Dowd,Attorney at Law,has submitted a claim for wages in the amount of$518.75.due and owing to Bruce Ferrell,City employee currently holding the position of Police Officer in the City of Omaha Police Department. The basis of this claim is that Mr.Ferrell believes he is entitled to be paid overtime for time spent traveling during his off-duty hours for testifying in court as the result of a subpoena in connection with his job duties. It is the belief and contention of the City of Omaha Police Department and City of Omaha Law Department, that the claim should be denied for the reason that claimant was not entitled to be compensated for off-duty time spent traveling to and from the subpoena, because he was not performing work for the City of Omaha during that time period. That your Affiant is a police officer with the City of Omaha and at all times material herein was covered by the Collective Bargaining Agreement between the City of Omaha and Omaha Police Union Local 101. 2. That Section 2 of Article 19 of the Collective Bargaining Agreement provides for compensation for the required attendance in Court during off-duty time at a minimum of four(4)hours straight time or one and one-half(1 Y2)times the number of hours in actual attendance, whichever is greater. 3. That Section 1 of Article 21 of the Collective Bargaining Agreement requires the payment of one and one-half(1 '/2 )hours of your Affiant's straight time hourly rate for all hours worked in excess of eight (8) hours per day. 4. That on or about August 23,2007 your Affiant worked five and one-half(5 '/2)hours in excess of his eight(8)hour shift in connection with his travel to Atlanta, Georgia to testify in the United States District Court for the District of Georgia pursuant to a subpoena in connection with his job duties as an office;that on or about August 24, e denied. That during the time periods referred to in paragraph 4 above,your Affiant's straight time hourly rate of pay is $27.67 and his overtime rate of pay was $41.50 per hour. 6. That in connection with your Affiant's performance of job duties referred to in paragraph 4,he made a claim with the City of Omaha for twelve and one-half(12 1/2) hours of overtime at the overtime rate of$41.50 for a total claim of$518.75 on or about September 4, 2007, which was denied by the City of Omaha on or about January 3, 2008. 7. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the City Council determines that the complainant, Bruce Ferrell, has been properly compensated and that he was properly denied overtime pay in the amount of$518.75 for time spent traveling during his off-duty hours as the result of a subpoena; and,therefore,his claim for underpayment of wages is hereby denied.
