Attached for your consideration is a Resolution appointing Valerie J. Abbott to the Downtown
Business Improvement Area Board.
The Statute provides only that five or more board members serve on the board and that the members
of the Business Improvement Board shall consist of property owners,residents,business operators,
or users of space within the business area to be improved. Ms. Abbott meets the qualification by
being a proprietor of the French Café Inc. and is therefore a business owner and user of space within
the district. Ms Abbott is being appointed to replace Todd Heistand whose term ended September
17, 2006. I would recommend Ms. Abbott's appointment to the board to serve until her term shall
expire on September 17, 2011.

COST ASSUMPTION
The City of Omaha Police Department will continue the enforcement activities under Project
Night Life after funding assistance is terminated. The Project Officer and additional officer will
become a permanent addition to the Omaha Police Traffic Unit, Selective Enforcement Squad.
With long term sustainability the City will pay officer salary, benefits, vehicle and training
materials. Census data shows that the target population is annually refreshed with 5,500 new
drivers. Ongoing enforcement efforts will continue to be a need in our community.
**Acceptance of this grant is dependent upon approval of resolution by the Omaha City
Council.
r if there is a failure by the successful bidder(i.e.
the Contractor)to implement the stated agreements, intentions,objectives,goals,and comments set forth herein without prior approval of the Director of the Human
Relations Department, such action shall constitute a material breach of the contract, entitling the City of Omaha to reject the contractor's bid or to terminate the
Contract for default. The right to so terminate shall be in addition to,and not in lieu of,any other rights or remedies the City of Omaha may have for other defaults
under the Contract,under City of Omaha's Contract Compliance Ordinance or otherwise. Additionally,the Undersigned/Contractor will be subject to the terms of any
future Contract Awards.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, by virtue of Nebraska State Statutes, there now exists a Downtown
Business Improvement Area in Omaha as created by the City Council; and,
WHEREAS, Section 19-4021 of the Nebraska Revised Statutes provides for the
appointments to the Business Improvement Board to be made by the mayor, with approval of the
city council; and,
WHEREAS, Section 19-4021 of the Nebraska Revised Statutes provides further
that the members of the Business Improvement Board shall consist of property owners, residents,
business operators, or users of space within the business area to be improved; and,
WHEREAS, Section 19-4022 of the Nebraska Revised Statutes provides that a
Business Improvement Board shall consist of five or more members; and,
WHEREAS, the Mayor would like to appoint a new member to the Business
Improvement Board to replace Todd Heistand whose term expired on September 17, 2006; and,
WHEREAS, the City Council of the City of Omaha is being requested by Mayor
Mike Fahey to appoint Valerie J. Abbott of the French Café Inc. to be a member of the
Downtown Business Improvement Area Board to serve until her term shall expire on September
17, 2011.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the appointment by the Honorable Mike Fahey of Valerie J. Abbott of the
French Café Inc. to be a member of the Downtown Business Improvement Area Board to serve
until her term shall expire on September 17, 2011, is hereby confirmed by the City Council.
