Such payment 11/19/2007 illegal, invalid, or unenforceable, there be added as a part of this lease a clause or provision as similar in terms to such illegal, invalid or unenforceable clause or provision as may be possible and be legal, valid and enforceable. Richard Wahl has been convicted of, or plead guilty to, the following charges: a. In approximately 1993, Mr. Wahl was arrested for DUI in Iowa City, Iowa. He was a 19 year old student at the University of Iowa at the time of the arrest. The judge in the DUI case entered a deferred judgment, pursuant to which the DUI would be eliminated from Mr. Wahi's record seven (7) years after the date of the judgment, provided that Mr. Wahl was not arrested in Iowa for any other criminal violations during such seven (7) year period. Mr. Wahl has had a clean record in Iowa since the 1993 DUI and assumes that the DUI has been eliminated from his record. However, Mr. Wahl is listing the 1993 DUI on this application in the interest of full disclosure to the Nebraska Liquor Control Commission (the "Commission"). b. In 1999, Mr. Wahl was a casino supervisor at the Hard Rock casino in Las Vegas. An individual who has been convicted of drug charges is prohibited from holding a gaming license in Las Vegas. As a result, the Hard Rock casino subjected its employees to random drug testing to ensure that they were not using drugs. Mr. Wahl did not (and does not) use drugs, however, in 1999 he was living with his girlfriend who used marijuana. An incident occurred in which the girlfriend's ex-boyfriend came to Mr. Wahl's apartment and started an altercation with Mr. Wahl. Due to the noise from the fight, a neighbor called the police. When the police officers arrived at the apartment, they saw marijuana in the apartment and charged Mr. Wahl with possession of marijuana. Although possession of marijuana is a felony offense in Las Vegas, Mr. Wahl pled guilty to a misdemeanor. Due to the drug offense on his record, Mr. Wahl lost his job with the Hard Rock casino and was prohibited from working as a dealer or casino supervisor at any other casinos in Las Vegas. c. In 2004 or 2005, Mr. Wahl was charged with DUI in Omaha, Nebraska. Mr. Wahl took a defensive driver course as part of his punishment for the DUI. As a result, the Hard Rock casino subjected its employees to random drug testing to ensure that they were not using drugs. Mr. Wahl did not (and does not) use drugs, however, in 1999 he was living with his girlfriend who used marijuana. An incident occurred in which the girlfriend's ex-boyfriend came to Mr. Wahl's apartment and started an altercation with Mr. Wahl. Due to the noise from the fight, a neighbor called the police. When the police officers arrived at the apartment, they saw marijuana in the apartment and charged Mr. Wahl with possession of marijuana. Although possession of marijuana is a felony offense in Las Vegas, Mr. Wahl pled guilty to a misdemeanor. Due to the drug offense on his record, Mr. Wahl lost his job with the Hard Rock casino and was prohibited from working as a dealer or casino supervisor at any other casinos in Las Vegas. c. In 2004 or 2005, Mr. Wahl was charged with DUI in Omaha, Nebraska. Mr. Wahl took a defensive driver course as part of his punishment for the DUI. Although Mr. Wahl has been charged with two (2) DUIs and one (1) drug possession, Mr. Wahl requests the Commission to consider the circumstances surrounding the 1999 drug possession charges in determining whether to approve him as the on-site manager for Nomad Lounge.
