The attached Resolution approves the First Amendment to the Subdivision Agreement among Piney
Creek,Inc., Sanitary and Improvement District(S.&I.D.)465 of Douglas County,Nebraska and the
City of Omaha. This Subdivision Agreement covers the public improvement of Piney Creek Replat
2 (Lots 1-4), a subdivision located Northeast of Piney Creek Drive and Hopper Street.
The First Amendment to the Subdivision.Agreement covers the change in interceptor sewer fees due
by S.&I.D. 465.
The Public Works Department requests your consideration and approval of the attached Resolution
and First Amendment to the Subdivision Agreement.

THIS AGREEMENT,made and entered into this 41 day of ar,2007 by and between PINEY
CREEK,INC.,A NEBRASKA LIMITED LIABILITY COMPA Y(hereinafter referred to as"Subdivider"),
SANITARY AND IMPROVEMENT DISTRICT NO. 465 OF DOUGLAS COUNTY, NEBRASKA
(hereinafter referred to as"District"),and the CITY OF OMAHA,A MUNICIPAL CORPORATION IN THE
STATE OF NEBRASKA (hereinafter referred to as "City").
WITNES SETH
WHEREAS, Subdivider is the owner of the land included with the proposed plat attached hereto as Exhibit
"A",which parcel of land(hereinafter referred to as the"Area to be Developed")is outside the corporate limits
of the City and within the City's zoning and platting jurisdiction;and,
WHEREAS,the area to be rezoned and replatted are Lots 1 through 6,Piney Creek Replat 2,a subdivision
surveyed,platted,and recorded in Douglas County,Nebraska attached as Exhibit"A";the City entered into a
Subdivision agreement(hereinafter referred to as the"Agreement",amended by the City Council of the City of
Elkhorn on March 21,2005 setting forth certain conditions; and
WHEREAS, all public improvements necessary to service the Area to be Developed exist of have been
arranged for in the Agreement; and,
WHEREAS, Section I,paragraph A of the Amended Subdivision Agreement needs to be revised to show a
reallocation on a pro rata basis in the interceptor sewer fees required from the District as a result of the
rezoning.
NOW,THEREFORE,the following is agreed between the parties hereto:
1. The City agrees to amend the Agreement to provide for a reallocation on a pro rata basis to the
interceptor sewer fee paid by the District,computed as follows:
Previous Platting Fees Paid for Interceptor Sewers:
Lots 1-6,Piney Creek Replat,Single-Family
6 Units @ $1,050.00/Unit =$6,300.00
Lot 1-4 rezoned as R5.
4 Units @ $947.00/Unit =$3,788.00
TOTAL DUE TO THE DISTRICT $2,512.00
In all other respects, the Subdivision Agreement shall not be affected hereby and is hereby ratified and
confirmed. `.
IN WITNESS WHEREOF,we,the executing parties,by our respective duly authorized agents,hereby enter
into this Agreement effective on the day and year first above written.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: •
WHEREAS, Piney Creek, Inc. proposes to build a subdivision to be known as
Piney Creek Replat 2 (Lots 1-4) which will be located Northeast of Piney Creek Drive and
Hopper Street; and,
WHEREAS, Sanitary and Improvement District (S.&I.D.)465 has been formed to
build public improvements in this subdivision; and,
WHEREAS, S&ID 465 has paid $6,300.00 in interceptor sewer fees in
accordance with the original agreement adopted by the City Council of the City of Elkhorn on
March 22, 2005; and,
WHEREAS, S&ID 465 is subject to interceptor sewer fees of$3,788.00 based on
the replat; and,
WHEREAS, S&ID 465. is due a refund of $2,512.00 from the Interceptor Sewer
Fund; and,
WHEREAS, an Amendment to the Subdivision Agreement has been prepared
setting forth all the provisions mentioned above.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the First Amendment to the Subdivision Agreement among the City of
Omaha, Piney Creek, Inc. and Sanitary and Improvement District 465 of Douglas County,
Nebraska, as recommended by the Mayor, providing for the refund of interceptor sewer fees, is
hereby approved. The Subdivision is to be known as Piney Creek Replat 2 (Lots 1-4) and is
located Northeast of Piney Creek Drive and Hopper Street.
