The attached Resolution cancels the Class "C" retail liquor license held by Straight Shooters, II,
Inc., dba "Straight Shooters' II" at 3929 Farnam Street, for violations of liquor laws and
regulations and for cause.
State statutes permit the City Council.to cancel or revoke a liquor license for cause or upon a
showing that the licensee has violated any provision of the Liquor Control Act or any regulation
relating to alcoholic liquor. City Councilmember Vokal has requested this Resolution. A
hearing has been scheduled in accordance with state law, and the.appropriate notice has been
given.
Omaha police report large disturbances and fights among this business's customers and evidence
that agents or employees of the licensee used improper methods to respond to the disturbances
on two dates listed in the Resolution. Nebraska Liquor Control Commission regulations prohibit
any licensee, or its employees or agents, from allowing.any brawl, fight, or other activity that
may endanger the patrons, employees, law enforcement officers, or members of the general
public within licensed premises or on adjacent related outdoor areas. If a disturbance occurs, the
licensee is to take reasonable actions to terminate the disturbance or, if those actions are not
• successful or may create danger to the licensee or its employees or agents, then police are to be
immediately called to assist. Physical force may be exercised only in extreme circumstances and
must be limited to the force reasonably required to terminate the disturbance and remove people
without endangering persons. The police reports show evidence that on two occasions when.
disturbances occurred in the business or immediately outside the business employees or agents of
the licensee used physical force against customers and exposed customers to pepper spray or
other incapacitating substances. On one occasion the pepper spray exposure required medical
treatment. In addition, when police investigated one of the disturbances they found the liquor
license was not posted in a conspicuous place as required by Commission regulations.

To provide a licensee due process, Omaha ordinances require a different procedure for a
cancellation hearing. The licensee first presents evidence in favor of continuing the license
(opposing the cancellation); persons opposed to continuing the license (in favor of the
cancellation) and the City then present evidence; and the licensee is allowed a rebuttal period.
The licensee or its attorney is allowed to ask questions of persons testifying in favor of the
cancellation. If the licensee or its attorney wishes to ask questions, they should sit at a
microphone at the side table and ask questions from there. The Council president may limit the
testimony or the questioning where it appears incompetent, irrelevant, unduly repetitious or
intended to harass the witness.
If you adopt this Resolution and cancel the license, Straight Shooters II, Inc., has 30 days in
which to appeal that decision to the Nebraska Liquor Control Commission. For that reason, the
cancellation is effective at the end of the appeal period. You may continue this cancellation
hearing to a later meeting, but state law requires that your decision must be made no later than
June 7, 2007.

MOTION BY COUNCILMEMBER
I hereby move that Council Document No. , Current Series, appearing as Item
No. 69 on the May 15, 2007 agenda of the City Council,be amended in the following respects:
1. A new paragraph should be inserted between the 5th and 6th paragraphs on page 1
reading as follows:
"WHEREAS, regulation 6-019.01Q, validly adopted by the Nebraska Liquor
Control Commission, prohibits a licensee knowingly allowing illegal activity to
be committed by others on the license premises or adjacent related outdoor areas;
and,"
2. The last `WHEREAS" paragraph, appearing on page 2 of the Resolution, is
amended to read as follows:
"WHEREAS, this City Council finds that Straight Shooters II, Inc., has violated
Nebraska Liquor Control Commission regulations 6-019,01F, 6-019.010, and 6-
019.01 Q by the aforementioned actions and that cause exists to cancel the retail
liquor license held by Straight Shooters II, Inc."

