Mumgaard, Deputy City Attorney SUBJECT: Liquor License Fence Rules—Practice Tee Appearing on the June 3, 2008, City Council agenda is an application for a liquor license at the Practice Tee, 5415 No. 72nd Street. The application will license the clubhouse and the outdoor driving range tee boxes. The submitted diagram shows the area of the driving range into which golf balls are hit will not be licensed. However, that presents difficulty in complying with the Liquor Control Commission's outdoor area fence rules and the application should be amended. Liquor Control Commission rules require that outdoor areas be fenced or delineated in some fashion. If no food is served in the area, it's a "beer garden" and must have a fence or wall sufficient to prevent "the uncontrolled entrance or exit of persons from the premises and [to prevent] the passing of alcoholic liquors to persons outside the premises." No openings are allowed. NLCC Reg. 012.07. If the area is used for the service of meals as well as alcohol, it is a "sidewalk café" and must only be contained "by a permanent fence, wall, railing, rope, or chain, defining the licensed area, provided that one open entrance not to exceed eight (8) feet shall be allowed." NLCC Reg. 012.08. .I'm told limited food service (hot dogs, chips, etc.) can be taken into the outdoor area of the Practice Tee, so it must comply with the "sidewalk café"regulation. The driving range's plans do not show the proposed outdoor area is completely surrounded by any fence. To correct this, the Practice Tee will be submitting a revised sketch licensing the entire driving range area, which is fenced. However, customers will not be allowed in that area. Practice Tee also says it will also extend a chain and post boundary enclosing the rest of the area. The City has asked the Commission to amend its fence rules and not distinguish between whether food is or is not served in an outdoor area. The Commission has declined to do so. The changes the Practice Tee must make show again that the regulations' distinction is unrealistic. Nonetheless, as amended, the area will comply with the fe, - :gulations.
