The attached Resolution approves the Amendment to the Subdivision Agreement among
Copperfields, LLC, the Copperfields Homeowners Association, Sanitary and Improvement
District (S.&I.D.) 491 of Douglas County, Nebraska and the City of Omaha. This Subdivision.
Agreement covers the public improvement of Copperfields Replat 4 (Lots 1-4), a subdivision
located Southwest of 202nd Avenue and "C" Street.
The Subdivision Agreement Amendment covers the change in interceptor sewer fees due by
S.&I.D. 497.
The Public Works Department requests your consideration .and approval of the attached
Resolution and Subdivision Agreement.

which, with the view directly from the west, are clearly the best and otherwise least
obstructed views of the Barn itself. Please refer to the existing views of the Property shown

THIS ECOND AMEND ENT TO SUBDIVISION AGREEMENT is made and entered
into this f day of�Iuv�l ibci, 2007, by and between COPPERFIELDS, LLC, a Nebraska
limited liability company (hereinafter referred to as "Subdivider"), SANITARY AND
IMPROVEMENT DISTRICT NO. 491 OF DOUGLAS COUNTY, NEBRASKA (hereinafter
referred to as "District"), the COPPERFIELDS HOMEOWNERS ASSOCIATION, a Nebraska
not-for-profit corporation (hereinafter referred to as the "Association") and the CITY OF
OMAHA, a municipal corporation in the State of Nebraska(hereinafter referred to as "City").
WITNESSETH :
WHEREAS, Subdivider is the owner of the land included within the proposed plat
attached hereto as Exhibit "A", which parcel of land (hereinafter referred to as the "Area to be
Developed") is outside the corporate limits of the City and within the City zoning and platting
jurisdiction; and
WHEREAS, the Area to be Developed is a revised plat of an area, attached as Exhibit "A-
1", that the Subdivider, the City, and the District, entered into a Subdivision Agreement
(hereinafter referred to as the "Agreement"), adopted by the City Council of the City of Omaha
on September 23, 2003 via Resolution Number 1191, setting forth certain conditions; and
WHEREAS, the Agreement should be amended to reflect the new plat for Lots 1 through
4, Copperfields attached hereto as Exhibit "A-1" and to amend Exhibit "C" previously attached
to the Agreement attached hereto as Exhibit "C-1"; and
WHEREAS, Section IX of the Agreement should be revised to show a reallocation of the
interceptor sewer fees required from the District as a result of the new plat.
NOW, THEREFORE, the following is agreed between the parties hereto:
1. The District and City agree to amend the Agreement to provide for a reallocation
of the interceptor sewer fees paid by the District, computed as follows:

2. That Exhibit "A" of the Agreement be amended to show the replat (Exhibit "A-1"
attached hereto) to Lots 1 through 4, Copperfields Replat 4 (Exhibit "A-1" attached hereto).
3. The costs with respect to the Trails/Boulevards and Neighborhood and
Community Park were provided for in the Agreement, Section II, Paragraph S, approved and
adopted by the City Council of the City of Omaha on September 23, 2003 via Resolution
Number 1191.
Exhibit "A" to the Agreement is hereby amended to the extent shown on the attached
Exhibit "A-1".
Exhibit "C" to the Agreement is hereby amended to the extent shown on the attached
Exhibit "C-1".
In all other respects, the Agreement shall not be affected hereby and it is hereby ratified
and confirmed.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Copperfields, LLC proposes to build a subdivision to be known as
Copperfields Replat 4 (Lots 1-4) which will be located Southwest of 202nd Avenue and "C"
Street; and,
WHEREAS, Sanitary and Improvement District (S.&I.D.)491 has been formed to
build public improvements in this subdivision; and,
WHEREAS, S.&I.D. 491 has paid $2,841 in interceptor sewer fees in accordance
with the original agreement adopted by the City Council of the City of Omaha on September 23,
2003 via Resolution No. 1191; and,
WHEREAS, S.&I.D. 491 is subject to interceptor sewer fees of$3,788.00 based
on the replat; and,
WHEREAS, S.&I.D. 491 owes an additional $947 to the Interceptor Sewer Fund;
and,
WHEREAS, an Amendment to the Subdivision Agreement has been prepared
setting forth all the provisions mentioned above.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the Amendment to the Subdivision Agreement among the City of Omaha,
Copperfields, LLC, the Copperfields Homeowners Association, and Sanitary and Improvement
District 491 of Douglas County, Nebraska, as recommended by the Mayor, providing for the
payment of additional interceptor sewer fees, is hereby approved. The Subdivision is to be
known as Copperfields Replat 4 (Lots 1-4) and is located Southwest of 202nd Avenue and "C"
Street.