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, section 53-134 of the Nebraska Liquor Controi:Act, as amended,
• authorizes the Omaha City Council to cancel or revoke a retail liquor license within the city upon •
a showing of cause or that the licensee has violated any provision of the actor any valid and
subsisting ordinance or regulation relating to alcoholic liquor; and,
WHEREAS, Straight Shooters II, Inc., dba "Straight Shooters II" at 3929
Farnam Street in Omaha, Nebraska, holds a Class "C" liquor license; and, •
WHEREAS, Omaha Municipal Code section 15-42 provides that cause for
cancellation and/or revocation of a retail liquor license shall exist if the licensee has violated any
of the provisions of the Nebraska Liquor Control Act or any rule or regulation of the Nebraska
Liquor Control Commission enacted in the interest of good morals and decency; and,
• WHEREAS, regulation 019.01F, validly adopted by the Nebraska Liquor
Control Commission, prohibits a licensee or its agents or employees from allowing disturbances
• in the licensed premises or adjacentrelated outdoor areas that endangers patrons, employees, law
enforcement agents, and members of the general public, or from failing to take reasonable
actions as are reasonably necessary to terminate the activity or to immediately contact law
• enforcement personnel; and,
WHEREAS, regulation 019.010, validly adopted by the Nebraska Liquor
Control Commission,requires a licensee to frame its license and hang the license in plain view in
a conspicuous location on the licensed premises; and,
WHEREAS, regulation 6-019.01Q, validly adopted by the Nebraska Liquor
Control Commission, prohibits a licensee knowingly allowing illegal activity to be committed by
other's on the license premises or adjacent related outdoor areas; and,

WHEREAS, this Council has determined that on the following listed dates
Straight Shooters II, Inc., acting through its principals, employees, or agents, violated the listed
regulations:
February 24, 2007 Disturbance allowed on or about the premises
February 24, 2007 Improper use of pepper spray or another incapacitating
substance or physical force to terminate the disturbance
February 24, 2007 Failure to properly contact law enforcement personnel for
assistance in terminating the disturbance
February 24, 2007 Failure to properly display the liquor license
April 15, 2007 Disturbance allowed on or about the premises
April 15, 2007 Improper use of pepper spray or another incapacitating
substance or physical force to terminate the disturbance
April 15, 2007 Failure to properly contact law enforcement personnel for
assistance in terminating the disturbance;
and,
WHEREAS, this City Council finds that Straight Shooters II, Inc., has violated
Nebraska Liquor Control Commission regulations 6-019.01F, 6-019.010, AND 6-019.01Q by
the aforementioned actions and that cause exists to cancel the retail liquor license held by
Straight Shooters II, Inc.

Greetings to you, Mr. Vokal,
Due to my work schedule, I will be unable to attend the May 15 city
council meeting, regarding the liquor license of the bar called
'Straight Shooters II, ' located at 40th & Farnam.
Although I do not own property at that location, I am an independent
contractor renting my business space at Salon Namaste (pronounced
"nah-mah-STAY") , 4005 Farnam Street.
Please allow me to share my experience of working a half a block away
from 'Straight Shooters II Bar, ' on the same side of the street.
On a weekly basis, I sweep up trash and/or broken glass from smashed
beer and liquor bottles, in front of my business, before my patrons
arrive. On a "good day, " the bottles are left intact, sitting on the
narrow window sills of my business, there to greet me when I arrive
in the mornings.
I no longer take late night appointments, as of a year ago, due to
the raucous of the bar patrons, often outside the establishment.
Within two days of installing our brand new outdoor business sign
(two weeks ago) , I was saddened and frustrated to discover gang
graffiti sprayed in black paint on the cream-colored face of our
salon building, directly next to our brand new sign. (I called the
Mayor's Hotline, so this is on record, with police documentation. )
Upon further inspection, gang graffiti in white paint was sprayed all
over on the flat black roof of the building directly above our
salon. The perpetrators accessed our roof from the small parking lot
in back of the building, which is directly across the street, and to
the west of 'Straight Shooters II. ' What else did I see on the roof
- ? MORE empty beer & liquor bottles, right next to the gang
graffiti - which is STILL on the face of our salon building, AND on
the roof above.
(The Mayor's Hotline reported that they cannot cover graffiti which
is above ground level. . . . )
The small parking lot in back of the salon/building (shared with the
apartment complex located at 40th & Harney) is where I've personally
found many liquor & beer bottles, stuck in our building gutters, as
well as on the roof of the building. I remove the bottles from the
building gutters on a weekly basis, to prevent further damage to the
building (from blocked gutters) in which I am renting space.
I strongly urge you, Mr. Vokal, to rescind the liquor license for

