This Interlocal Agreement sets out the duties and responsibilities of the City of Omaha and Douglas County including those tasks for which each entity will be financially responsible. The agreement maybe terminated by the City of Omaha or Douglas County upon mutual consent or upon giving 60-days written notice. • The Public Works Department requests your approval of this ordinance. Each lot must provide the perimeter and interior landscaping area as required by this agreement in addition to the feature area improvements specified in Exhibit B.The mixed-use area in its entirety cannot exceed an impervious coverage of eighty-five percent(85%). E. To assure continuity and consistency in pedestrian improvements and site features, all lots will install specific sidewalks and site features following the design guidelines as provided in Exhibits B and El and the following criteria, for Lots 1 through 3 as a condition of building permit approval: 1. All pedestrian crossings must be distinguished from other driving surfaces by integrally colored crosswalks at least ten (10) feet in width. (Concrete must be colored throughout, not surface applied color such as paint or stain.) 2. Intersections of the plaza sidewalks with streets and driveways shall be defined by (4)four traffic bollards , (2) at each end of the crossing placed no closer than six (6) feet on center, at each intersection. 3. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Approval is hereby given to the attached Interlocal Agreement between the City of Omaha and Douglas County for the operation of the Offender Work Program with each party to bear any costs incurred in fulfilling its responsibilities. Said Interlocal Agreement with Douglas County provides a method for continued operation of the program and also clarifies each party's responsibilities and the interaction with the County Court system. Section 2. That the Mayor is authorized to sign and the City Clerk to attest the attached Interlocal Agreement with Douglas County which was previously approved by Douglas County on November 14, 2006. Rev. Stat. §13-801 et seq. (Reissue 1997) by and between the COUNTY OF DOUGLAS (County), a political subdivision organized and existing under the laws of the State of Nebraska located in Douglas County, Nebraska and the CITY OF OMAHA, a municipal corporation organized and existing under the laws of the State of Nebraska located in Douglas County (City). WHEREAS, the City and County believe that a partnership to continue operating the Offender Work Program would serve their mutual interests, be beneficial to City and County and for the joint use of their residents and would be permissible under the authority granted by the Nebraska Interlocal Corporation Act, Neb. Rev. Stat. §13-801, et seq. WHEREAS, the City, through its Public Works Department has operated a program known as the Offender Work Program, hereinafter referred to as ("Program"), for many years; and, WHEREAS, the Program allows offenders to satisfy the payment of fines and costs through maintenance and cleaning work throughout the City of Omaha through trash pick up, graffiti removal, and other similar tasks; and, WHEREAS, the City and County, through the Douglas County Department of Corrections, hereinafter referred to as ("County Corrections") have discussed a partnership in the administration and management of the Program; and, WHEREAS, the fact that the administration and oversight of the Program has not involved County Corrections has led to some concerns about the Program's interaction with the County Court; and, WHEREAS, City and County have decided to enter into an Agreement of partnership for oversight of the program. C) NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS SET FORTH HEREIN, THE PARTIES AGREE AS FOLLOWS: 1. Duties of the County Douglas County, through the Douglas County Department of Corrections, agrees to be responsible for: A. Enrolling offenders in the Program and informing offenders of Program rules and requirements. B. Communicating with court officers regarding receipt of payments from offenders in the program for unsatisfied fines and costs. C. Any costs related to these responsibilities. 3. Duties of the City The City of Omaha, through the Public Works Department, agrees to be responsible for: A. Setting the daily number of offender laborers and reporting locations by coordinating with the City of Omaha Parks Department, the Omaha Douglas County Building Commission and other departments/agencies using offender labor. B. Transporting the offenders from the assigned reporting location (currently 24`h and Hickory Street) to various work locations around the City. Transportation of offenders assigned to the Parks Department and the Building Commission, if • necessary, will be handled by those Departments. C. Documenting offenders' attendance, completion, and failure to complete assignments in the program and communicating this information to court officers as is necessary. D. Providing tools and materials appropriate for the offenders work assignments. E. Supervising offenders working in the Program. F. Responsible for technology maintenance and required upgrades. G. Any costs related to these responsibilities. 4. Duration of Agreement This Agreement shall be in full force and effect from and after its date of execution by the parties and shall continue in effect until terminated by either the County or City. This Agreement may be terminated upon mutual written consent of the parties or by either of the parties giving sixty (60) days written notice to the other of its intention to terminate the Agreement. 