The attached Ordinance is prepared at the request of the City Clerk..
The Ordinance waives prohibitions on the sale of beer, wine and distilled spirits before 12:00
noon on Sunday. If this Ordinance is adopted and sales are approved by the State, Ames Realty,
Inc., dba "Maplewood Lanes", will be allowed to sell beer, wine, and distilled spirits on Sunday
morning, February 19, 2006, beginning at 7:00 a.m. at 3030 North 101st Street in Omaha. This
business is hosting a bowling tournament during this time.
Although Omaha Municipal Code section 15-2(b) prohibits the sale of alcohol in the City prior
to 12:00 noon on Sundays,Nebraska statutes authorize the City to adopt an ordinance permitting
beer and wine to be sold prior to that hour and authorize the Liquor Control. Commission to
allow the holder of a special designated license to sell distilled spirits prior to that hour. This
Ordinance exercises that authority and waives the restrictions of Section 15-2 only with respect
to this specific liquor licensee on this specific day. The licensee has also applied for a special
designated license for this event and asks that the Liquor Control Commission waive the state
laws controlling the sale of distilled spirits on Sunday. That special designated license cannot be
granted by
the City Clerk and will be submitted for your consideration.

1 AN ORDINANCE to waive the provisions of Omaha Municipal Code section 15-2 prohibiting

6 WHEREAS, Nebraska Revised Statutes provide that no alcoholic liquor may be sold at
7 retail or dispensed before 12:00 noon on Sundays except as allowed by city ordinance or
8 authorized by an exemption granted by the Nebraska Liquor Control Commission to the holder
9 of a special designated license; and,
10 WHEREAS, Omaha Municipal Code section 15-2 provides that alcoholic liquor may not
11 be sold within the City before 12:00 noon on Sunday; and,
12 WHEREAS, Ames Realty, Inc., dba "Maplewood Lanes", 3030 North 101st Street,
13 Omaha, Nebraska, has requested permission to sell beer, wine, and distilled spirits on Sunday,
14 February 19, 2006, commencing at 7:00 a.m. during a bowling tournament; and,
15 WHEREAS, Ames Realty, Inc., dba "Maplewood Lanes", 3030 North 101st Street,
16 Omaha, Nebraska, has applied for a special designated liquor license for this event which would
17 allow the Nebraska Liquor Control Commission to waive statutory provisions prohibiting the
18 sale of distilled spirits on Sunday morning.
19 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
20 Section 1. Notwithstanding the prohibitions of Omaha Municipal Code section 15-2, the
21 City of Omaha authorizes and consents to the sale and consumption of beer, wine, and distilled
