offices for Metro Area Youth Services staff to support the operations of the
facility as well as educational space to allow the youth to participate in
homework and educational programming onsite. There are an average of
25 youth in the program at a time.
Metro Area Youth Services allows youth, including system and probation-
impacted youth, to fulfill their day and/or evening probation reporting
criteria, receive tutoring, participate in athletics, receive assistance with
employment and job placement and receive family support services, under
one roof.
Provided Services: Day and evening reporting, tutoring, personal training
and sports, field trips, and family support.
Staffing: Metro Area Youth Services (MAYS), at full capacity and peak
hours, will staff the building with 10 staff including administrators, direct

care staff, and educators working directly with youth. Residential staff will
provide onsite coverage across one shift.
Public
Improvements:
Traffic and Circulation: Comply with the City’s driveway regulations.
Construct the private street in the vacated 50th Avenue right-of-way to
City standards; coordinate with Public Works.
Coordinate with the City on the vacation process for the 50th Avenue
right-of-way.
Utilities: OPPD has existing distribution equipment on/near the property.
Coordinate with OPPD on removal/relocation if necessary.
Grading and
Drainage:
All development must comply with all applicable stormwater management
ordinances and policies, including providing for a no net increase in
stormwater runoff and must treat the first 1/2” of stormwater for water
quality.
Land Use and
Planning: The Recreational club use type requires a Special Use Permit in the R1
zoning district, which may be approved upon compliance with applicable
base district development standards and Section 55-885 review criteria.
Landscaping: Per Section 55-885, landscaped areas shall be planned as
an integral part of the development, providing street landscaping and
buffering, and dividing otherwise unbroken paved areas. The applicant
must submit a revised landscaping plan providing overstory trees not more
than 40’ OC along the entire Grand Avenue and 52nd Street frontages.
Fencing: The applicant is proposing a 10-foot perimeter non-scalable
security fence around the perimeter of the yard of the proposed residential
facility on the west part of the site. The maximum height of a fence within a
required front yard or street side yard setback in a residential zoning district
shall be four feet. The maximum height for any fence outside of a required
front yard shall be six feet. Due to the civic nature of the operation and the
need for security on the site, the City recently supported a waiver to
maximum fence height for the proposed project as part of the previously
submitted associated use permit applications and subsequent Zoning
Board of Appeals application, provided that the fence is moved to the
building setback line along the north and west property lines and
landscaping is added to screen the fence from neighboring residential
properties. A revised site/landscape plan must be submitted moving the
fence to the setback applicable to each property line and landscaping added
to appropriately screen the fence, prior to forwarding this request to City
Council for final action. Coordinate with the Planning Department on an
acceptable landscape plan.
Parking: Section 55-734, Schedule of off-street parking, requires 1 space
for every 4 persons total capacity for the Recreational club use type. Based
on a Uniform Building Code requirement of 50 square feet per person for
the largest place of public assembly (4,200 SF), the capacity of the facility
is determined to be 84 people. A minimum of 21 parking spaces are
required. It should also be noted the applicant indicates that on average,
Metro Area Youth Services has 8 cars in the parking lot during program

hours. Youth typically do not transport themselves to or from the facility,
rather are brought by an adult or transportation company. Provided plans
show 80 stalls on the east part of the site for the proposed Recreational
club, which is acceptable. Provided parking for the associated uses on the
west part of the campus were determined to be sufficient as part of the
review for the previous use permit applications.
III. ANALYSIS:
Conditionally, the proposed facility complies with the requirements of the zoning ordinance
and the goals and objectives of the Omaha Master Plan.
IV. RECOMMENDATIONS:
Approval of a Special Use Permit to allow a Recreational club in the R1 District, subject to the
following conditions:
1. Submittal of and compliance with a revised site/landscaping plan providing overstory
trees along the entire Grand Avenue and 52nd Street frontages, moving the fence to
the building setback line along the north and west property lines, and adding
landscaping to the exterior side of the fence, prior to forwarding this request to City
Council for final action.

