The Agreement provided partial funding in the amount of $600,000.00 for the rehabilitation of the Hill Hotel property, located at 505 South 16th Street, into 65 rental units. These funds leveraged $4.9 million in other public and private funding. The loan is secured by a Mortgage and Promissory Note in the amount of$600,000.00, filed with the Douglas County Register of Deeds on October 10, 1990, in Book 3543 on Page 426. The original terms of the Redevelopment Agreement and Promissory Note require payment in full upon sale or other transfer of interest. The Partnership must also make sure that at least 51 percent of the units are occupied by low and moderate-income households or made available, through the Partnership's best efforts, for occupancy by such households. The Partnership has operated this project in accordance with the agreement for 17 years, but now finds that it must sell it to another entity. The appraised value and purchase price are significantly lower than the amount originally invested in the rehabilitation of the property. The net cash flow through 2006 was only $25,783.00. The Partnership will realize a net loss of$1.8 million on the sale of the property. In an effort to reduce its loss, the Partnership has made written request to the City asking that it accept the present value of its interest as satisfaction of the debt rather than require full payment of$600,000.00. As a part of this agreement, the City provided a$600,000 Community Development Block Grant loan (CDBG) to the Joint Venture. The Partnership and the City recognize that the Joint Venture has operated the property in a manner consistent with the Redevelopment Agreement and, for a period of 18 years, has continued to provide affordable housing to residents of the downtown area. In addition, we have requested and the City has determined that the present value of the CDBG loan is $295,625. The City has indicated that the City would release the CDBG lien on the property if the Joint Venture were to pay $295,625 to the City. We are requesting that the Planning Department approve our request for repayment and discharge the Joint Venture from any further obligations upon payment.
