This Subdivision. Agreement covers the public improvement of Copperfields Replat 4 (Lots 1-4), a subdivision located Southwest of 202nd Avenue and "C" Street. The Subdivision Agreement Amendment covers the change in interceptor sewer fees due by S.&I.D. 497. The Public Works Department requests your consideration .and approval of the attached Resolution and Subdivision Agreement. Please refer to the existing views of the Property shown in Exhibit A, which is attached hereto and incorporated herein by this reference. Please refer also to the aerial photographs attached hereto as Exhibit B and the photograph simulation showing a graphical rendering of the proposed Site attached hereto as Exhibit C, each of which are incorporated herein by this reference. Further location of the Facility on the southeast corner of the property would cause the Site to be closely proximate to State Street to the south without any buffering of views from traffic or neighboring properties. Such location would also substantially hinder potential future development on the Property, including parking for and/or access to the Barn for planned meetings and social events, and is therefore unacceptable to the Property owner. WITNESSETH : WHEREAS, Subdivider is the owner of the land included within the proposed plat attached hereto as Exhibit "A", which parcel of land (hereinafter referred to as the "Area to be Developed") is outside the corporate limits of the City and within the City zoning and platting jurisdiction; and WHEREAS, the Area to be Developed is a revised plat of an area, attached as Exhibit "A- 1", that the Subdivider, the City, and the District, entered into a Subdivision Agreement (hereinafter referred to as the "Agreement"), adopted by the City Council of the City of Omaha on September 23, 2003 via Resolution Number 1191, setting forth certain conditions; and WHEREAS, the Agreement should be amended to reflect the new plat for Lots 1 through 4, Copperfields attached hereto as Exhibit "A-1" and to amend Exhibit "C" previously attached to the Agreement attached hereto as Exhibit "C-1"; and WHEREAS, Section IX of the Agreement should be revised to show a reallocation of the interceptor sewer fees required from the District as a result of the new plat. NOW, THEREFORE, the following is agreed between the parties hereto: 1. That Exhibit "A" of the Agreement be amended to show the replat (Exhibit "A-1" attached hereto) to Lots 1 through 4, Copperfields Replat 4 (Exhibit "A-1" attached hereto). 3. The costs with respect to the Trails/Boulevards and Neighborhood and Community Park were provided for in the Agreement, Section II, Paragraph S, approved and adopted by the City Council of the City of Omaha on September 23, 2003 via Resolution Number 1191. Exhibit "A" to the Agreement is hereby amended to the extent shown on the attached Exhibit "A-1". Exhibit "C" to the Agreement is hereby amended to the extent shown on the attached Exhibit "C-1". In all other respects, the Agreement shall not be affected hereby and it is hereby ratified and confirmed.