The Metro Area Youth Services program will operate as follows:
A. Zoning: The property on which the facility will locate is in an R-1 zoning district. The goal is to
proceed under the existing zoning.
B. Facility: The existing buildings will be used for the Metro Area Youth Services (MAYS) program
located at 5020 Grand Avenue. The existing buildings are located on the east half of the 10-acre
campus near the intersection of 50th and Grand Avenue comprised of 1 building totaling
approximately 29,000 gross square feet.
MAYS has previously operated the same programming at 5150 Ames Avenue, in a building located
one block away from this site. Despite COVID, the youth assigned to our Metro Area Youth
Services still need to continue programming during the pandemic. To safely continue to operate,
Metro Area Youth Services relocated to this facility to allow youth and staff to responsibly social
distance.
The program will continue to operate from 8am to 7pm, 5 days a week and includes a gym,
classrooms, a kitchen and dining facility for the meals and cooking activities, areas for group
activities, recreation, administrative offices for the facility, and a lobby. There will be space in the
building for offices for Metro Area Youth Services staff to support the operations of the facility as
well as educational space to allow the youth to participate in homework and educational
programming onsite. There are an average of 25 youth in the program at a time.
Metro Area Youth Services allows youth, including system and probation impacted youth, to fulfill
their day and/or evening probation reporting criteria, receive tutoring, participate in athletics,
receive assistance with employment and job placement and receive family support services, under
one roof.
These uses fall within the following use types under Section 55-46 of the City of Omaha Municipal
Code.
(c) Civic use type (2) Recreational Club. A club providing indoor and/outdoor athletic
facilities, with or without social facilities. Typical uses include country clubs and nonprofit
recreation or community centers.
C. Staffing: Metro Area Youth Services (MAYS), at full capacity and peak hours, will staff the
building with 10 staff including administrators, direct care staff, and educators working directly
with youth. Residential staff will provide onsite coverage across one shift across.

D. Population: Metro Area Youth Services will accept most of its referrals from juvenile probation,
St Francis and Health and Human Services. Other referral sources may include child welfare,
education, mental health professionals, and directly from legal guardians. Thus, we have developed
our program to effectively serve and work with this population.
E. Services: The Metro Area Youth Services (MAYS) is an existing non-profit organization, founded
in 2013 with the goal to provide growth and development to the teens facing behavioral issues,
multiple suspensions, failed drug screening, lack of employment and other barriers. Metro Area
Youth Services provides a full array of services:
a. Day and Evening Reporting: Day and Evening probation reporting is available between
the hours of 9am-3pm for youth ages 12-18. During these hours staff work with kids to:
• Focus on behavioral issues at home or school
• Transition back to home from an out-of-home placement
• Cultivate decision making skills
• Promote positive peer relationships
• Find ways to positively fill their idle time
• Improve relationships with adults and authority figures
• Develop resiliency
• Learn employability skills and search for jobs
b. Tutoring: A certified teacher on staff provides resources and opportunities for students to
maintain or catch up academically.
c. Personal Training/Recreational Sport: Personal training and martial arts instruction
enables us to emphasize wellness, fitness and participation in community sports leagues to
provide our program youth the opportunity for practical application of social skills.
d. Hood to the Woods: Gives youth the opportunity to experience new adventures, and build
relationships with people outside of their social circles through trips that incorporate
camping, hiking, kayaking, white river rafting, etc. These off the grid experiences allow
youth to unplug and reconnect with themselves and others.
e. Family Support: Allows wrap around services to help take the stress off of families by
assisting in finding housing, jobs, counseling services and other social services needs.
F. Hours of Operation: Metro Area Youth Services (MAYS) will have programming from 9am-7pm,
5 days a week. MAYS will not discriminate or permit discrimination in violation of federal or state
laws or local ordinances because of race, color, sex, age, or disability, or because of political or
religious opinions, afflictions, or national origin.
G. Parking: On average, Metro Area Youth Services has 8 cars in the parking lot during program
hours. Youth typically do not transport themselves to or from the facility, rather are brought by an
adult or transportation company.