• Straight Shooters II. I do not know what kind of clientele this bar
is attracting, but it is my opinion that our neighborhood would be
CLEANER AND SAFER, without this business in our neighborhood at all.

As you know, the 40th and Farnam area has a problem with Straight Shooters bar. My direct
impact is the trash, broken bottles and general litter on my Farnam and 39th St.frontages.
This is daily and varies in amount with the busier nights at Straight Shooters. We spend
between 25 and 45 minutes a day cleaning up after their customers. But more than the
importance of my trash problem is the problem of the street fights, the inbar fights and
the impact on the neighborhood in general. We have tried as a group to discuss the
problem with the owners and things only improve for a short time. Dan Houlahan, a
neighbor of mine on the block at Sullivans, has expressed countless problems of
harrassment to his customers resulting in a considerable dropoff in his business as his
customers are afraid to be there at night. I understand the Reading Grounds bookstore on
the corner of 40th and Farnam has had similar problems. I do not see why the rest of us
who try to take care of our property and the surrounding area have to accept or put up
with this problem. If the bar owners cared about this neighborhood at all, they would take
more responsibility for the actions of their customers both inside and outside of their

My name is Scott Reiling, and I am the resident manager of the M.G. Apartments
which are situated on the corner of 40th & Harney Street, across from Straight
Shooters II. I write to you at the behest of Mark and Jill Goodrich, who are the
owners of the M.G. Apartments. They have brought to my attention the hearing that
will take place next Tuesday, May 15th, 2007, concerning the liquor license of the
Straight Shooters II bar. I have been witness to many disorderly acts and
disrespectful behaviors displayed by the patrons of Straight Shooters II in the 20
months I have been resident manager. Incidents include, but are not limited to:
- Regulars of Straight Shooters II (who will here-on be referred
to as "patrons") parking in the rear parking lot of M.G. Apartments, despite
clearly visible posted signs in the lot denoting the lot as private, and stating
violators would be subject to towing.
An incident between patrons and employees of the A-1 Towing
company which caused A-1 to stop towing vehicles from the M.G. Apartments parking
lot during the bar's operating hours, due to the A-1 employees' fear of bodily
harm.
- An incident, during which Adam Nelson, who is a current
resident at M.G. Apartments, was physically accosted by patrons, in the M.G.
parking lot. Mr. Nelson was knocked out and money was stolen from him. A police
report was filed concerning this event.
Multiple confrontations between M.G. Apartment residents, and
said patrons. These confrontations were rarely physical, however they often
focused around the aforementioned parking spaces, to which the patrons had no
right. Please note that fear of these patrons has caused M.G. to lose at least
four residents, who did not renew their contracts after their year leases had
expired.
Numerous fights, some of which have included so many
individuals, that they spilled out onto the street and into the M.G. parking lot.
Many accounts of loitering by patrons in the M.G. parking lot
after Straight Shooters has closed. The activities of such patrons have included
sitting in their cars and play extremely loud music; starting fights amongst each
other, and littering.
- The morning after each "party" night at the Straight Shooters II
bar, I have walked into the parking lot and witnessed many broken and intact
bottles, McDonalds (or other fast food) bags, cigarette cases, and other evidence
of litter throughout the lot. Please keep in mind that I have personally witnessed
the littering take place, and thus, I am not simply making a correlation based upon
the evidence present.
Other crimes, such as attempted breaking and entering, as well as multiple
vandalizations of vehicles belonging to current residents, have also occured in
concordance with "party" nights during which there has been heavy traffic into and
out of the Straight Shooters II establishment.
If there is any way in which I can help at this meeting on Tuesday, please let me
know. The business owners around the area, and I, thank you for making this effort
to make our daily lives more pleasant.

