Attached is a Resolution authorizing the City of Omaha to accept a grant contract award in the
amount of $70,162.00 from the Nebraska Office of Highway Safety, Grant Contract Award
Number 07-17 to support the Omaha Police Department's Project Night Life. The grant contract
period is from October 1, 2006 to September 30, 2007
The Project Night Life goal is to reduce motor vehicle accidents involving drivers between the
ages of 15-18, funding will expand training and awareness to law enforcement officers, target
high crash locations, increase knowledge of Provisional Operator Permit (POP) restrictions, and
increase enforcement of safety related violations. The total project cost is $109,762.00; the
Omaha Police Department will match $39,600.00 through Omaha Police Department general
funds as designated by the Finance Department.

SUMMARY
The Omaha Police Department (OPD) is dedicated to the reduction of vehicle crashes. Drivers
between the ages of 15-19 are responsible for a disproportional number of vehicle crashes.
Recognizing this, the State of Nebraska has a provisional operator's permit (POP) statute
(60-4,120.01) that provides for a graduated increase in driving responsibility and privileges.
This statute limits non-essential driving for 16 and 17 year old drivers to the hours between
midnight and 6:00 a.m. The exceptions are when these drivers are enroute to school or
employment. Drivers of this age account for a disproportionate number of total crashes,
especially those crashes that occur between midnight and 6:00 a.m. In the City of Omaha, the
problem may be exacerbated by midnight curfew ordinances in jurisdictions immediately
surrounding the city, which may have the effect of increasing the number of youthful drivers in
the City of Omaha.
Omaha has developed a significant population of young people who organize and participate in
"street racing," an activity which poses obvious dangers to all members of the driving public.
Much of this "street racing"takes place under cover of darkness. Spectators are an integral and
necessary part of this activity, and increased enforcement of the age restrictions on driving after
midnight will reduce the number of people participating in or observing street races. Recently,
one business owner in southwest Omaha sought to visit his own business late at night in an
industrial area, and encountered an illegal roadblock organized by young people for the purpose
of conducting a street race. This man was turned away from his own business by people who
told him "the street is closed."
Past enforcement efforts indicated it is extremely difficult to apprehend the drivers who are
involved in these events. Intensive effort often nets only three or four drivers per night. By
focusing on the young drivers who are spectators, or perhaps waiting for their chance to
participate, OPD can dissuade a larger number of people from participating in street racing
events. This will reduce the number of street racing events and the number of underage drivers
after midnight.
The City of Omaha faces a unique problem. It is surrounded by jurisdictions of substantial size,
many of which enacted teen curfews. This drives the teen population of Douglas County into
Omaha, where there is no curfew. This increases the risk for the motoring public and the risk of
accidents among the target population. Despite this push into Omaha after midnight, City

Prosecutor Marty Conboy advises there have been almost no tickets issued for violations of the
POP statute. Awareness of the statute and the need for enforcement is still building and needs
a stronger push in Omaha.
Younger drivers also account for a disproportionate number of crashes from 3:00-6:00 p.m., the
time following school dismissal. Project Night Life seeks to reduce the crash rate among young
drivers by addressing the driving violations that occur most frequently among young drivers and
by enforcing the state's graduated driver licensing (GDL) provisions.
Project Night Life will continue its success by:
• Reinforcing awareness and Education of area police officers regarding the Nebraska
GDL provisions. Despite being in effect for several years, these provisions are rarely
enforced. The City of Omaha Prosecutor's Office, which prosecutes all misdemeanor
and traffic citations issued in Douglas County, advises that Provisional Operator Permit
(POP) charges are quite rare (per City Prosecutor Marty Conboy).
• Continuing education of teen drivers regarding the need for adhering to these restrictions
and the penalties for failure to do so.
• Education and awareness of parents and encouraging their assistance in establishing
parental rules for teen drivers.
• Enforcement action, focused on the time and place where teen drivers congregate. The
operations will be enforced in known cruising areas surrounding shopping malls,
commercial retail areas and high schools during dismissal time.
ORGANIZATIONAL BACKGROUND
The Omaha Police Department is the primary law enforcement agency for the City of Omaha
and the largest agency in Douglas County, with a current authorized strength of 797 officers,
serving over 500,000 residents. The OPD includes a specialized Traffic Enforcement Section
consisting of three parts: a Canine Unit, a Selective Enforcement Squad, and an Accident
Investigation Unit. This grant will continued to be administered under the Selective Enforcement
Section of the Omaha Police Traffic Unit. The Traffic Unit has extensive experience in
successfully administrating grants and frequently has the leading DUI enforcement officers in
the state. The OPD has a proven history of administering grants and producing results. During
the last two years of implementation of Project Night Life, it has produced successful results.
Not only in the implementation of enforcement grants, but the population of teens and parents
reached during educational seminars.

