Attached is a Resolution authorizing the City of Omaha to accept a contract grant award in the
amount of $61,800.00 from the Nebraska Office of Highway Safety, Grant Contract Award
Number 07-20 to support the City of Omaha's Prosecutor Office DWI (Driving While
Intoxicated) Prosecution Enhancement Project.
The goal of the DWI Prosecution Enhancement Project is to continue ninety (90) percent of DWI
bench and jury trials being scheduled no more than twelve weeks after arraignment. The grant
funding objectives are to (1) continue the employment of the Criminal Attorney who will
conduct quarterly in-house training for the Assistant City Prosecutors, (2) expand the training of
the Administrative Clerk relative to the administrative processing of DWI cases, (3) ensure pre-
trial conferences for every DWI jury is scheduled within seven weeks of arraignment, and (4)
institute the digital scanning of DWI police reports to make them immediately available to
defense attorneys.
The grant contract period is from October 1, 2006 to September 30, 2007. The total project cost
is $118,600.00; and there is a match of$56,800.00 paid through the Prosecutor's Office general
funds as designated by the Finance Department.

DWI PROSECUTION ENHANCEMENT GRANT — YEAR THREE
SUMMARY
During the past four years, the number of 'Driving Under the Influence' (DWI/DUl) cases
prosecuted by the Omaha City Prosecutor's Office has increased more than sixty percent. This
growth is attributable in large measure to two factors: the reduction of the blood alcohol
standard from .10 to .08 and to the deft utilization of Highway Safety Grants by the local law
enforcement agencies.
Beginning two years ago, the increase in arrests strained the ability of the Omaha City
Prosecutor's Office to devote sufficient resources to the handling of DWI cases. To meet the
challenge a grant was obtained by the Prosecutor's Office from the Office of Highway Safety to
hire a full-time prosecutor and an administrative clerk. This application is for a third year of
funding for this project.
Utilizing the additional staff, the Prosecutor's Office has met its objectives in reducing case
processing times. New court procedures and a further ten percent increase in DWI arrests
during the past year make it imperative that we maintain the grant supported personnel. Cost of
the project is $118,600.00 including $61,800.00 requested from NOHS and $56,800.00 provided
by the City of Omaha Prosecutor's Office.
ORGANIZATIONAL BACKGROUND
The City of Omaha Prosecutor's Office is responsible for the prosecution of misdemeanor
criminal and traffic offenses that occur throughout Douglas County. The City Prosecutor
maintains a staff of ten deputies, seven administrative clerks, and one secretary. In 2005, the
Office handled 68,000 traffic citations and 37,000 criminal arrests. Law enforcement agencies
supported by the Office include, the Omaha Police Department, Douglas County Sheriff's Office,
the State Patrol, Carrier Enforcement, and police departments for the towns of Ralston, Elkhorn,
Boys Town, Bennington, Waterloo, and Valley. The Prosecutor's Office has long maintained an
aggressive stance towards DWI prosecution. We have one of the highest conviction rates in the
country; over 95% of all DWI arrests in Douglas County results in conviction.
PROBLEM IDENTIFICATION
When the City of Omaha Prosecutor's Office first applied for the present grant, the Office was

inability to recall distant events threatened success in other cases.
The goal of the DWI Prosecution Enhancement project is to have ninety percent of DWI bench
and jury trials scheduled no more than twelve weeks after arraignment. To accomplish this
goal, we hired an experienced criminal attorney and an administrative clerk. With an 'extra'
prosecutor, more DWI cases could be scheduled daily for trial. This in turn promised to lead to
a reduction in processing time. Within ninety days we had reached our goal.
To help maintain our goal, we embarked on a collaborative effort with the Court and law
enforcement to develop and apply technology solutions to case scheduling. However, we face
new challenges to our ability to maintain our case progression goal. A year ago, the Douglas
County Court opened a courtroom at the County Correctional Facility. The courtroom is used
daily for felony case bond settings and misdemeanor arraignments. With the need to staff this
new courtroom, we have impaired our flexibility to staff for DWI trials. Additionally, in 2005, the

number of new DWI arrests increased ten percent over the previous year. It is imperative that
we maintain the personnel hired and supported by the DWI Prosecution Enhancement Grant if
we are to maintain our case progression goal.
An important component to improving our case progression statistics is to improve our ability to
comply with discovery requests by defense attorneys. Defense attorneys demand adequate
time to review police reports and to perform case preparation. Currently, paper copies of police
reports are made available to defense attorneys sometime after arraignment. We seek to
change this by scanning police reports as they are received in this office. The scanned reports
would be available immediately to defense attorneys. This, in turn, will facilitate earlier
dispositions of cases and reduce the need for defense attorneys to request trial continuances.
The cost of programming will be paid by the Prosecutor's Office. We are requesting funding for
a high-speed document scanner at five thousand dollars.
GOAL
The goal of this project is to continue having ninety percent of DWI bench and jury trials
scheduled no more than twelve weeks after arraignment during the funding period.
OBJECTIVES
1. Continue the employment of our experienced criminal attorney (Mr. Jonathon Crosby).
Have Mr. Crosby conduct in-house training on a quarterly basis for the Office's other
Assistant City Prosecutors.
2. Expand the training of the administrative clerk (Carla Irons) relative to the administrative
processing of DWI cases.
3. Ensure pre-trial conferences for every DWI jury trial is scheduled within seven weeks of
arraignment.
4. Institute the digital scanning of DWI police reports that will make them immediately
available to defense attorneys.
STRATEGIES
1. Ongoing contact with Presiding Judge, Court Administrator, Chief Bailiff to ensure timely
scheduling of trials.

EVALUTION
1. An administrative evaluation will be completed at the conclusion of the project to
measure actual activities and tasks against those planned.
2. On a monthly basis, compile and compare arrest and conviction data for the project
period against that of the previous year.
3. Compile and compare the case processing times to ascertain whether project goal is
being met on a monthly basis.
4. Conduct personnel evaluations to ascertain suitability for continued employment after
ninety days and again at the end of the project year.
5. An evaluation will be made on the efficiency of the new document scanning program to

COST ASSUMPTION
The City of Omaha is committed to the successful prosecution of persons who drive while under
the influence of alcohol or drugs. To that end, the Prosecutor's Office has nurtured career
prosecutors. The average term of employment for the current staff is fifteen years. The City is
understandably reluctant to employ another civil service, career-minded prosecutor for what
may prove to be a short-term increase in DWI arrests. As a municipal corporation, the City can
and will assume the costs of an additional prosecutor and administrative clerk as it becomes
clear that the increase of DWI arrests and prosecution is a continuing phenomenon.
