Transmitted herewith is an Ordinance creating Street Improvement District (SID) 6873 and
Sanitary Sewer District SD1578 for the construction and improvement of streets, sanitary sewers,
and storm sewers from 84th Avenue to 85th Street, between. Decatur and Seward Streets.
Residential lots 1 though 33 has been created and will be assessed for the work. A map of the
area is attached.
The land was previously known as Lots 2, 3, 10 and 1 land a portion of Lots 1 and 12, Block 33,
West Dodge and Addition to the City of Omaha; therefore, a Sanitary & Improvement District
cannot be used to construct public improvements. A subdivision agreement for this area was
adopted on June 6, 2006 by Resolution. No. 525 and amended on April 17, 2007 by Resolution
No. 445. As part of the agreement, the City agreed to create street, sanitary sewer Districts to
finance the public improvement costs.
According to figures supplied by the developer, approximately $59,626.60 will be paid by the
City for sanitary sewers and assessed back to the properties benefited. Approximately
$235,568.89 will be paid for street paving and assessed back to the properties. The total.
estimated special assessment cost is $295,195.49 which will be paid from the Capital Special.
Assessment Fund 13573, Special Assessment Organization 116168. All assessments will be
divided equally among the residential lots.
Approximately $25,940.39 will be paid for street intersections from the 2006 Transportation
Bond Fund 13182, 2006 Issue of the 2006 Transportation Bond Organization 117111,
$147,025.44 will be paid for storm sewers from the 2000 Sewer Bond Fund 13116, Storm Sewer
Bond Organization 116251. These costs, totaling $172,965.83, are considered "General.
Obligation" costs in an S&ID and are not assessed back to the properties..,.

AN ORDINANCE creating Street Improvement District SID6873, and Sanitary Sewer District
SD1578 in the City of Omaha, for the purpose of improving Decatur Street from 84th
Avenue to 85th Street, Seward Street from 84th Avenue to 85th Street, and 84th Avenue
from Decatur Street to Seward Street, and 84th Terrace, by grading, curbing and paving,
and installing storm and sanitary sewers; fixing and defining the boundaries of said
District; authorizing acquisition of the necessary Right-of-Way for the construction of the
improvement; authorizing the design, management, and inspection of the improvement;
advertise for bids for the construction of the improvement; and to provide an effective
date hereof
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That Street Improvement District SID6873, and Sanitary Sewer District
SD 1578 is hereby created in the City of Omaha for the improvement of Decatur Street from 84th
Avenue to 85th Street, Seward Street from 84th Avenue to 85th Street, and 84th Avenue from
Decatur Street to Seward Street, and 84th Terrace, to City Standards. The streets, sanitary sewer,
and storm sewer will be constructed at the same time and all as part of the overall project, also
known as Project OPW 51051.
Section 2. The outer boundary of Street Improvement District 6873 shall include the
following Lands and Lots:
Lots 1 through 33 of Camden Creek, as approved by City Council Resolution
No. 525 adopted on June 6, 2006 and amended on April 17, 2007 by City
Council Resolution No. 445, and the extension of Decatur Street from 85th
Street east to 84th Avenue and the extension of Seward Street from 85th Street
east to the east right-of-way line of 84th Avenue.

The outer boundary of said District shall be the outer boundary of the lots hereinabove set
forth. The general area is shown in the attached Exhibit "A".
Section 3. That the Public Works Director or his designee is authorized to hire a
professional engineer to design the improvement, provide project management, inspect the
construction, and prepare an estimate of the cost of such improvements.
Section 4. That the Public Works Depaitment is hereby authorized and directed to
acquire any right-of-way needed for the construction of said street improvement to be constructed
in said district.
Section 5. That the Purchasing Agent of the City of Omaha or his designee is hereby
directed to advertise for and receive bids for a street and sewer installation with said bids to be
made under and in accordance with the plans and specifications to be prepared for and on file in
the office of the City Engineer.
Section 6. That the owners of the land in the district waives the right to challenge the
creation of this district, waives the "order-in" Resolution, waives the right to request damages
caused by grading elevation changes, and waive the right to challenge the assessments, as long as
the assessments are done according to this agreement. This waiver is binding on any successors
or assigns.
Section 7. The full cost (which includes construction, engineering, right-of-way,
construction management, and any other directly related costs) of any special assessments for
sanitary sewer, pavement, and sidewalks will be divided equally between Lots 1 through 33 of
Camden Creek. The full cost is estimated by the developers to be $295,195.49 plus engineering,
