Mike Fahey,Mayor City Attorney
Honorable President
and Members of the City Council,
The attached Resolution is submitted by the City Law Department. It authorizes settlement of a
lawsuit pending in the District Court for Douglas County. If the Resolution is approved, the
settlement in the amount of$207,500.00 will be paid from the Judgment Fund to the Plaintiffs.
This case seeks recovery for the wrongful death of Chad Sieger, who drowned in the early
morning hours of July 22, 2004, when he was swept into a City storm sewer at the intersection of
108th and Borman Avenues. A wrongful death suit was subsequently initiated against the City of
Omaha by Andrew Sieger, the special administrator of the Estate of Chad Sieger, and included
the usual claims of injury and lost to the estate as well as pre-death pain and suffering.
Additional information about this case has been submitted to you in a confidential memorandum
and you may review that and discuss this matter further with the Law Department in an
Executive Session called to discuss this pending litigation if that is your desire.
Your favorable consideration of this Resolution is respectfully requested. The Law Depaitnient
believes passage of this Resolution to be in the best interest of the City of Omaha.
Respectfully submitted, Referred to City Council for Consideration:
