Dowd, Attorney at Law,has submitted a claim for wages in the amount of$103.68 due and owing to Frederick Hiykel, a City employee currently holding the position of Police Officer in the City of Omaha Police Department. The basis of this claim is that Mr. Hiykel believes he is entitled to be paid overtime for time spent testifying in court as the result of a subpoena in a criminal case which occurred while he was working off-duty in police uniform. It is the belief and contention of the City of Omaha Police Department and City of Omaha Law Department, that the claim should be denied for the reason that claimant was not entitled to be compensated for testifying, pursuant to a subpoena, about an incident that occurred while he was working off-duty, because he was not performing work for the City of Omaha during that time period. That your Affiant is a police officer with the City of Omaha and at all times material herein was covered by the Collective Bargaining Agreement between the City of Omaha and Omaha Police Union Local 101. 2. That Section 2 of Article 19 of the Collective Bargaining Agreement provides for the compensation for the required attendance in Court during off-duty time at a minimum of four(4) hours straight time or one and one-half(1 ''/2) times the number of hours in actual attendance, whichever is greater. 3. That on or about March 5, 2007 your Affiant appeared in Court as required by subpoena to testify in connection with a criminal misdemeanor charge for which he was entitled to a minimum of four(4)hours of straight time rate of$25.92,for a total of$103.68. 4. That your Affiant made claim for the payment of $103.68, on or about March 8, 2007, which was denied by the City of Omaha on March 30, 2007. d for testifying, pursuant to a subpoena, about an incident that occurred while he was working off-duty, because he was not performing work for the City of Omaha during that time period. C-25A CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS,Thomas F.Dowd,Attorney at Law,has submitted a claim for wages due and owing to Frederick Hiykel,current City employee holding the position of OmahaPolice Officer, "• in the City of Omaha Police Department; and, WHEREAS, the claim is submitted based on the contention of the claimant that he performed duties beyond his scheduled hours of employment and that he should receive overtime compensation for time performing those duties;and, WHEREAS,the City of Omaha recommends denial of the above-referenced claim by Frederick Hiykel for overtime compensation in the amount of one hundred three dollars and sixty- eight cents ($103.68) for the reason that the City of Omaha does not believe that Mr. Hiykel is entitled to compensation for this time. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT,the City Council determines that the complainant,Frederick Hiykel,has been properly compensated and that he was properly denied overtime pay in the amount of$103.68 for time spent testifying as a result of a subpoena that originated from his off-duty employment; and, therefore,his claim for underpayment of wages is hereby denied.
