The attached Resolution approves the Interlocal Cooperation Agreement between Sanitary and
Improvement District (S.&I.D.) 494 of Douglas County, Nebraska and the City of Omaha. This
Interlocal Cooperation Agreement covers the public improvement of Green Meadows, a
subdivision located.Northwest of 1.35th and Blondo Streets.
This Interlocal Cooperation Agreement stipulates which public improvements will be built by
S.&.I.D. 494, those which will be paid for by special assessment and those to be paid for by
General. Obligation of S.&I.D. 494.
Interceptor Sewer fees are not due since the plat was filed prior to the adoption of the Interceptor
Sewer Element of the Master Plan. Park fees will not be charged since the area is already
platted.
If S.&I.D. 494 is annexed by the City, any outstanding General. Obligation Debt would be
assumed by the City.
The Public Works Department requests your consideration and approval of the attached
. Resolution and Interlocal Cooperation Agreement.

SANITARY AND IMPROVEMENT DISTRICT NO. 494 (GREEN MEADOWS)
This Agreement is made and entered into by and between THE CITY OF OMAHA,
NEBRASKA (hereinafter referred to as "CITY") and SANITARY AND IMPROVEMENT
DISTRICT NO. 494 OF DOUGLAS COUNTY, NEBRASKA (hereinafter referred to as "SID
494"or the"District") .
PRELIMINARY STATEMENT
SID 494 is presently undertaking the infrastructure development of the real property
legally described as the Green Meadows Subdivision, a subdivision in Douglas County,
Nebraska, which is located northeast of 141 st Street and Blondo Street, in Douglas County,
Nebraska, which is within CITY's zoning jurisdiction and is bordered on three sides by
subdivisions within the city limits of CITY.
It is in the best interest and would be mutually advantageous to the City and SID 494 to
improve Green Meadows at this time (in a phasing schedule established by SID 494) as shown
on the site plan (the site plan) attached hereto as Exhibit "A" and incorporated herein by this
reference. Such improvements shall include, without limitation, the installation of a water
system, sanitary sewer, storm sewer and concrete pavement to serve Green Meadows. The
locations of these installations are shown on Exhibit "A". Also included in this project will be
reconstruction of driveway approaches and sidewalks, construction and relocation of storm
sewers and other drainage facilities, relocation of utilities, construction of roadways, and other
related improvements, all of which are hereinafter referred to as the "Improvements." The
Improvements shall be constructed in phases, according to a phasing schedule established by the

NOW, THEREFORE, in consideration of the covenants herein set forth, the CITY and
SID 494 do hereby agree and contract with each other as follows:
1. No Administrative Entity. There shall be no separate legal or administrative
entity created to administer this Agreement, and, therefore, no separate budget
established for such an entity.
2. Plans and Design. SID 494 will contract Thompson, Dreessen & Dorner, Inc.,
registered engineers in the State of Nebraska, for the preparation of plans and
specifications for the construction of each phase of the Improvements. The final
plans and specifications for each phase of the Improvements shall be subject to
approval by each of the parties hereto which approval shall not be unreasonably
withheld.
3. Payments for Improvements. Engineering design, construction administration,
construction management fees, legal fees, finance fees, and miscellaneous costs
related to SID funding of the project shall initially be paid by SID 494. Sidewalks
are to be built and paid for by owners as lots are developed. Interceptor Sewer
Fees will not be paid since the plat was recorded prior to the adoption of an
interceptor sewer plan, or fees. Park Fees will not be paid since this is already a
platted area.
4. Right-of-Way. All right-of-way or easements deemed necessary for the
construction of the Improvements shall be obtained by SID 494.

5. Construction. SID 494 agrees to cause the Improvements to be constructed in
separate phases according to a phasing schedule established by SID 494 in its
reasonable discretion and in accordance with the plans and specifications
approved by the parties hereto in accordance with Paragraph 2. During the course
of construction of the Improvements, the City may at any time cause inspection of
the work to insure compliance with the final plans and specifications. The parties
hereto agree that SID 494 will own, operate, and at its cost, maintain the
Improvements within the right-of-way upon completion until annexation by the
CITY. SID 494 will contract with Douglas County, Nebraska to provide traffic
control signage within Green Meadows.
6 Lake Street and Related Storm Sewer. —The City and SID 494 desire construction
of Lake Street and the Storm Sewer in Lake Street. The engineer's estimate of the
storm sewer costs for Lake Street is detailed on Exhibit "B". SID 494 alone is not
financially able, at this time, to construct this project. A major portion of the
storm water originates from areas within the City, but the City is not financially
able, at this time, to contribute to this project. Therefore, construction of the Lake
Street box culvert will not commence until the SID 494 fiscal agent deems it
appropriate. An Interlocal Agreement will be entered into between the City and

