Conditions:
1. Noting on the plat that direct access to 108th Street from the property, except for the
approved north (middle of the site) and south access locations, will not be permitted;
2. Noting on the plat that the middle access to 108th Street will be restricted to right-in/right-
out vehicular turning movements;
3. Providing for removing the middle access if/when the neighbor to the north allows a
shared access in the subdivision agreement;
4. Submitting a queue length analysis that address the southbound left-turn at Lake Street as
well as the northbound right-turn on the northern (middle) drive;
5. Submitting a traffic study that addresses the trip generation and distribution from this
development and the "Emerald Point" property;
6. Providing for all improvements that result from the queue length analysis, as well as
traffic signal installation or modification;
7. Submitting proof that an access easement has been acquired from OPPD so the south
driveway can be aligned with Lake Street. OPPD should then take access from this
easement the OPPD access to 108th Street removed;
8. Providing for the installation of a sidewalk along 108th Street as well as a functional
internal pedestrian circulation system that connects with the sidewalk.
9. Submitting cross-sections for all drainageways, as well as calculations for a 100-year
storm. Based on this information channel maintenance easements must be provided
equal to the 3:1 slope + 20' or the 100-year storm path, whichever is greater. All
jurisdictional waterways must be delineated, preserved and protected; and,
10. Submitting a letter from Douglas County that indicates a noxious weed plan has been
approved.

WHEREAS,preliminary plat entitled 108TH AND LAKE,located at 2425 North 108t..
Street, attached hereto and made a part hereof as Exhibit "A", has been approved by the City of
Omaha Planning Board,along with the conditions set out in Exhibit"B"attached hereto and made a
part hereof; and,
WHEREAS,Section 53-6 of the Omaha Municipal Code requires the submission of
preliminary plats to the City Council for its consideration; and,
WHEREAS,the acceptance of this preliminary plat is tentative in nature and does not
constitute or require approval of the final plat of this subdivision.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
