The attached Resolution approves the Subdivision Agreement between PDM, Inc. and the City
of Omaha. This Subdivision Agreement covers the public improvement of 72 Blondo (Lots 1-3),
a subdivision located southeast of 72'd &Blondo Streets.
This Subdivision Agreement stipulates which improvements will be built by PDM, Inc., those
which will be paid for by special assessment and those to be paid for by PDM, Inc. The total
cost of improvements will be paid for by PDM, Inc.
The Public Works Department requests your consideration and approval of the attached
Resolution and Subdivision Agreement.

SUBDIVISION AGREEMENT
72 BLONDO
LOTS 1 THROUGH 3
This Subdivision Agreement,made this day of , 2008,by and
between PDM, INC, a Nebraska corporation (hereinafter referred to as "Subdivider"),
and the City of Omaha(hereinafter referred to as "City").
WHEREAS,the Subdivider is the owner of the land shown on the proposed plat attached
hereto as Exhibit"A"(hereinafter referred to as "Property"); and,
WHEREAS, the Subdivider wishes to connect the Property to the sewer system of the
City of Omaha.
NOW, THEREFORE, in consideration of the above, the following is agreed between the
parties hereto:
1. Public Improvements. All required public improvements exist.
2. Water. Water mains exist to serve the Property.
3. Power. Electrical power exists to serve the Property.
4. Right to Connect to City Sewer System. The City hereby acknowledges that it
has given the Subdivider the right to connect the Property to the City sanitary
sewer system, subject to obtaining proper permits and paying the regular fees
for sanitary sewer.
5. Sidewalks. Public sidewalks exist.
6. Retaining Walls. The repair,reconstruction or relocation of the existing
retaining wall adjacent to Lots 1 and 2 along 72nd Street and Blondo Street
right of ways shall be addressed with the Public Works Department at the time
that applications for building permits for said lots are submitted. Subdivider
shall require the purchasers of Lots 1 and 2 to assume this responsibility as a
condition of sale.

parties, their successors and assigns, and shall run with the land shown on
Exhibit"A".

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, PDM, Inc. proposes to build a subdivision to be known as 72 Blondo
(Lots 1-3)which will be located southeast of 72"a &Blondo Streets; and,
WHEREAS, PDM, Inc. will build public and private improvements in this
subdivision; and,
WHEREAS,PDM,Inc.wishes to construct a sanitary sewer system and connect said
system to the Sanitary Sewer System of the City of Omaha; and,
WHEREAS,the parties wish to agree upon the manner and the extent to which public
funds may be expended in connection with public improvements to be constructed within the area to
be developed or serving the area to be developed and the extent to which the contemplated public
improvements specifically benefit property in the area to be developed and to what extent the cost of
the same shall be specially assessed; and,
WHEREAS, a Subdivision Agreement has been prepared setting forth all the
provisions mentioned above.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the Subdivision Agreement between the City of Omaha and PDM, Inc., as
recommended by the Mayor, providing for the public improvements and sewer connection to the
Omaha Sanitary Sewer System, is hereby approved. The Subdivision is to be known as 72 Blondo
(Lots 1-3) and is located southeast of 72nd &Blondo Streets.
