ORD 37119 - Rezone 1938 N 85th St from R2 to LO C10-05-170 ORDINANCE NO. c //9 AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code,by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 1938 North 85th Street from R2-Single Family Residential District (Medium Density)to LO-Limited Office District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is,changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1 and 2,Block 42,West Dodge,a subdivision as surveyed,platted and recorded in Douglas County,Nebraska,is hereby rezoned from R2-Single Family Residential District (Medium Density) to LO-Limited Office District. Section 2. This Ordinance shall be in full force and effect fifteen(15)days from the date of its passage. NEBRASKA August 16, 2005 City of Omaha Office of the City Clerk Omaha/Douglas Civic Center 1819 Farnam Street, Suite LC-1 Omaha, Nebraska 68183-0112 Subject: Rezoning of 1938 North 85th Street Public Hearing; August 30, 2005 Z-170-08/30/05 Due to a scheduling conflict we will not be able to attend the subject public hearing. We wish to support the request to change the present zoning from R2 to LO. We own the adjacent property to the West. The present use of our property is Professional Office use. The property across Blondo street to the North and across the street to the East is of similar nature. Rezoning of this to LO would be a better, more appropriate, and a higher use of the property. Another factor that we have experienced since we have owned our property is the problems experienced by the various residents of who have lived in the structure. The driveway to the garage is within thirty feet of the intersection. There is no parking on Blondo and on 85th adjacent to the structure. The residents and their guests park in front of the garage and block the sidewalk, as well as sight distance of traffic coming down Blondo. The current resident parks an "over the road" truck along side of the driveway. This situation creates a hazard to traffic attempting a left turn from 85th Northbound to Blondo Westbound. In addition, The sidewalks along the North and East sides of the property are long. The City plows snow onto the sidewalk and piles it up on the corner at the cross walk. The residents hardly ever shovel the walks and keep them open, creating safety problems for the frequent use by pedestrians. If this were an office, the sidewalks would be kept open by use of a Commercial Contractor as we do with our office . Our support of this Rezoning has one recommendation and requirement. The driveway and parking in front of the existing garage be eliminated, with carefully designed and landscaped parking constructed on the West side of the structure, with driveways along the West and South property lines.