7. Purpose of Agreement: Timing of Work. It is the mutual desire and intention of

9. Duration. This Agreement shall continue until such time as the Improvements to
be performed by SID 494 and the CITY's financial obligations contained in this
Agreement, have been completed, unless this Agreement is terminated sooner by
the written agreement of all parties hereto.
10. Appointment of Administrators. The City of Omaha Public Works Director shall
administer this contract on behalf of the City. Thompson, Dreessen & Dorner,
Inc. shall administer this contract on behalf of SID 494.
11. Removal of the Building Moratorium. Except for lots which are subject to
flooding in the 100 year rain event, as shown on Exhibit "C", attached hereto, the
CITY's building moratorium will be lifted with respect to lots in Green Meadows
upon completion of water, sanitary sewer, paving and storm sewer, gas and power
Improvements serving such lots. Only those lots located in a phase for which all
of such Improvements have been completed, as certified by SID 494's engineers
and agreed to by City Public Works, will have the building moratorium lifted.

12. Sanitary Sewer. Subject to the conditions and provisions hereinafter specified,
the City hereby grants permission to the District to connect its sewer system to the
sewer system of the City, in such manner and at such place or places designated
on plans submitted by the District and approved by the City.
Without prior written approval by the City, the District shall not permit any sewer
lines or sewers outside the presently described boundaries to be connected to: the
sewer or sewer lines of the District, any sewer from the District's boundaries to
the sewers of the City, any outfall sewer of the City, or any sewage treatment
plant of the City. The City shall have exclusive control over connections to its
sewers whether inside or outside the District's boundaries. The District shall not
collect connection charges for such connections.
At all times all sewage from and through said District into the City sewer system
shall be in conformity with the ordinances, regulations, and conditions applicable
to sewers and sewage within the City as now existing and as from time to time
may be amended.
Before any connection from any premises to the sewer system of the District may
be made, a permit shall be obtained for said premises and its connection from the
proper department of the City, which permit shall be obtainable on the same
terms, conditions, and requirements of the City and for the same permit fee of the
City applicable from time to time to permit property outside the City to connect to
the sewer system of the City; it being expressly understood that the City reserves

required; all such connections shall comply with minimum standards prescribed
by the City.
Notwithstanding any other provisions of this Agreement, City retains the right to
disconnect the sewer of any industry, or other sewer user within the area to be
developed, which is discharging into the sewer system in violation of any
applicable ordinances, statute, rule, or regulation.
13. The District warrants that it has not employed or retained any company or person,
other than a bona fide employee working for the District, to solicit or secure this
Agreement, and that it has not paid or agreed to pay any company or person, other
than a bona fide employee working for the District, any fee, commission,
percentage, brokerage fee, gifts, or making of this Agreement. For breach or
violation of this warranty, the City shall have the right to annul this Agreement
without liability. The District shall require the same warranty from each
contractor with whom it contracts in any way pertaining to its sewage system.
The prohibition provided for herein shall not apply to the retention of an attorney
or other agent for the purpose of negotiating the provisions of this Agreement
where the existence of such agency has been disclosed to the City.
Subletting, assignment, or transfer of all or part of any interest of the District
hereunder is prohibited without prior written approval of the City of Omaha.

of the City of Omaha shall hereafter adopt or provide as being applicable
to or required in contracts with sanitary and improvement districts or in
order to permit or continue the discharge of any sewage from a sanitary
and improvement district to flow into or through any part of the sewer or
sewage system of the City of Omaha.
15. Nondiscrimination Clause. In accordance with the Nebraska Fair Employment
Practice Act, Neb. Rev. Stat. 48-1122, all parties to this agreement agree that they

or applicant for employment to be employed in the performance of this
agreement, with respect to hire, tenure, terms, conditions, or privileges of

WHEREAS,S.&I.D.494 proposes to build improvements in the subdivision known
as Green Meadows which is located Northwest of 135th and Blondo Streets; and, ,
..
WHEREAS,Sanitary and Improvement District(S.&I.D.)494 will build public and
private improvements in this subdivision; and,
WHEREAS, S.&I.D. 494 wishes to construct a sanitary sewer system and connect
said system to the Sanitary Sewer System of the City of Omaha; and,
WHEREAS,the parties wish to agree upon the manner and the extent to which public
funds may be expended in connection with public improvements to be constructed within the area to
be developed or serving the area to be developed and the extent to which the contemplated public
improvements specifically benefit property in the area to be developed and to what extent the cost of
the same shall be specially assessed; and,
WHEREAS,an Interlocal Cooperation Agreement has been prepared setting forth all
the provisions mentioned above.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT,the Interlocal Cooperation Agreement among the City of Omaha and Sanitary
and Improvement District 494 of Douglas .County, Nebraska, as recommended by the Mayor,
providing for the public improvements and sewer connection to the Omaha Sanitary Sewer System,
is hereby approved. The Subdivision is to be known as Green Meadows and is located Northwest of
135th and Blondo Streets.