I just recently read the article in the Omaha World Herald concerning the objections some
neighbors and businesses have expressed in regards to the manner in which Straight
Shooters II, the bar on the corner of 40th and Farnam, conducts its business. As the
president of the Tudor Arms Condominium Association, a community of 24 condominiums
located just north of 39th and Farnam and a mere half block away from Straight Shooters, I
have also had to field concerns from our very own residents in regards to this bar.
On a fairly consistent basis, our residents, as well as myself, have personally been a
witness to the following activities being partaken by their patrons: fights breaking out,
trash being thrown onto our lawn and having to be picked up by our building manager or
myself, drinking on and just outside of our property, drug use, money changing hands and
cars parking illegally in the alleyway adjacent to our building and in our back parking
lot, cars blasting their subwoofers and people shouting and yelling in the middle of the
night. Our community has had to deal with these activities on a case by case basis in the
past. However, I do not have the time nor energy to play citizen patrol and our
association simply cannot keep up. These activities need to stop immediately, and the
only reasonable and definitive solution in dealing with this problem is the REVOCATION of
their liquor license. These steps must be taken, especially at a time when our
neighborhood and the entire midtown area in general, are taking great strides in
revitalizing our community with new businesses and residences. Our resources and efforts
as a community can more effectively be placed elsewhere.
I may be voicing these concerns on the behalf of our association; however, I am also a
resident in close proximity of this business. As such, and on a very personal basis, I
simply do not feel safe in my own neighborhood. I am a medical student at the University
of Nebraska Medical Center. I have to constantly side-step broken bottles and beer cans
littering the sidewalks during my morning walks to school. This is simply unacceptable.
I understand that all legal business entities should have the right to conduct business as
they see fit, regardless of what that business may be (zoning laws and covenants aside) .
But the way in which that business conducts itself should not impede on the personal
safety, well being, nor rights to enjoy a peaceful and quiet living environment of those
residents living within that community. I am pleading for their liquor license to be
REVOKED. As I understand it, and on the basis of what was written in the Omaha World

City Councilman Vokal:
I was hoping to attend the city council meeting tomorrow regarding the possible liqueur
revocation the the Straight Shooter's Bar on 40th & Farnum. I will be out of town and
unable to attend but did want to express my feelings. My wife and I both come to 'Mid
Town' to spend our entertainment dollars. Whether it be eating in the Old Market or going
to meet our friends at Sullivan's. Quite frankly there have been times when my wife and I
have left Sullivan's that we did not feel safe because of being hassled by the patrons of
Straight Shooters. There comes a time when one has to ask himself if it is worth the risk
to be in that neighborhood after dark. I would like to continue coming to area, as it
stands now that is questionable. I would like to voice my recommendation to cancel the