PROBLEM IDENTIFICATION
Younger drivers were targeted for new and special restrictions by the Unicameral for
appropriate reasons. They have a dramatically disproportionate number of crashes for the size
of their license population. A POP holder is restricted from driving after midnight and before
6:00 a.m. unless for school or employment. Since the enactment of Project Night Life, fatalities
for drivers age 16-20 have decreased. A & B crashes have also decreased. The number of
offenses involving the Provisional Operator's Permit restrictions increased by over 80%.
Sixteen to twenty-year old drivers are also the target of under-age drinking and driving. The
zero tolerance law Section 60-6,211.01, which prohibits persons under twenty-one years of age
to operate or be in actual physical control of any motor vehicle when such person has a
concentration of two-hundredths of one gram or more by weight of alcohol per one hundred
milliliters of his /her blood, but less than eight-hundredths, as described by 60-6,196, will be a
focus of selective enforcement operations.
GOAL
The goal is to reduce 3-year average of Fatal, A and B injury crashes from 555 fatal by 7% in
2007 by drivers ages 15 to 18. Project Night Life will expand its efforts reaching more students
and parents with more seminars of education and awareness. Selective enforcement efforts will
continue monthly concentrating on high crash locations involving young drivers.
OBJECTIVES
1. Expand the training and awareness law enforcement officers, including new Omaha
Police Recruits, and surrounding local law enforcement agencies. The focus needs to
expand to surrounding agencies in a multi-agency effort. Training and awareness will be
increased with the assignment of a Project Night Life cruiser that will not only promote
the program, but also be used as an effective tool in educational and enforcement
efforts.
2. Target high-crash locations to increase enforcement during high-risk drive time. Increase
knowledge of POP restrictions among teen drivers by 50%.

BUDGET NARRATIVE
Salary: Full-time position to work in the Traffic Unit under the Project Night Life grant. Will continue to
educate law enforcement officers, recruit officers, students, parents, and the community regarding the
dangers and risks associated with under-age driving. Will participate in selective enforcement operations,
as well as routine selective enforcement based on identified hot spots.
Postage Costs: Upon scheduling of information seminars to local schools and communities, flyers and
informational brochures will be sent to the selective population using data base information provided by
local area schools and companion organizations, such as Project Extra Mile.
Training Materials. The total amounts shown are an estimated amount for this line item. Actual costs
and materials will vary according to the grantor approval and the project's specific needs.
Enforcement Operations: Selective enforcement operations will be spread throughout the entire grant
year. These enforcement operations will encompass ( 1 ) sergeant and up to (5) officers. The
enforcement operations will concentrate during the time frames where crashes for this age group are
highest(1500-1800), as well as during the P.O.P. restrictive hours (0000-0600). It is also desired to work
with other organizations, such as Project Extra Mile, in conjunctive selective enforcement operations.
COST ASSUMPTION
The City of Omaha Police Department will continue the enforcement activities under Project
Night Life after funding assistance is terminated. The Project Officer and additional officer will
become a permanent addition to the Omaha Police Traffic Unit, Selective Enforcement Squad.
With long term sustainability the City will pay officer salary, benefits, vehicle and training
materials. Census data shows that the target population is annually refreshed with 5,500 new
drivers. Ongoing enforcement efforts will continue to be a need in our community.
**Acceptance of this grant is dependent upon approval of resolution by the Omaha City
Council.
r if there is a failure by the successful bidder(i.e.
the Contractor)to implement the stated agreements, intentions,objectives,goals,and comments set forth herein without prior approval of the Director of the Human
Relations Department, such action shall constitute a material breach of the contract, entitling the City of Omaha to reject the contractor's bid or to terminate the
Contract for default. The right to so terminate shall be in addition to,and not in lieu of,any other rights or remedies the City of Omaha may have for other defaults
under the Contract,under City of Omaha's Contract Compliance Ordinance or otherwise. Additionally,the Undersigned/Contractor will be subject to the terms of any
future Contract Awards.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the Omaha Police Department has made an application to the
Nebraska Office of Highway Safety to seek funding to support the Omaha Police Department's
Project Night Life, to reduce motor vehicle accidents involving drivers between the ages of 15-
18; and,
WHEREAS, the Nebraska Office of Highway Safety, approved Grant Contract
Award Number 07-17, with special conditions in the amount of$70,162.00 to the Omaha Police
Department; with the grant contract period of October 1, 2006 to September 30, 2007; the total
project cost is $109,762.00; the Omaha Police Department will match $39,600.00 through
Omaha Police Department general funds as designated by the Finance Department and,
WHEREAS, it is in the best interest of the City of Omaha and the residents
thereof to accept this grant award.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the City Council does hereby approve the application for and approves the
acceptance of the Grant Contract Award Number 07-17, with special conditions, from the
Nebraska Office of Highway Safety in the amount of $70,162.00 for the Omaha Police
Department's Project Night Life; to reduce motor vehicle accidents involving drivers between
