GENERAL INFORMATION: Purpose: To plat, replat, and rezone 4.4 acres into eleven (11) lots for new single family residential lots. Existing Use(s): Single family residential Existing Zoning: AG, DR (Pending) Adjacent Land Use(s): Adjacent Zoning: North: Vacant (Future Vistancia) North: AG (R4 Pending) South: Single family residential/Civic South: R4 East: Vacant (Future Vistancia) East: AG (R4 Pending) West: Vacant (Future Vistancia) West: DR, R4 Future Land Use Designation(s): Low-Density Residential Zoning History: • C3-19-262, C10-18-219, C12-18-220: Final Plat approval of VISTANCIA (Lots 301-512, Outlots J-L), with rezoning from AG to DR, R4, and R5, approved by Planning Board June 3, 2020 (City Council approval pending) • C10-18-219, C12-18-220: Final Plat approval of VISTANCIA (Phase 1) with rezoning from AG to DR, R4 and R5, approved by City Council on September 10, 2019. • C3-18-218: Variance to the Present Development Zone boundary, approved by City Council with Preliminary Plat on November 20, 2018. • C3-08-056: To amend the City of Omaha's official zoning map to reflect the conversions from Elkhorn and Douglas County zoning to Omaha's most comparable zoning districts, April 22, 2008. • C3-07-042: Approval of the adoption of the Elkhorn Master Plan to take effect in those areas not covered by the current Omaha Master Plan, approved by City Council on May 1, 2007. Applicable Regulations: If approved, the site is subject to compliance with R4-Single-Family Residential District (High Density), as well as all other applicable development regulations. No building permits will be issued based on a site plan that does not comply with the provisions of the Zoning Ordinance. Date: August 26, 2020 Case Number: C10-18-219, C12-18-220 Applicant: Falcone Land Development Request: Preliminary and Final Plat approval of VISTANCIA (Lots 513-523), a minor plat outside city limits, with rezoning from AG-Agriculture District and DR- Development Reserve District to R4-Single-Family Residential District (High Density) Location: Northwest of 210th and Fort Streets Case Number: C10-18-219, C12-18-220 VISTANCIA (Lots 513-523) Page: 2 GS II. SPECIAL INFORMATION: Site Characteristics: The site is approximately 4.4 acres and consists of an existing single family residence and a separate detached building. The site is generally flat. The property currently has access to Fort Street from the south. Development Proposal: The applicant is proposing to replat Outlot “I”, Vistancia and plat the subject property into eleven lots for the construction of single family residences Utilities: Omaha Public Power District (OPPD) has existing distribution equipment on or near the property. Coordinate with OPPD on removal/relocation of equipment if necessary. Public Improvements: The proposed street connection from the development to Fort Street will require permits from the Douglas Count Engineer’s Office and must meet proper sight distance criteria and incorporate intersection improvements as required by current City/County Access Policy. The cost of the roadway improvements for the street connection, if required, will be the responsibility of the developer. The sight distance criteria to be used in the evaluation, of the street connection, will be AASHTO Stopping Sight Distance for 50 MPH design (425’). Storm Sewer design computations and final plans must be submitted to the Douglas County Engineer’s Office for review that relate to the handling of roadway and site drainage along the development boundary adjacent to Fort Street. Coordinate with the City of Omaha Public Works on an acceptable G.O. paving plan. On the 208th Street approach to Fort Street, provide a 16 foot inbound land, a 4 foot paved median, and two 12 foot outbound lanes, and dedicate right- of-way as needed to accommodate. As part of the paving public improvements, remove the temporary connection to Fort Street south of 208th Avenue and Ogden Street. Provide a right-of-way dedication on the northeast corner of 207th and Ogden Streets to accommodate the corner curb ramps. Coordinate with the Planning and Public Works Departments on the Complete Streets Design Guide Design Checklists. Submit the 30% design report for the sanitary sewer to the Public Works Design Division per Section 2.14 of the City’s Wastewater Collection System Design Manual. A note must be placed on the plat stating direct access to Fort Street from all adjacent lots or outlots will not be permitted. Grading and Drainage: Proposed site grades along the southern boundary of the platting, adjacent to Fort Street, must be coordinated with the future improvement of the roadway. The applicant will be required to submit cross section information, for review purposes, that shows the relationship of the proposed sited Case Number: C10-18-219, C12-18-220 VISTANCIA (Lots 513-523) Page: 3 GS grading to the existing and future Fort Street improvements. Certifications of the grade coordination will be required prior to approval of the final plat. Any grading, sewer or utility work carried out in conjunction with this development, in Fort Street right-of-ways, will require a permit(s) from the Douglas County Engineer’s Office. All development must comply with all applicable stormwater management ordinances and policies, including providing for a no net increase in stormwater runoff and must treat the first 1/2” of stormwater for water quality. Environmental: Tree canopy analysis and mitigation plan: The applicant has submitted a tree canopy analysis that has determined that 32 trees need to be mitigated. A mitigation plan will be required showing the required tree plantings protected within an outlot or off-site. The applicant will need to coordinate with planning and parks staff regarding and acceptable planting plan prior to forwarding to City Council. Land Use and Planning: The rezoning from AG and DR to R4 is consistent with the Future Land Use Element of the City’s Master Plan. IV. RECOMMENDATION: Approval of the rezoning from AG and DR to R4. Approval of the Preliminary Plat, subject to the following conditions: 1. Coordinate with Douglas County Engineer’s Office site grade cross sections for the southern boundary of the plat, adjacent to Fort Street. 2. Coordinate with Douglas County Engineer’s Office for any necessary permits for the street connection to Fort Street. 3. Coordinate with Douglas County Engineer’s Office on storm sewer design plans along the development boundary adjacent to Fort Street. 4. Coordinate with the City of Omaha Public Works on an acceptable G.O. paving plan. 5. Provide a 16 foot inbound land, a 4 foot paved median, and two 12 foot outbound lanes, and dedicate right-of-way as needed to accommodate on the 208th Street approach to Fort Street. 6. ANALYSIS: Conditionally, the rezoning and subdivision complies with the goals and objectives of the Omaha Master Plan and the requirements of Chapter 53, Subdivisions, of the Omaha Municipal Code. Coordination with city staff and submittal of an acceptable tree mitigation planting plan regarding on-site of off-site locations. Approval of the Final Plat, subject to addressing the conditions of the Preliminary Plat and submittal of an acceptable final subdivision agreement, prior to forwarding this request to City Council.