Dear Mr. Vokal,
I am writing to you today because I was privileged enough to be privy
regarding information for a hearing concerning an establishment in the
Omaha Metro area. I am speaking of the Straight Shooters Bar on 40th
and Farnam St.
My interest is as such, because, I have been a patron at Sullivan's
Bar, located on Farnam St. , directly across from Straight Shooters,
for almost 10 years. A quick recap on my history w/ Sullivan's; It has
always been a decent bar, but really became a good place to hang out
under the current ownership. I believe Dan Houlihan has been the
proprietor for 7 or 8 years now. What he has done to the place is
nothing short of goodness concerning taste, service and the community.
Not only did he refurbish Sullivan's Bar, he restored it ! Greatly
increasing the value and overall ambience for customers, for years to
come. This leads me to why I am writing you. Straight Shooters has
been a nuisance ever since they opened up for business a few years
ago. I don't know what the causes are, but I have honestly never seen
such a cause for concern for safety as I do with the shenanigans that
go on at Straight Shooters week in and week out. To be as accurate as
possible, my patronage has dropped off over the last 2 years. Mainly because
of the hours I pull with my career, but before that, it was already
dwindling because I really didn't want to be around where the police
are called to subdue a mild riot regularly. That would happen, I would
say, 95% of the time on the weekends, and a far less percentage during the
week, but a percentage nevertheless. I have personally noticed that > over the
last 2 years, the customer base for Sullivan's has decreased by 50%. I believe
that is solely due to the overwhelming nuisance that the Straight Shooters Bar
is. I have personally been around for instances such as; when I went outside to
have a cigarette, a woman was getting harassed by lewd, upsetting
comments by patrons of Straight Shooters. She asked for my help, I
told her to go inside. They then started threatening and approaching me.
I, of course, went inside as well. Although that was the end of that, it
was an intimidating and completely unnecessary experience. Another
instance; I was sitting at the bar, I looked over towards the front
door, and saw a man, outside facing in, exposed and urinating right on
door. Unbelievable! The bartender went to end the public urination,
and the guy swung on the bartender and caught his ear. That was that,
but the man who urinated, quite naturally, went over to Straight
Shooters.
As mentioned earlier, the police are called nearly every weekend, to >
keep/restore order. These are things, I suppose, that could happen
anywhere at anytime, but every weekend? ! That is unacceptable for the
good paying customers of the business' that surround the area, as well
as for the community as a whole.
I wish I could attend the hearing, but my place of employment will not
facilitate that happening.

Saturday nights and has gotten worse with nice weather.
9-17-05 2 radio calls re. fight disturbance. Officers responded to find nothing.
Bouncer reported no problems.
10-14-05 Fugitive Unit on surveillance for a person observed fight at bar at 0015
hrs. The wanted person and two other people with warrants were
located and arrested.
11-4-05 At 0059 hrs. at 39th & Farnam, 8 males from SS argued with another
group of males — heard shots, arrest made. RB # 67031-F
11-11-05/ At 0049 hrs. 2 women fought in middle of street. Several more fights
11-12-05 broke out — mace used by police and crowd dispersed. No arrests.
Tavern report completed.
11-20-05 No officers, 0050 fight call, code 5. No caller to be seen.
2-3-06 Radio call by off-duty officer reporting a party being assaulted inside the
bar. Suspect fled, report was made. Tavern report completed.
2-19-06 0000 Hrs, intoxicated male observed.
4-2-06 0003 hrs. intoxicated male observed.

9-29-06 At 0143, call of fight disturbance at 3926 Farnam, Sullivans Bar. Small
crowd dispersed quickly, no actual fight. Officers were told that there
had been a large fight involving 20 — 25 people, 6 police officers came,
but no one was ticketed or arrested.
10-1-06 Report of 10 — 15 people fighting in the street.
10-5-06 Small crowd. Recorded video from 2330 — 0130 hrs. No problems, no
radio calls. Spoke with mgr. who stated that on Thursday nights they
are letting in 21 year olds. Prior to last month, the crowd was 25 years
of age or older. New policy has made crowds larger.
10-7-06 Large crowd of at least 50 exiting. Checked one party who appeared to
be urinating in the area. One traffic stop for obstructing traffic, expired
plates, & no insurance. Was flagged down by a patron who had left the
bar about an auto stolen from 41st & Farnam.
10-8-06 0055 hrs., 30 people walking outside, some with open beer
10-13-06 0022 — 0116 hrs. Sgt. Assignment to 40th & Farnam to observe Straight
Shooters II. Observed people congregating in the street/intersection,
jaywalking and pretending to fight.
10-14-06 0050 — 0120 hrs. Mild crowd, radio call of persons with warrants inside.
Officers on the scene ID'd 2 subjects. The rest of the crowd became
restless, insultive. Control was maintained with no problems.
10-27-06 Approximately 35 — 40 patrons exited. 12 — 15 loitered out front until
0105 hours. Officer advised people about loitering and the crowd left.
No problems.
10-28-06 Radio call of 50 people fighting. On arrival, bystanders advised that 2
females began physically fighting in the bar which triggered a large fight.
Bar employees deployed pepper spray inside and outside. Subjects
involved were gone on officer's arrival. One female bystander exposed
to pepper spray was treated but not transported by OFD Medic Unit.
Tavern report was completed. R.O. on scene for the remainder of the
assignment. The bar was pretty much empty. No other problems.
10-29-06 2030 hrs. Male in street yelling at passerby.
11-2-06 Fairly large crowd of approx. 50 — 60 people exited. Some loitered at
front for 1 — 2 minutes prior to leaving. Everyone gone by 0110 and no
problems.

