Mike Fahey,Mayor ` Public Works Director Honorable President and Members of the City Council, The attached Resolution approves the Subdivision Agreement between Douglas County School District No. 10, AKA Elkhorn School District and the City of Omaha. This Subdivision. Agreement covers the public improvement of Blue Sage Addition (Lot 1), a subdivision located Southeast of 204th Street and Blue Sage Parkway. This Subdivision Agreement stipulates which public improvements will be built by the Elkhorn School District. The total cost of improvements will be paid by the Elkhorn School District. The Public Works Department requests your consideration. and approval of the attached Resolution and Subdivision Agreement. WITNESSETH: WHEREAS, the Subdivider is the owner of the land included within the proposed plat of the Blue Sage Addition, Lot 1, which is attached hereto as Exhibit"A",which parcel of land (hereinafter referred to as the"area to be developed") is outside the corporate limits of the City but within the City's zoning and platting jurisdiction; and WHEREAS,the Subdivider proposes to develop the area to be developed as a public high school complex and to connect the system of sanitary sewers to be constructed within the area to be developed to the sewer system of the City; and WHEREAS,the Subdivider and the City wish to agree upon the development of the area to be developed and the connection to the sewer system of the City. NOW, THEREFORE, IT IS AGREED AS FOLLOWS: I. The Subdivider covenants that it shall A. Develop the area to be developed as a public high school complex consistent with the plat (Exhibit"A")and the overall site layout plan which is attached hereto as Exhibit"B". B. Construct a sidewalk along the south side of Blue Sage Parkway within the area to be developed in conjunction with the construction of the public high school, and construct a sidewalk along the west side of South H.W.S. C. The area to be developed has or has access to existing electrical, gas, and water services, and, if necessary, the Subdivider shall enter into agreements with the Omaha Public Power District and/or the Metropolitan Utilities District regarding the installation and/or extension of such utility services to and/or across the area to be developed, and such agreements will be provided as soon as available but in no event longer than four(4) months from the date of execution of this Subdivision Agreement. D. Implement the tree mitigation requirements in accordance with the Tree Survey And Mitigation Plan dated April 2007 prepared by Jacobson Satchell Consultants, which is incorporated herein by reference. In addition, the Subdivider expressly agrees that: (1) On or before July 1, 2010 it shall provide the City with written assurance that the tree mitigation requirements of the aforesaid Tree Survey And Mitigation Plan have been properly implemented in accordance with said Tree Survey And Mitigation Plan. (2) On or before July 1, 2011 it shall hire a qualified tree mitigation consultant to inspect the tree mitigation site and provide the Subdivider and the City with a written report of the status of the tree mitigation site. (3) On or before July 1, 2012 it and the aforesaid tree mitigation consultant and the City will meet at the tree mitigation site and inspect the status thereof, and if it is the consensus that the tree mitigation site is not in conformance with the Tree Survey And Mitigation Plan, then a remedy plan shall be developed by the Subdivider and its tree mitigation consultant and submitted to the City on or before September 1, 2012. E. Reconstruct, manage and monitor a prairie mitigation area in accordance with the Prairie Mitigation Plan dated August 2007 prepared by Jacobson Satchell Consultants,which is incorporated herein by reference. In addition,the Subdivider expressly agrees that: (1) On or before July 1, 2010 it shall provide the City with written assurance that the prairie mitigation requirements of the aforesaid Prairie Mitigation Plan have been properly implemented in accordance with said Prairie Mitigation Plan. (2) On or before July 1,2011 it shall hire a qualified prairie mitigation consultant to inspect the prairie mitigation site and provide the Subdivider and the City with a written report of the status of the prairie mitigation site. The parties agree that the entire cost of all improvements set out in Section I hereof, and the entire cost of developing the area to be developed, shall be paid by the Subdivider. III. In the performance of this Subdivision Agreement,the Subdivider shall not discriminate against any parties on account of race, national origin, sex, age,disability,political or religious affiliations in violation of federal or state laws or local ordinances. IV. A. Subject to the conditions and provisions hereinafter specified, the City hereby grants permission to the Subdivider to connect its sewer system to the sewer system of the City for a period not to exceed ten(10)years, in such manner and at such place or places designed on plans submitted by the Subdivider and approved by the City. B. Notwithstanding any other agreement involving the Subdivider to the contrary, the Subdivider shall not,without the prior written agreement of the City,permit any sewer lines or sewer systems outside the boundaries of the area to be developed to be