The attached Resolution is submitted by the City Law Department. It authorizes settlement of a
lawsuit pending in the District Court for Douglas County. If the Resolution is approved, the
settlement in the amount of $75,000.00 will be paid from the Contingent Liability Fund to the
Plaintiffs.
This case arises out of a trip and fall accident where there was a dislocation of approximately one
inch to two inches between adjoining sidewalk slabs on a concrete walkway in Tranquility Park.
Ms. Peters had been at the park facility to watch her grandson play soccer. As she walked on the
bridge connecting the soccer fields to the parking lot, she passed over the bridge and tripped over
the dislocation between adjoining slabs.
This matter has been fully investigated by the Law Department and it recommends that this
settlement in the amount of$75,000.00 is in the best interest of the City of Omaha.
Additional information about this case has been submitted to you in a confidential memorandum
and you may review that and discuss this matter further with the Law Department in an
Executive Session called to discuss this pending litigation if that is your desire.
Your favorable consideration of this Resolution is respectfully requested. The Law Department
believes passage of this Resolution to be in the best interest of the City of Omaha.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,litigation is presently pending in the District Court for Douglas County,
Nebraska, in the case entitled Marie Peters v. City of Omaha, Doc. 1065, No. 528,in which the
Plaintiff alleges the City of Omaha is liable for a trip and fall accident where there was a dislocation
of approximately one inch to two inches between adjoining sidewalk slabs on a concrete walkway in
Tranquility Park; and,
WHEREAS, the allegations and contentions against the City of Omaha constitute
disputed claims; and,
WHEREAS, the City Council determines it is in the best interest of the City of
Omaha,upon the recommendation of the Law Department of the City of Omaha to avoid the costs
and uncertainty of trial and resolve this litigation by settlement.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the City of Omaha Law Department is hereby authorized to conclude the
pending litigation entitled Marie Peters v. City of Omaha, Doc. 1065, No. 528, by the entry of
settlement,including the exchange for the dismissal of all claims,by the payment of the full amount
of$75,000.00; said funds to be paid from the Contingent Liability Fund Judgment Fund No. 12112,
Organization No. 122101 and Account No. 46113.