11-3-06 Crowd of 20 — 25 congregated in front doors from 0050 — 0055. One
person came out agitated as if going to start a fight. Officer called for
additional cars and confronted the subject. Male was agitated and was
trying to leave but others were taunting him. Officers escorted him to his
vehicle. Traffic stop made for vehicle going the wrong way on Farnam
and driver was determined to be intoxicated.
11-10-06 Medium crowd, everyone left the area quickly. Yelled at one to turn
down music.
11-26-06 Medium sized crowd left. No problems. No loitering.
11-30-06 Approx. 20 people exited — no loitering, no problems.
12-1-06 25 — 30 people exited, no loitering no prob.
12-15-06 30-35 people exited the establishment. One traffic stop was made for
vehicle going the wrong way on Farnam St. No problems
12-16-06 40-50 people exited. No loitering or problems.
12-17-06 40-50 people loitering and screaming. They began to leave when officer
instructed them to. They went to Amoco on 40th and Dodge Street and
20 people started a disturbance there but left when instructed to by
officer.
12-22-06 Radio call @ 0020 for fight disturbance in street. 10-15 parties present
12-23-06 Large crowd gathered after closing. Officer instructed them to find their
cars and leave. Crowd then dispersed.
12-24-06 25 — 30 people gathered outside then dispersed when officer instructed
them to do so.
12-29-06 R/Os called for fight disturbance. Upon arrival, large crowd but no fight
seen. Crowd dispersed upon officers' request.
12-30-06 Small crowd of 15 — 20 people gathered after closing. All dispersed
when told to.
1-7-07 0055 — 0105, 5-10 people left. No problems.
1-12-07 No problems, but crowd from Shooters congregated at Bucky's 40`h &
Dodge were involved in an assault at 0110 hrs.
1-13-07 Small crowd, 20 — 25 people. Moved quickly to vehicles due to cold
weather. No problems.
1-14-07 Call received from citizen who said "Straight Shooters just let out and
they're dancing in the streets" and "There is no police presence here."
Officer on call at Straight Shooters reported only 2 people were outside.
Was a crowd at 40 & Dodge BP.

