This Interlocal Cooperation Agreement covers the public improvement of Green Meadows, a subdivision located.Northwest of 1.35th and Blondo Streets. This Interlocal Cooperation Agreement stipulates which public improvements will be built by S.&.I.D. 494, those which will be paid for by special assessment and those to be paid for by General. Obligation of S.&I.D. 494. Interceptor Sewer fees are not due since the plat was filed prior to the adoption of the Interceptor Sewer Element of the Master Plan. Park fees will not be charged since the area is already platted. If S.&I.D. 494 is annexed by the City, any outstanding General. Obligation Debt would be assumed by the City. PRELIMINARY STATEMENT SID 494 is presently undertaking the infrastructure development of the real property legally described as the Green Meadows Subdivision, a subdivision in Douglas County, Nebraska, which is located northeast of 141 st Street and Blondo Street, in Douglas County, Nebraska, which is within CITY's zoning jurisdiction and is bordered on three sides by subdivisions within the city limits of CITY. It is in the best interest and would be mutually advantageous to the City and SID 494 to improve Green Meadows at this time (in a phasing schedule established by SID 494) as shown on the site plan (the site plan) attached hereto as Exhibit "A" and incorporated herein by this reference. Such improvements shall include, without limitation, the installation of a water system, sanitary sewer, storm sewer and concrete pavement to serve Green Meadows. The locations of these installations are shown on Exhibit "A". Also included in this project will be reconstruction of driveway approaches and sidewalks, construction and relocation of storm sewers and other drainage facilities, relocation of utilities, construction of roadways, and other related improvements, all of which are hereinafter referred to as the "Improvements." NOW, THEREFORE, in consideration of the covenants herein set forth, the CITY and SID 494 do hereby agree and contract with each other as follows: 1. No Administrative Entity. There shall be no separate legal or administrative entity created to administer this Agreement, and, therefore, no separate budget established for such an entity. 2. Plans and Design. SID 494 will contract Thompson, Dreessen & Dorner, Inc., registered engineers in the State of Nebraska, for the preparation of plans and specifications for the construction of each phase of the Improvements. The final plans and specifications for each phase of the Improvements shall be subject to approval by each of the parties hereto which approval shall not be unreasonably withheld. 3. Payments for Improvements. Engineering design, construction administration, construction management fees, legal fees, finance fees, and miscellaneous costs related to SID funding of the project shall initially be paid by SID 494. Sidewalks are to be built and paid for by owners as lots are developed. Interceptor Sewer Fees will not be paid since the plat was recorded prior to the adoption of an interceptor sewer plan, or fees. Park Fees will not be paid since this is already a platted area. 4. Construction. SID 494 agrees to cause the Improvements to be constructed in separate phases according to a phasing schedule established by SID 494 in its reasonable discretion and in accordance with the plans and specifications approved by the parties hereto in accordance with Paragraph 2. During the course of construction of the Improvements, the City may at any time cause inspection of the work to insure compliance with the final plans and specifications. The parties hereto agree that SID 494 will own, operate, and at its cost, maintain the Improvements within the right-of-way upon completion until annexation by the CITY. SID 494 will contract with Douglas County, Nebraska to provide traffic control signage within Green Meadows. 6 Lake Street and Related Storm Sewer. —The City and SID 494 desire construction of Lake Street and the Storm Sewer in Lake Street. The engineer's estimate of the storm sewer costs for Lake Street is detailed on Exhibit "B". SID 494 alone is not financially able, at this time, to construct this project. A major portion of the storm water originates from areas within the City, but the City is not financially able, at this time, to contribute to this project. Therefore, construction of the Lake Street box culvert will not commence until the SID 494 fiscal agent deems it appropriate. An Interlocal Agreement will be entered into between the City and District if City funds are available to participate in the construction of the Lake Street storm sewer 7.
