Mike Fahey,Mayor Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving Supplemental Agreement No. 1 to the Program Agreement between the City of Omaha and the State of Nebraska Department of Roads concerning the reconstruction of"Q" Street from 156th Street to 172nd Street, Project No. STPC- 3795(4), State Control Number 22147. The amendment allows for increased Federal funding of 100% of the construction cost up to $4,941,784 with remaining cost split 80% Federal and 20% City. The increased Federal funding reduces the City's and Douglas County's 20% •p&rt:tion from $1 ,580,000.00 to $163,643.20. The original agreement with the Nebraska Department of Roads for reconstruction of"Q" Street from 156th Street to 172nd Street was approved by the City Council by Resolution No. 442 on April 13, 2004. The details of the additional funding are described in the attached Supplemental Agreement. STPC-3795(4),STATE CONTROL NO.22147 Q STREET, 156T"TO 172" STREETS ROADWAY RECONSTRUCTION THIS SUPPLEMENTAL AGREEMENT,made and entered into by and between the City of Omaha, hereinafter referred to as the"City",and the State of Nebraska,Department of Roads, hereinafter referred to as the"State", WITNESSETH: WHEREAS,the State and City entered into an agreement executed by the City on April 15,2004, and by the State on May 5,2004,that provided for the reconstruction of 'Q'Street to a four-lane divided urban section,and WHEREAS,it now becomes necessary that the agreement be supplemented to update the total estimated cost of the project and to detail the funding cost sharing. NOW THEREFORE, in consideration of these facts,the State and City agree as follows: SECTION 1. The total estimated cost of the project has been revised to$5,760,000. Federal Discretionary(Earmark)Funds will be reimbursed to the City at 100 percent up to a maximum of $4,941,784. Any costs above the maximum discretionary funds will be split 80 percent Federal STP funds and 20 percent City of Omaha funds. SECTION 2. Except as specifically amended by this Supplemental Agreement, all terms and conditions of the agreement executed by the City on April 15,2004 and by the State on May 5, 2004 shall remain in full force and effect. 427Su'N 1 funding are described in the attached Supplemental Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, as recommended by the Mayor, Supplemental Agreement No. 1 to the Program Agreement between the City of Omaha and the State of Nebraska Department of Roads allowing for increased Federal funding participation in the reconstruction of "Q" Street from 156th Street to 172nd Street, Project No. STPC-3795(4), State Control Number 22147, is hereby approved. BE IT FURTHER RESOLVED: THAT, the Finance Department is authorized to pay the City of Omaha's and Douglas County's 20% share of the remaining cost of construction in the amount of $163,643.20 from the 2007 Issue Transportation Bond Organization 117112, 2006 Transportation Bond Fund 13182.