1-21-07 R/O recovered stolen vehicle from in front of Straight Shooters and two

intersection of 40 Farnam. Third car called with pepperball but crowd
left before 3rd cruiser arrived.
1-26-07 Two radio calls to Straight Shooters for fights (one was @ 4008
Harney). Large crowd 75+ people at Bucky's, 401h & Dodge. Traffic was
backed up from Dodge to south of Harney. Also, two radio calls to
Sullivan's for loud music.
1-27-07 30 — 35 people exited. No loitering, no problems, no crowd at 40th &
Dodge.
1-28-07 No problems. Few people loitering in front or across the street in the
parking lot.
2-2-07 3 arrests: 1)open container; 2)littering/urinating, 3)DUI
2-3-07 A lot of foot traffic. No further info.
2-8-07 Large crowd, no problems. Most went straight to Bucky's & McDonald's
@ 40th & Dodge.
2-15-07 Large crowd, no problems.
2-16-07 Large crowd, no problems.
2-17-07 20-30 people exited. No problems. Some loitering/slow walking due to
snow piled along curbs, sidewalks, and sides of streets.
2-18-07 30-40 people exited. One male attempted to confront another male on
40th Street just north of Farnam. 4 — 5 other people held back the male
keeping an actual assault from occurring. All involved left. No other
problems.
2-23-07 35 — 40 person crowd congregated on the sidewalk and street in front of
bar. Would not leave after several requests from officer who called for
more cars. Crowd moved with no incident.
2-24-07 Large crowd disturbance/fight. 40 - 50 person crowd. Several fights in
street and NW corner parking lot. Strong odor of pepper spray inside
business, possibly indicating fight started inside, causing employees to
discharge pepper spray. Tavern report completed/forwarded. One
arrest.
2-25-07 Small crowd, no problems.
3-2-07 Two arrests in the Dialysis Center: one for open container and one for
littering.

Straight Shooters were arguing over car keys. One party arrested on
misdemeanor warrant.

3-10-07 Small crowd. One patron said, "Fuck the police" to officers as he left the
bar. No other problems observed.
3-11-07 Crowd gathered and disregarded traffic and caused.a few traffic
problems. Disturbance at 40th & Dodge
3-16-07 Large crowd, 50 — 60 people leaving. House security guards did a good
job of keeping crowd moving. No problems.
3-17-07 Large crowd, minor arguments between a few patrons. Security
handled. No contacts made.
3-18-07 No problems observed. Call received reporting a large fight in street but
officers observed no incident.
3-25-07 5-10 people loitering in front with people jaywalking and obstructing
traffic.
3-31-07 40 — 50 people exited quickly. No problems. Heavy rain.
4-1-07 30 people left quickly due to rain

volume control criminal citation.

4-15-07 Injury report. Patrons refusing to disperse. Security at bar sprayed
pepper spray on sidewalk. Female was unable to breathe so squad was
called and transported to UNMC — tavern report completed.
4-20-07 Party cited for urinating on 139 S. 40 and marijuana possession. Large
crowd loitering and obstructing traffic. Security used mace at the ground
to disperse crowd.
4-21-07 Medium crowd. Approx. 20 people. No problems.

"Large crowd exited building. Fight started on Famam in front of establishment
and several other people joined in. When R/O [reporting officer] entered building
to obtain Liquor License info, strong odor of O.C. inside possibly indicating fight
started inside and employees discharged pepper spray. One person arrested for
Disorderly Conduct, Obstructing, Refusal to Leave. Copy of Liquor License
displayed on site was expired as of 10/31/06. Could not locate updated copy."

6-019-ILLEGAL CONDUCT: ALL LICENSEES:
019.01 Persons, partnerships, and/or corporations holding licenses issued pursuant to the
provisions of the Nebraska Liquor Control Act, Section 53-101, et seq., R.R.S. 1943, will be
subject to citation and possible administrative sanction to include suspension or revocation for
violation of the following:
019.01F Disturbance: No licensee or partner, principal, agent or employee of any licensee shall
allow any unreasonable disturbance, as such teiiu is defined hereunder, to continue without
taking the steps, as set forth hereunder, within a licensed premise or in adjacent related outdoor
areas.
019.01F1 A "Disturbance" as used in this section shall mean any brawl, fight, or other
activity which may endanger the patrons, employees, law enforcement officers, or
members of the general public within licensed premises or adjacent related outdoor area.
Such term shall include incidents involving, but not necessarily limited to: drug dealing;
intoxicated individuals; soliciting of prostitution; or any physical contact between the
licensee's agents or employees and its customers, involving any kissing, or an.y touching
of the breast, buttock or genital areas.
019.01F2 Unless there is reason to believe that a licensee or partner, principal, agent or
employee of any licensee would endanger himself/herself or others, such person shall
take such action as is reasonably necessary to terminate the disturbance. Physical force
should be exercised only in extreme circumstances and should be limited to the force
reasonably required to terminate the disturbance and remove the individual from the
licensed premise, without endangering any patron or other person.

