Transmitted herewith is an Ordinance requested.by the Public Works Department providing for
the transfer of a Right-of-Way Easement to the Omaha Public Power District (OPPD). OPPD
will be moving power lines to City-owned property as a result of the City's construction project
on 144th Street from F Street to Q Street.
This Ordinance authorizes the Mayor to execute the attached Right-of-Way Easement which will.
transfer the property interest to the Omaha Public Power District. Your favorable consideration
of this ordinance is respectfully requested.

ORDINANCE NO. c_VO�2,9
AN ORDINANCE to transfer a Right-of-Way Easement in land to Omaha Public Power District
for purposes of relocating electric facilities as the result of the City's construction project
on 144th Street from F Street to Q Street; to authorize the Mayor to execute the attached
Right-of-Way Easement; and to provide an effective date thereof
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That the City of Omaha, notwithstanding the procedure outlined in Section
27-51 to 27-75 of the Omaha Municipal Code will transfer to the Omaha Public Power District a
Right-of-Way Easement to the extent it has any interest in the following piece of property:
The East Ten (10) feet of Lot 14 Block 10 of Englewood and the
East Ten (10) feet of Lots 301 and 302 of Walnut Grove all as
surveyed, platted and recorded in Douglas County, Nebraska.
Section 2. That the Mayor of the City of Omaha shall be authorized to execute the Right-
of-Way Easement attached to this Ordinance.
Section 3. That this Ordinance shall be in full force and take effect on the date of its passage.

RIGHT-OF-WAY EASEMENT
In consideration of the sum of One Dollar($1.00)and other valuable consideration,receipt of which is hereby
acknowledged, the CITY OF OMAHA does hereby grant to the OMAHA PUBLIC POWER DISTRICT, a
public corporation, its successors and assigns, hereafter referred to as "District", a permanent right of way
easement with rights of ingress and egress thereto, to construct, operate, maintain, replace and remove its
electric facilities, consisting of cables, wires, conduits, manholes, drains, splicing boxes and other
appurtenances,upon,over, along and under the following described real estate,to wit:
The East Ten(10)feet of Lot 14 Block 10 of Englewood and the East Ten(10)feet of Lots 301
and 302 of Walnut Grove all as surveyed,platted and recorded in Douglas County,Nebraska.
CONDITIONS:
The Grantor hereby grants to the District,its successors and assigns,the right,privilege and authority to clear
all trees,roots,brush,and other obstructions from the surface and subsurface of said strip and to temporarily
open any fences crossing said strip. Grantor agrees that grade shall not be reduced more than One foot(1')in
elevation without the prior approval of the District.
District agrees that no electric facilities or appurtenances shall be constructed above ground. In granting this
