Mike Fahey,Mayor • Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving an Agreement with Hawkins Construction Company for intersection improvements located at 168th Street and "S" Street and 1.68th Street and "V" Street in conjunction with the construction of OPW 50243, being the reconstruction of "Q"Street from 156th Street to 170th Street and 168th Street from `Q" Street approximately 1,200 linear feet north and 1,300 linear feet south,which is currently underway. The YMCA pf Greater Omaha and The Mission Park (S&ID 376) feel that it is in their best interest to have these improvements constructed under the current contract with Hawkins Construction Company. Both have agreed to help pay for these intersection improvements as detailed in the Agreement. Hawkins Construction Company has on file a current Contract Compliance Report Form (CC-1). • As is City policy, the Human Rights and Relations Director will review the contractor to ensure compliance v6th the Contract Compliance Ordinance. Hawkins Construction Company has agreed to construct the intersections described above in the amount of$4188,281.72. The City's share of the cost will be paid from 2007 Issue Transportation Bond Organization 117112, 2006 Transportation Bond Fund 13182, year 2007 expenditures in • the amount of $258,534.10. The YMCA of Greater Omaha will pay $100,000.00 and The Mission Park(S&ID 376)will pay$129,747.62. WHEREAS, The YMCA of Greater Omaha has an agreement with the City to pay for street improvements at 168th Street and "S" Street; and, WHEREAS, The YMCA of Greater Omaha shall be responsible for$100,000.00 for the improvements to the 168th Street and "S" Street intersection. WHEREAS, The Mission Park (S&ID No. 376) of Douglas County, Nebraska, has an agreement with the City to pay for improvements to the intersection of 168th Street and "V" Street, adjacent to S&ID No. 376. WHEREAS, The Mission Park (S&ID No. 376) of Douglas County, Nebraska, shall be responsible to pay for the cost of agreed improvements to 168th Street and "V" Street intersection in amount of$129,747.62. WHEREAS, The YMCA, The Mission Park (S&ID No. 376) and the City have determined that it is in the best interest of all parties to have the improvements constructed by Hawkins Construction to safely minimize disruption to the traveling public. WHEREAS, the parties hereto have reached an agreement concerning the additional work required to extend the reconstruction of 168th Street south to "V" Street. • WHEREAS, the parties have agreed the limits of the extension of the 168th Street reconstruction are from station 2623+88 to 2607+63.62. WHEREAS, the parties agree the estimated cost of the extension to $168th Street is approximately$488,281.72. WHEREAS, the parties have agreed that no incentive/disincentive clause will be established for the extension of the 168th Street reconstruction. Hawkins Construction will perform, or cause to perform, as appropriate, the following tasks: a. Cause the reconstruction to begin no later that August 15, 2007. b. Cause the reconstruction to be completed no later than November 15, 2007. c. Cause the reconstruction to be performed in accordance with the most current edition of the City of Omaha Standard Specifications for Public Works Construction, the plans, standard details and special provisions defined for the OPW 50143 "Q" Street from 156th Street to 170th Street contract. 2. The City shall provide funding for all the work items necessary to extend the reconstruction of 168th Street. Hawkins Construction shall be paid for work performed upon a unit price cost per the attached. 3. Hawkins Construction or City shall not, in the performance of this Agreement, discriminate or permit discrimination against any person because of race, sex, age, national origin, or political beliefs or affiliations in violation of federal or state laws. 4. This instrument contains the entire agreement of the parties and shall be binding upon the successors and assigns of the respective parties. Name Ai / Signature 0• CO ., Title r- tf—one O—F— % Fax 33Z. 1 , Address 3C S Zzo'k 3` .j Al . ‘s 0 Street/P.O.Box City State Zip itU r,l E-Mail Address aFU I° C-25A CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, the City of Omaha has a contract for OPW 50243 with Hawkins Construction Company to reconstruct "Q" Street from 156th Street to 170th Street, and 168th Street from "Q" Street approximately 1,200 linear feet north and 1,300 linear feet south; and, WHEREAS, The YMCA of Greater Omaha wish to pay for street improvements to the intersection at 168th Street and "S" Street and The Mission Park (S&ID No. 376) wish to pay for street improvements to the intersection of 168th Street and"V" Street as detailed in the Agreement; and, WHEREAS, the City of Omaha, The YMCA of Greater Omaha and The Mission Park (S&ID No. 376) have determined that is in the best interest of all parties to have these improvements constructed under the existing contract with Hawkins Construction to safely minimize disruption to the traveling public;and, WHEREAS, the attached Agreement with Hawkins Construction Company, which by this reference is made a part hereof, details the sharing of cost and responsibilities for these intersection improvements;and, WHEREAS, the City of Omaha's portion of these additional improvements will be $488,281.72 which will be paid from the 2007 Issue Transportation Bonds Organization 117112, 2006 Transportation Bond Fund 13182,year 2007 expenditures. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, as recommended by the Mayor, the Agreement with Hawkins Construction Company for intersection improvements at 168th Street and "S" Street and 168th Street and "V" Street in the amount of$488,281.72 is hereby approved; and,that the Finance Department is authorized to pay the City's share of the cost of these improvements in the amount of $258,534.10 from the 2007 Issue Transportation Bonds Organization 117112, 2006 Transportation Bond Fund 13182, year 2007 expenditures. The YMCA of Greater Omaha is paying $100,000.00 The Mission Park (S&ID No. 376)is paying$129,747.62.