019.010 Notices: Every licensee shall cause his license or licenses to be frarn-e.d and hung in
plain view in a conspicuous place on the licensed premises. (53-148) The warning to minor and
adults sign and the pregnancy poster must also be on display in a prominent place. (53-180.04
and 53-103.04)
019.01 Q Other Illegal Activities: The Commission finds that certain illegal activities may
induce individuals to enter licensed premises and that the Commission has an interest in insuring
that licensees do not use illegal means to promote the sale and consumption of alcohol. The
Commission also•believes the consumption of alcohol could impair judgment and could lessen
inhibitions, causing some consumers to engage in illegal activities or to be victims of illegal
activities on or about licensed premises, endangering the health, safety and welfare of
individuals. The Commission, therefore, finds there is a nexus between the consumption of .
alcohol and certain illegal activities that occur within licensed premises or in adjacent related
outdoor areas.
Such activities are: drug-related offenses, prostitution or pandering, assaults, sexual assaults,
homicide, gambling, vandalism, weapons-related offenses, theft, disturbing the peace, violations
of statutes or local ordinances relating to entertainment, acceptance of food stamps for the sale of
alcohol or otherwise in violation of federal laws or regulations, and any offense referred to in
Section 53-125 (4) or (5), whether or not there has been a plea of guilty or a conviction in
criminal court.
If the Commission finds by a preponderance of the evidence that a licensee or employee or agent
of a licensee has committed any of the foregoing illegal activities or has knowingly allowed such
offense to be committed by others on the licensed premises or adjacent related outdoor areas, the
Commission may suspend, cancel or revoke such license.

Per our converstation on Monday, 7 May 07, I have attached three pages
from the power point presentation used to train Omaha Police Officers during
basic recruit training. Recruits receive eight hours of training to include being
sprayed with OC directly into their face prior to being certified in the use of
OC.
The material specifically covers possible effects of OC when deployed on
suspects, The material provided was obtained from the National Law
Enforcement Training Center where I received my Instructor Certification.

I have included some pictures of last night.
Here is some context to help in understanding the pictures and what I have observed over
the last two Thursdays.
* This evening was much lighter than the previous week
* Last night, the crowd dispersed earlier
* Cars and people began really pouring in starting around 11: 00
* The two OPD Officers that are on the corner have a difficult
time managing what is going on because there is so much going on up and down the street
* The sidewalk on the West side of the bar is clogged with cars
forcing people to walk in the street heading South on 40th. In fact, the sidewalks are
too narrow to handle that type of use
* The crowd will walk in the middle of the street, stop cars, hold
up traffic, and expose themselves to being hit posing a huge safety issue
* Although this is a commercial building, Harney and Farnam, 41st
to 38th is loaded with residential apartments and homes, including a home directly behind
the bar. The amount of noise the police had to make plus the flashing lights with the
yelling and screaming must be maddening to those in the area
* There is a considerable amount of angst, tension, and hostility
between the customers of Straight Shooters, Sullivan' s, and Bucky' s that continues to
escalate

019.01F3 In the event efforts taken in accordance with the preceding subparagraph are
not successful or if there is reason to believe that the licensee, partner, principal, agent or
employee of any licensee may create a danger to himself/herself or others, than in such
event, such person should immediately contact law enforcement personnel to assist in
properly handling the disturbance. In the event law enforcement and/or medical
personnel are summoned, the directions and/or orders given by such law enforcement or
medical personnel shall be followed.
019.01F4 A licensee who has conformed with the procedure as set forth in this section
shall be deemed to have not permitted a disturbance to occur and continue.
