Freeholders, Messrs. Thomas E. Stevens, John A. Moran and Kevin S. Kroger, submitted the
attached report concerning grade changes.
There were no damages awarded for either project. The report details the committee's
recommendations.
The Public Works Department requests your consideration and approval of the attached
Resolution.

PURPOSE OF THE REPORT
The purpose of this report is to describe and answer complains received from property owners in
the districts enumerated below. The Committee has estimated the loss in value, if any,sustained
by the individual parcels of real estate in these districts due to the establishment or change of
grade abutting the street and/or alley in the following locations:

Being the North/south Alley Between South 27th and 28`h Streets,
From Leavenworth Street to Mason Street, Omaha,Nebraska
Prior to the hearing date on January 18, 2008,the Committee made a plan-in-hand inspection of
the above captioned alley on January 16,2008. We observed the construction which had been
completed and studied each property for potential change of grade damages.
At the time of the hearing on January 18, 2008, only one property owner appeared before the
Committee: ..
Tract 10 — Continental Investments c/o Ron Anglim, 3116 South 93`d Avenue,
Omaha,NE 68124
Mr. Anglim indicated that the pavement of the alley was a huge improvement and
was concerned somewhat with the asphalt at the north end of the alley. He also was
concerned with persons parking vehicles in the alley, of which this Committee has
no jurisdiction. Mr. Harald Flatoen, P.E., Engineering Service Manager of the City
of Omaha stated that the alley width was 12 feet and was improved based on City
standards.
Conclusion: The Committee concluded that there is no damage to the above property and other
properties adjoining the alley resulting from the change of grade of the alley.
No other property owners appeared at the Committee meeting regarding this project.

Blondo Street Extension— l92nd to 204th Streets
Prior to the hearing date on January 18, 2008,the Committee made a plan-in-hand inspection of
this project on January 16,2008. We observed the construction which had been completed and
studied each property for potential change of grade damages.
At the time of the hearing on January 18, 2008, the following appeared before the Committee or
submitted a letter to the Committee:
Tracts 4 and 5 —Kevin G. McArdle, P. O. Box 592, Elkhorn, Omaha,NE 68022
Dan D. Stoller,attorney,provided the Committee with a letter from Kevin McArdle
dated January 17, 2008, which stated "the original road design was engineered to
leave the ditch open to carry the drainage water from south to north under Blondo
Street so the natural runoff would flow unobstructed. This did not occur and due to
the 20'vertical embankment and the relatively flat slope left by the final construction,
water now backs up against the new road embankment and ponds upstream of
Blondo Street,thus creating a basic wetlands of my property. Due to the adjustment
in grade to construct the `Blondo Street extension' my land has been relatively
worthless."
Conclusion: The Change of Grade Committee, along with Mr. Harald Flatoen, P.E.,
Engineering Service Manager, Omaha Public Works Department, reinspected this property on
January 28, 2008, and viewed the street change of grade. The Change of Grade Committee
concluded that there are no damages to the property resulting from the change of grade of the
street.

Tract 3 —Elkhorn Properties, L.L.C., 1502 South 190th Plaza, Omaha, NE 68130
Dan D. Stoller attorney, representing Fred Korth (also attending the meeting) with
Elkhorn Properties, L.L.C., submitted a letter to the Change of Grade Committee
outlining what Elkhorn Properties, L.L.C., considered damages to the property
affected by the change of grade of Blondo Street. Nine points were covered in his
letter and the information was presented and discussed with the Committee at the
meeting. He provided estimated costs of$73,296 evidenced by his attached Exhibit
C and indicated that the engineering costs for this work came to $12,000. He also
indicated that Elkhorn Properties, L.L.C., was required to purchase the land from
Kevin McArdle on the east for$35,000 to allow the toe of the slope for fill dirt to
extend far enough east to level the entire site, without the cost of a twenty foot high
retaining wall.
Conclusion: The Change of Grade Committee reinspected the property on January 28, 2008,
along with Harald Flatoen, P.E., Engineering Services Manager for the City of Omaha Public
Works Department. Mr. Stoller pointed out the areas discussed in his letter and the problems he
associated with the construction of the Blondo Street Extension. After considering the
information provided by Mr. Stoller, the Change of Grade Committee concluded there was no
damage to the property resulting from the change of grade of the street.
No other property owners appeared at the Committee meeting regarding this project.

CONCLUSIONS
After carefully considering the effect of the construction and the change of grade on all the
properties in the districts discussed in this report,the Change of Grade Committee made findings
as discussed above, and found no damage to any of the properties in any of the above-named
districts due to change of grade.

The City of Omaha is considering a reassessment of the assessable costs of
Elkhorn Street Improvement District No. 2003-2 (construction of West Blondo
Street/Honeysuckle Drive from 192nd Street to 2046 Street). If the decision is made to
reassess, the original assessments levied by the City of Elkhorn against the benefited
properties would be rescinded, and new recalculated reassessments would be levied
against those properties. Any payments already made by the owners of those properties
would be credited against the new reassessments.
The attached notice involves an initial phase of this process, in which the Omaha
City Council will consider whether any of the properties in the District have incurred
damages by any changes in grade. The Board of Equalization and the Omaha City
Council will make decisions on the actual reassessment plan on later dates in the future.
