Transmitted herewith is an Ordinance requested by the Public Works Department providing for
the transfer of a Permanent Easement near 18`h Street and Jaynes Street in Omaha, Nebraska to
Metropolitan Utilities District of Omaha. Metropolitan. Utilities District of Omaha will be
relocating an existing fire hydrant out of the way of proposed paving onto the ground for which
they are securing this easement. This relocation of a fire hydrant is necessary as a result of the
City's construction of the new Northeast Joint Use facility.
This Ordinance authorizes the mayor to execute the attached permanent easement which will
transfer the.property ert interest in Metropolitan Utilities District of Omaha.

AN ORDINANCE to grant a permanent easement for property near 18th Street and Jaynes Street
to Metropolitan Utilities District of Omaha for the purpose of constructing a fire hydrant
• and all appurtenances thereto, which is necessitated by construction of the City's
Northeast Joint Use facility; authorizing the Mayor to execute the attached Permanent
Easement; and to provide an effective date thereof.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That the City of Omaha notwithstanding the procedures outlined in Section
27-51 to 27-75 of the Omaha Municipal Code, will grant to the Metropolitan Utilities District a
permanent easement in property near 181" Street and Jaynes Street as described in the exhibit
attached to the Permanent Easement Agreement.
Section 2. That the Mayor of the City of Omaha is authorized to execute and the City
Clerk to attest, the Permanent Easement attached to this Ordinance.
Section 3. That this Ordinance shall be in full force and take effect on the date of its
passage.

THIS AGREEMENT, made this HA- day of , , 2007
between CITY OF OMAHA, a Body Corporation and Pol. ic, ("Grantor"), and
METROPOLITAN UTILITIES DISTRICT OF OMAHA, a Municipal Corporation and
Political Subdivision, ("Grantee"),
WITNESS:
Grantor, in consideration of the sum of Two Dollars ($2.00) and other valuable
consideration, receipt of which is hereby acknowledged, hereby grants to Metropolitan
Utilities District of Omaha, its successors and assigns, a permanent easement to install,
maintain, operate, repair, and remove, at any time, a fire hydrant and all appurtenances
thereto, together with the right of ingress and egress on, over, under and through lands
described as follows:
PERMANENT EASEMENT
A tract of land in Lot 1 of Robert H. Franzen Memorial Subdivision, a
subdivision, as surveyed, platted and recorded in Douglas County,
Nebraska and described as follows:
The westerly twenty feet (20') of the easterly one hundred five feet (105')
of the southerly twenty feet (20') of Lot 1 as it abuts the right-of-way of
Jaynes Street.
This permanent easement contains 0.0092 of an acre, more or less, and is
shown on the attached drawing hereto and made a part hereof by
reference.
TO HAVE AND TO HOLD said Permanent Easement to Grantee, Metropolitan
Utilities District of Omaha, its successors and assigns.
1. The Grantor and its successors and assigns shall not at any time erect,
construct or place any building or structure on or below the surface of the permanent
easement and shall not permit anyone else to do so.
2. The Grantee shall restore the soil excavated for any purpose hereunder, as
nearly as is reasonably possible, to its original condition and contour within a
reasonable time after the work is performed.
3. The Grantor is the lawful possessor of this real estate; has good, right and
lawtul a uthority to make such c;nveyance; and Grantor and its successors and assigns
shall warrant and defend this conveyance and shall indemnify and hold harmless
Grantee forever against claims of all persons asserting any right, title or interest prior to
or contrary to this conveyance.
4. The person executing this instrument has authority to execute it on behalf of
the City of Omaha.
