Mike Fahey,Mayor Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution amending the 2004 Wastewater Service Agreement between the City of Papillion and the City of Omaha. Both parties first entered into a wastewater service agreement in 1975, which was amended in 1978 and again in 1986. The 2004 agreement, Resolution No. 740 on June 8, 2004, updated and replaced the service agreement adopted May 19, 1998. The attached amendment #2 adds additional connection points to provide service to an area already included in the 2004 Wastewater Service Agreement. Amendment #2 supersedes and replaces all items modified by Amendment #1 adopted on February 13, 2007 by Resolution No. 204. Two Connection Authorization Agreements are also attached providing for the new connection points to the City of Omaha interceptor system. There is adequate capacity in the Papillion Creek Wastewater Treatment Plant to handle the wastewater expected from this agreement amendment. The Public Works Department requests your consideration and approval of the attached Resolution and Agreements. Development and connection to the sewer system for any lots platted within the shaded area must be provided for by y amending this service agreement or by a new wastewater service agreement. Wastewater service to any development in the shaded area is not guaranteed expressly or by inference. However it shall not be unreasonably or inequitably withheld. Item #3: Paragraph #7 (2004 agreement lists this paragraph as 5. after the table) of the 2004 "Agreement for Wastewater Service between City of Omaha, Nebraska and City of Papillion, Nebraska" and as modified by Amendment#1 February 13, 2007 shall be superceded and replaced by the following: 7. A manhole shall be constructed at each connection point indicated on Exhibit A-2008; such that the first six(6) feet of riser above the floor of the manhole is a minimum of fifty- four inches in diameter. The location of each such manhole shall be approved by the Environmental Quality Control Division of the City of Omaha. Item #4: Exhibit A-2004 of the 2004 "Agreement for Wastewater Service between City of Omaha, Nebraska and City of Papillion, Nebraska" and Exhibit A-2007 of Amendment#1 shall be superceded and replaced by Exhibit A-2008 which is attached to this amendment. ' - • . . . . . . • . . •- •i• c-25a CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: =' WHEREAS, the City of Papillion and the City of Omaha entered into a Wastewater Service Agreement in 1975,which has been renewed and amended several times since; and, WHEREAS, the City of Papillion and the City of Omaha most recently renewed their Wastewater Service Agreement in 2004; and, WHEREAS, the City of Papillion wishes to include new outfall connection points Within_ the service area of the 2004 Wastewater Service Agreement to provide sewer service to Portal. Plaza, Portal Plaza South, West Cornhusker Plaza and West Cornhusker Plaza South; and, WHEREAS, the required applications for connection of the new outfalls to the Papillion Creek Interceptor have been completed; and, WHEREAS, the City of Omaha will allow the outfalls, O.P.W. 51437 and O.P.W. 51438 to be connected to the regional treatment system; and, WHEREAS, the attached Amendment#2, which by this reference becomes a part hereof, updates portions of the 2004 agreement to begin service to the lots in Portal Plaza, Portal Plaza South, West Cornhusker Plaza and West Cornhusker Plaza South. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, as recommended by the Mayor, the Wastewater Service Agreement with the City of Papillion last amended on February 13, 2007, by Resolution 204, is hereby amended and, that the connections to City of Omaha interceptor S. O.