connected to the sewer or sewer lines of the Subdivider. C. At all times all sewage from and through the area to be developed shall be in conformity with all applicable ordinances,regulations, and conditions as now exist and as from time to time may be enacted or amended. D. Before any connection from any premises to the sewer system of the area to be developed may be made, a permit shall be obtained for said premises and its connection from the proper department of the City,which permit shall be obtainable on the same terms, conditions, and requirements of the City and for the same permit, installation, and inspection fees of the City applicable from time to time; it being expressly understood that the City reserves the right to collect all connection charges and fees as required by City ordinances or rules now or hereafter in force; all such connections shall comply with the minimum standards prescribed by the City. E. Notwithstanding any other provisions of this Subdivision Agreement, the City retains the right to disconnect the sewer of any industry, or other sewer user,whether within or without the area to be developed, or whether within or without the area to be developed, which is discharging into the sewer system in violation of any applicable ordinance, statute, rule, or regulation. F. For breach or violation of this warranty, the City shall have the right to annul this Subdivision Agreement without liability. The Subdivider shall require the same warranty from each contractor with whom it contracts in any way pertaining to its sewage system. The prohibition provided for herein shall not apply to the retention of an attorney or other agent for the purpose of negotiating the provisions of this Subdivision Agreement where the existence of such agency has been disclosed to the City. G. The subletting, assignment, or transfer of all or part of any interest of the Subdivider hereunder is prohibited without the prior written approval of the City. H. The Subdivider expressly agrees that it is and that the area to be developed shall be: (1) Bound by and to any provisions of any ordinances,rules, regulations, and franchises hereafter made, adopted and granted by the City applicable to development areas which receive sanitary sewer service by and/or through the City; and, (2) Bound by any terms and provisions which by ordinance,resolution,rule, or franchise of the City shall hereafter adopt,grant or provide as being applicable to or required in contracts with development areas which receive sanitary sewer service by and/or through the City. V. A. The Subdivider shall pay to the City a connection charge in the amount of$114,460.92. This charge is computed as follows for the lot shown on the plat(Exhibit"A"): Lot 1 consisting of 58.10 total acres of which 22.26 acres consist of a public high school building,parking areas, developed land, and the land immediately adjacent to the facility which forms the useable part of the property, and of which 35.84 acres consist of unsewered playgrounds and sports activity areas and prairie, wetland and drainage easement areas, at$5,142.00 per acre times 22.26 acres equals$114,460.92. If the area to be developed is replatted, or if the use of the lot is changed, then the charge shall be changed by the City in conformance with requirements of City Municipal Code 31-259 as amended. B. In the event the Subdivider shall plat additional lots which will be in the area to be developed which it wishes to connect to the sewer system,then this Subdivision Agreement shall be amended by the parties to provide for payment of the charge for the additional lots. C. The City may collect, within the area to be developed, the City's installation,permit, and inspection fees, as provided by existing City ordinances, and its sewer use and connection fees as now or hereafter exist. Upon execution of this Subdivision Agreement, the Subdivider shall make payment to the City in cash or warrants immediately convertible into cash at par, in the amount as stated in Section V(A) of this Subdivision Agreement for Lot 1. V. A. The Subdivider shall pay to the City a connection charge in the amount of$114,460.92. This charge is computed as follows for the lot shown on the plat(Exhibit"A"): Lot 1 consisting of 58.10 total acres of which 22.26 acres consist of a public high school building,parking areas, developed land, and the land immediately adjacent to the facility which forms the useable part of the property, and of which 35.84 acres consist of unsewered playgrounds and sports activity areas and prairie, wetland and drainage easement areas, at$5,142.00 per acre times 22.26 acres equals$114,460.92. If the area to be developed is replatted, or if the use of the lot is changed, then the charge shall be changed by the City in conformance with requirements of City Municipal Code 31-259 as amended. B. In the event the Subdivider shall plat additional lots which will be in the area to be developed which it wishes to connect to the sewer system,then this Subdivision Agreement shall be amended by the parties to provide for payment of the charge for the additional lots. C. The City may collect, within the area to be developed, the City's installation,permit, and inspection fees, as provided by existing City ordinances, and its sewer use and connection fees as now or hereafter exist.
