This Subdivision Agreement covers the public improvement of Tripp Place Replat (Lots 1-13), a subdivision located Northwest of 144th Street and Ames Avenue. The Subdivision Agreement Amendment covers the change in interceptor sewer fees due by S.&I.D. 432. The Public Works Department requests your consideration and approval of the attached Resolution and Subdivision Agreement. STATE OF NEBRASKA(hereinafter referred to as"City"). WITNES SETH WHEREAS, Subdivider is the owner of the land included with the proposed plat attached hereto as Exhibit "A",which parcel of land(hereinafter referred to as the"Area to be Developed")is outside the corporate limits of the City and within the City's zoning and platting jurisdiction; and, WHEREAS,the City,and the District,previously entered into a Subdivision agreement(hereinafter referred to 1 as the"Agreement",adopted by the City Council of the City of Omaha on January 25,2005 via Res. No. 35 setting forth certain conditions; and, WHEREAS, no additional public improvements are required to serve the Area to be Developed; and, WHEREAS, Section IX,paragraph A of the Subdivision Agreement needs to be revised to show additional interceptor sewer fees required from the District as a result of the platting of the Property. NOW, THEREFORE,the following is agreed between the parties hereto: 1. The City agrees to amend the Agreement to provide for additional interceptor sewer fee paid by the District, computed as follows: Fees Previously Paid: • Lots 8-11, Hillsborough Pointe No. 3 4 Lots @ $947.00/Unit =($3,788.00) Fees Currently Due: Lots 1-13, Tripp Place Replat 13 Single Family Units @ $947.00/Unit =$12,311.00 TOTAL DUE TO THE CITY $8,523.00 In all other respects, the Subdivision Agreement shall not be affected hereby and is hereby ratified and confirmed. I C-25A I • CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, Tripp Homes LLC proposes to build a subdivision to be known as • Tripp Place Replat (Lots 1-13), which will be located Northwest of 144th Street and Ames Avenue; and, WHEREAS, Sanitary and Improvement District (S.&I.D.) 432 has been formed to build public improvements in this subdivision; and, WHEREAS, S.&I.D. 432 has paid $3,788.00 in interceptor sewer fees in accordance with the original agreement adopted by the City Council of the City of Omaha on January 25, 2005, via Resolution No. 35; and, WHEREAS, S.&I.D. 432 is subject to interceptor sewer fees of$12,311.00 based on the replat; and, WHEREAS, S.&I.D. 432 owes an additional $8,523.00 to the Interceptor Sewer Fund; and, WHEREAS, an Amendment to the Subdivision Agreement has been prepared setting forth all the provisions mentioned above. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Amendment to the Subdivision Agreement among the City of Omaha, Tripp Homes LLC and Sanitary and Improvement District 432 of Douglas County, Nebraska, as recommended by the Mayor, providing for the payment of additional interceptor sewer fees, is hereby approved. The Subdivision is to be known as Tripp Place Replat (Lots 1-13) and is located Northwest of 144th Street and Ames Avenue.