5. Administration No separate administrative or legal entity is created to administer this Agreement and no joint financing or budget is established for the same, except to the extent provided herein. City shall be responsible for overseeing the work Program. County shall be responsible for the general administrative work necessary as set forth in this Agreement. 6. Cooperation City and County further agree to cooperate and work together to keep the Program costs to a minimum while maximizing the benefit to the public by using the Program workforce. Performance Administration The County and the City shall perform the covenants of this Agreement through their respective employees and independent contractors. Except as specifically provided for herein, all property, real and personal, used in the performance of this Agreement, and existing at the end, shall be and remain that of the respective party as provided by law. 8. Interest of the City Pursuant to section 8.05 of the Home Rule Charter, no elected official or any officer or employee of the City shall have a financial interest, direct or indirect, in any City contract. Any violation of this section with the knowledge of the person or corporation contracting with the City shall render the contract voidable by the Mayor or Council. • 9. Authority The parties hereby declare and assert that all preconditions, including resolutions or ordinances have been passed and duly adopted authorizing the implementation, execution of this Interlocal Cooperation Agreement. 10. Records Each of the parties hereto agrees to prepare, keep and maintain records, in a method, location and for a time period satisfactory to the other, necessary to deternline that each was in compliance the terms of this Agreement. Each party shall have the right to audit and examine such records during usual business hours upon reasonable notice to the other. 11. Amendment/Merger This instrument contains the entire agreement between the parties and shall be binding on all successors and assigns of the respective parties. No written amendments, deletions, or additions shall be made to this Agreement except in writing signed by all parties. . • 12. Nondiscrimination Clause The parties shall not, in the performance of this Agreement, discriminate or permit discrimination in violation of federal or state laws or local ordinances because of race, color, sex, age, political or religious opinions, affiliations or national origin. 13. Choice of Law This Agreement shall be governed in all respects by the laws of the State of Nebraska and the venue for any litigation with respect hereto shall be in the courts of Douglas County, Nebraska. 14. Assignment and Delegation This Agreement is exclusive to the parties and rights may not be assigned nor duties delegated by either party except on prior written consent of the other party. Any attempted assignment or delegation without such approval shall be void and shall constitute a breach of the Agreement. 15. Release and Indemnity The County and the City shall each assume all risk of loss, indemnify the other party (the second party) against loss, and hold the second party, its employees, agents, assignees, and legal representatives harmless from all liabilities, demands, claims, suits, losses, causes of action, fines OWP Interlocal Agreement 2006 3 must be distinguished from other driving surfaces by integrally colored crosswalks at least ten (10) feet in width. (Concrete must be colored throughout, not surface applied color such as paint or stain.) 2. Insurance Both parties agree to provide at their own expense liability insurance or self insurance to indemnify them in the event that they become liable for the payment of a judgment based upon the acts or omissions of its agents and employees in performing this agreement. Each party shall provide a copy of said insurance policy or proof of self insurance to the other party upon written request. 17. Drug Free Policy Douglas County maintains a drug free workplace policy. The City of Omaha maintains a Drug and Alcohol policy which provides for zero tolerance for drug and alcohol abuse by its employees. Nondiscrimination Clause The parties shall not, in the performance of this Agreement, discriminate or permit discrimination in violation of federal or state laws or local ordinances because of race, color, sex, age, political or religious opinions, affiliations or national origin. 13. Choice of Law This Agreement shall be governed in all respects by the laws of the State of Nebraska and the venue for any litigation with respect hereto shall be in the courts of Douglas County, Nebraska. 14. Assignment and Delegation This Agreement is exclusive to the parties and rights may not be assigned nor duties delegated by either party except on prior written consent of the other party. Any attempted assignment or delegation without such approval shall be void and shall constitute a breach of the Agreement. 15. Release and Indemnity The County and the City shall each assume all risk of loss, indemnify the other party (the second party) against loss, and hold the second party, its employees, agents, assignees, and legal representatives harmless from all liabilities, demands, claims, suits, losses, causes of action, fines OWP Interlocal Agreement 2006 3 must be distinguished from other driving surfaces by integrally colored crosswalks at least ten (10) feet in width. (Concrete must be colored throughout, not surface applied color such as paint or stain.) 2. Intersections of the plaza sidewalks with streets and driveways shall be defined by (4)four traffic bollards , (2) at each end of the crossing placed no closer than six (6) feet on center, at each intersection. 3.
