Jones. The terms of the 1996 Deed of Trust securing this deferred loan provided for the partial financing of the purchase of property located at 4702 North 47th Street, such financing consisting of a CDBG Deferred Payment Loan in the original amount of $15,000.00. The terms of this loan provide for fifty percent (50%) depreciation after the first five years with the $7,500.00 balance remaining due upon sale or transfer. At the time of the rehabilitation, the City's lien was in second position behind a first mortgage in the original amount of$35,000.00. Ms. Jones is further indebted to HFC in the original amount of$18,498.87. Ms. Jones is elderly and qualifies as very low income. She is having difficulty making ends meet while raising her three grandchildren. A reverse mortgage would allow her to access the equity in her property. Wells Fargo Bank has approved a reverse mortgage in the approximate amount of$129,000.00 upon the condition that its lien is in first position. Ms. Jones will receive loan proceeds of approximately $67,000.00, an amount sufficient to repay the balances of her existing loans from Wells Fargo Bank and HFC, replace her car that was stolen, and cover reasonable closing costs. Underwriting for a reverse mortgage requires that the amount of the deed of trust include the maximum amount of interest that could accrue during the loan term. Consequently, $62,000.00 of the $129,000.00 loan amount represents that potential interest. This loan eliminates monthly loan payments and, thus allows Ms. Jones to retain more of her income for her daily needs. Ms. Jones has requested that the City subordinate its interest in the property to that to be acquired by Wells Fargo Bank. The proposed Resolution would authorize the Mayor to execute a Debt Subordination Agreement, in substantially the same form as "Exhibit A" to facilitate this reverse mortgage. Although this action does reduce the security of the City's interest, it should be approved due to hardship. This action would enable the elderly homeowner to improve her financial position to the point where she could cover her basic needs and to remain in her own home. Jones (hereinafter referred to as "Borrower") is now or hereafter may be indebted to Wells Fargo Bank NA (hereinafter referred to as "Bank A") on account of a loan in the amount of Thirty-five Thousand and 00/100 Dollars ($35,000.00) which indebtedness was incurred for the purpose of acquisition of property located at 4702 North 47th Street, Omaha, Nebraska and legally described as: Lots 65 and 66, Fontenelle View, an Addition to the City of Omaha, as surveyed, platted and recorded in Douglas County,Nebraska WHEREAS, the Borrower's above-described indebtedness to Bank A is secured by a Deed of Trust, which security interest was perfected on October 28, 1996, upon the filing of same with the Douglas County Register of Deeds, same being recorded on October 30, 1996, in Book 4856 on Page 382; and, WHEREAS,the Borrower is indebted to the City of Omaha(hereinafter referred to as "City") by virtue of a deferred payment loan made in the sum of Fifteen Thousand and 00/100 Dollars ($15,000.00), which indebtedness was also incurred for the purposes of partially financing the acquisition of the above-described property; and, WHEREAS, the Borrower's above-described indebtedness to the City is secured by a Deed of Trust and Promissory Note, which security interest was perfected on October 28, 1996, upon the filing of same with the Douglas County Register of Deeds, same being recorded on October 30, 1996, in Book 4856 at Page 387 and, WHEREAS, the Borrower is also indebted to Household Finance Corporation (hereinafter referred to as "Bank B") by virtue of loan made in the sum of Eighteen Thousand Four Hundred Ninety- eight and 87/100 Dollars ($18,498.87); and, WHEREAS, the Borrower's above-described indebtedness to Bank 13 is secured by a Deed of Trust and Promissory Note, which security interest was perfected on April 24, 2000, upon the filing of same with the Douglas County Register of Deeds, same being recorded on April 27, 2000, in Book 6028 at Page 272; and, WHEREAS, the Bank A is willing to make a loan in an amount not to exceed One Hundred Twenty-nine Thousand and 00/100 Dollars ($129,000.00), sufficient to refinance the balance of Bank A's current deed of trust, Bank B's deed of trust, include reasonable closing costs, and provide some funds to the Borrower, the proceeds of which loan to be used solely for the aforementioned purposes; and, n would authorize the Mayor to execute a Debt Subordination Agreement, in substantially the same form as "Exhibit A" to facilitate this reverse mortgage.
