If any SUBDIVISION AGREEMENT AKSARBEN� PLACE, Lot 1, inclusive This Subdivision Agreement,made this 30- clay of Z ,200gy and between COLUMBO,LLC,a Nebraska Corporation(hereinafter referred to as"SUBDIVIDER" and the CITY OF OMAHA(hereinafter referred to as"CITY"). WHEREAS,the Subdivider is the owner of the land shown on the proposed plat attached hereto as Exhibit"A" (hereinafter referred to as"PROPERTY");and, WHEREAS,the Subdivider proposes to build private improvements on the property;and, WHEREAS,the Subdivider proposes to build public improvements off the property;and, WHEREAS,the Subdivider wishes to connect the system of sanitary sewers to be constructed within the property to the sewer system of the City of Omaha. WHEREAS,the Subdivider and City desire to agree on the method for the installations and who will maintain the private and public improvements shown on Exhibits"B"and"C",to be constructed to serve the property. NOW,THEREFORE,in consideration of the above the following s agreed between the parties hereto: 1. Public Improvements: a. The Subdivider shall construct public improvements,as shown on Exhibit"D",consisting of improving 63`d Street to City standards. The City shall obtain all necessary right of way for said improvements. b. The Subdivider shall not oppose the creation of a paving and sewer district for future improvements of Castellar Street. c. Such public improvements shall be owned and maintained by City of Omaha. 2. Private Improvements: The Subdivider shall construct private improvements as shown on Exhibits`B", "C"and"E". Such private improvements shall be owned and maintained by the subdivider. The Subdivider shall permanently close the west driveway entrance to Center Street after cross easements are obtained from and a paved connection is made to the property lying immediately west of this property.As shown on Exhibit"F". 3. Water,gas and electrical power: The Subdivider agrees to enter into and Agreement with the Metropolitan Utilities District regarding al water and gas line extensions on the property,and into an Agreement with the Omaha Public Power District for power lines to be installed on the property. Copies of all Agreements with the Metropolitan Utilities District and the Omaha Public Power District will be provided to the City within four months from the date this Agreement. 4. Sidewalks: Sidewalks exist along the frontage of the property. Replacement of sidewalk due to construction shall be reinstalled at the expense of the Subdivider. An interior pedestrian circulation system connecting to the public system will be provided that connects to the public system. Attached hereto as Exhibit`B"and incorporated herein by reference is the plat showing the proposed sidewalk system to be installed to serve the property. 5. Right to connect to City sewer system: The City hereby acknowledges that it has given to the Subdivider the right to connect the sanitary sewer system of the property to the City sanitary sewer system, subject to obtaining proper permits and paying the regular fees. 6.
