The attached proposed Ordinance of Necessity authorizes the acquisition of a vacant lot within
the Miami Heights Redevelopment Plan area. The property is located at 3521 Ohio Street, as
shown on the attached map.
Together with privately acquired property, this lot will be the site of a new senior community
center serving the adjacent Salem Village and J. C. Wade Manor housing facilities. In a
proposed subsequent agreement, the City would convey the lot to the developer of Salem Village
who will construct the senior center.
The developer been unable to contact the property owner to privately purchase the property and
has asked that the City assist with the purchase of the lot. The City of Omaha will have the
property appraised and will offer just compensation to the property owner. If the City is unable
to negotiate the purchase price, the property will be acquired through eminent domain
proceedings. The acquisition of this property is for the development of housing for low-to-
moderate income families.
The City has allocated up to $250,000 in Community Development Block Grant funds in support
of this project. Funding is from the federal Community Planning and Development Program,
Fund 12186, Organization 131781.

AN ORDINANCE declaring the necessity of appropriating, for the use of the City of Omaha,
certain hereinafter described vacant property located within the Miami Heights

demolition of structures, preparation of sites, and subsequent use as sites for
implementing the Miami Heights Redevelopment Plan as a community center serving the
adjacent Salem Village senior housing facility; provided that as to each specified parcel
which cannot be obtained by negotiation, proceedings in eminent domain be undertaken
and completed; and, providing for the effective date hereof.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That it is proper and necessary, pursuant to the Nebraska Community
Development Law, to appropriate vacant and improved properties generally located in an area
bounded by Ohio Street, 34th Avenue, Lake Street, and 36t'' Street, as outlined on the attached
map, and that these vacant and improved properties necessary for such purpose are in Douglas
County, Nebraska and are more particularly described as follows:

Lot 11, Block 16, Omaha View, an addition to the City of Omaha, as surveyed,platted
and recorded in Douglas County, Nebraska.
