RAINWOOD HILL PROPERTIES, LLC
RECLYCLING AND LANDFILL OPERTIONS
OPERATING PLAN
Days & Hours of Operation The majority of the operations will take place Monday
through Friday between 0800 hours and 1700 hours. The
recycling and landfill operations will only be open during
the days and hours when necessary to dispose of, cover,
maintain, grade and recycle applicant's materials based
upon applicant's need to place materials on the site.
Employees One fill-time employee and part-time employees, as
necessary. The full-time employee will be the site
manager. The site manager's duties will be the general
oversight of the landfill and recycling operations, including
site and waste inspections, maintenance of the landfill,
covering the landfill and the management of all other
matters required to operate the landfill. Rainwood Hill
Properties, LLC is affiliated with other companies,
including a grading company. Additional employees will
be available for Rainwood Hill Properties to utilize to
operate equipment, make inspections, and generally operate
the landfill and recycling operations as and when needed.
In addition, River City Recycling has been hired to assist
with the recycling operations.
Clients This is a private landfill that will be utilized by the
applicant and its affiliated entities. The main affiliated
entity using the landfill will be McArdle Grading
Company. The landfill will not be available to the general
public.
Buildings There are no buildings.
Landscaping A majority of this site, as shown on the attached pla
ns,ns, is
currently used for crops and there is no current intent to
disturb those areas or to modify that use. The street yards
consist mainly of plant material and there is no intent to
disturb those areas.

necessary, fill. It is anticipated that approximately 90% of
the waste placed in the landfill will be waste resulting from
the demolition of roads, mainly consisting of concrete. A
primary goal of the operator is to recycle as much material
as possible. The operator intends to recycle new concrete
and trees brought to the site. In addition, the operator
intends to dig out previously buried concrete for recycling.
The recycled materials will be used to create crushed
concrete and rock for new construction use and mulch.
Traffic Generated/Volume It is anticipated that the site could generate approximately 5
trucks per day, on average. It is anticipated that 10 tons of
material per week will be placed in the landfill. It is
anticipated that up to 200 tons of material may be brought
to the landfill site per week with the remaining tons being
recycled. It is estimated that approximately 90% of the
material brought to the site will consist of heavy road
construction waste,primarily consisting of concrete.
Equipment The following equipment will be on site at all times:
Backhoe with a 3 cubic yard bucket, 20 cubic yard scraper,
loader with a 3 %2 cubic yard bucket, and a water truck with
a minimum capacity of 3,000 gallons. Other equipment will
be brought to the site for use as necessary.
Types of Waste Allowed Waste which results from construction projects, land

site. In addition, all waste will be first placed on the site in
piles, not placed in the landfill area. Each pile will be
visually inspected prior to recycling or placement of
material in the landfill. All improper materials will be
hauled away from the site.
Landfill Cells Landfill cells will be closed annually or as needed to
keep
open cells to approximately i acre or less. Based upon the
anticipated type and volume of material to be placed in the
landfill, it is anticipated that only 3 inches of depth will be
used annually for fill in a 1 acre cell.
Site Security Access to the site is limited to a gravel access road off 120th
Street. This road will be gated and locked. Additionally,
access to the site is controlled by the use of berms, trees,
and fencing.
Dust Control Personnel will be on-site during times that waste is
uncovered to spray water using water trucks, as necessary,
to prevent blowing dust. Personnel will monitor dusk
regularly throughout operations to ensure proactive dust
control. Approximately 90% of the waste will be heavy
road demolition waste, consisting mainly of concrete.
Waste will be covered promptly to prevent blowing dust.
In the event unacceptable levels of blowing dust are
encountered, personnel will promptly use water trucks to
spray the area creating the dust and discontinue the
operations causing the dust until such time as the dust can
be controlled.
Noise Control Personnel will limit the use of the site to the clients
mentioned above, limit equipment use to those times when
necessary for the safe operation of the landfill and limit the
use of multiple equipment simultaneously to those times
when necessary. Personnel will regularly monitor noise
levels and take measures to reduce equipment use and other
noise generating uses as reasonable. In the event
unacceptable levels of noise are encountered, personnel
will asses the cause of the excess noise levels and take all
reasonable steps to reduce noise, including without
limitation turning off idling vehicles, limiting the number
of vehicles and noise producing equipment in operation at
any one time, or removing noise causing equipment from
service.

Contingency Plans Fire: The cells of refuse will be limited to 1 acre or less to
minimize fire hazards. In addition, at the end of each day,
the active faces of the landfill will be covered with a
minimum of 6 inches of dirt when wood or other
combustibles are placed in the landfill. When the fill
materials consist primarily of non-combustibles and there
are no voids in the fill, the landfill will be covered with dirt
at least weekly. Water trucks and dirt-moving equipment
will be available at all times. Additionally, personnel will
be on-site. Construction waste is not a known fire hazard.
The recycling company will take active measures to ensure
that the tree chipping is properly done to reduce fire hazard.
Fire extinguishing equipment will be available at all times.
In addition, the equipment located on site will be monitored
regularly to ensure that no combustible liquids leak. Proper
measures will be taken to ensure that leaks are handled as
required by law.
Nuisance and Vermin: The initial landfill ditch is at least
1/8 of a mile from the nearest road and even further from
the nearest neighboring property. The operator will spray
as necessary and ensure that waste that might attract vermin
is promptly covered. The intended waste is not known to
be attractive for vermin. Personnel will be on-site to detect
vermin and nuisance and to ensure prompt control. In
addition, the access road is gravel, which will be replaced
and added to as necessary, at least 200 feet in length from
the road to help prevent dirt and mud from building up on
the streets. Streets will be inspected as materials are
brought to the site and will be cleaned immediately if mud,
dirt or spilled debris accumulates on the streets.
Ground Water and Gas: The closest groundwater is
approximately 54 feet under surface level. There is no
surface water. The fill is not known to create landfill gas.
Public health is being protected by limiting the type of
material placed into the ground to material that is not
hazardous. In addition, a baseline ground water reading
has been taken. The ground water will be tested regularly
against the baseline.

Conditions:
1) Dedicate right-of-way equal to 50' from each streets centerline for both 120th
Street and Rainwood Road;

3) Pave the drive entrance to the specifications of the Public Works Department;

or to such other address as shall be furnished in writing by any Party to the other Party prior to
the giving of the applicable notice or communication, and such notice or communication shall be
deemed to have been delivered as of the date personally delivered or three (3) business days after
the date of deposit with a national courier or the United States Mail, postage prepaid.
11. Remedies. The Parties acknowledge that money damages will not be a sufficient
remedy for any breach of this Agreement. So long as Neighbor is not in breach of this Agreement,
if the Applicant fails to cease its Authorized Use at the end of the Term, it shall pay Neighbor as
liquidated damages $500 per day for each day of continued use. If a Party breaches or threatens to
breach any of the covenants, representations, warranties, agreements or obligations herein, the other
Party shall be enticed to an injunction, without bond, prohibiting the breaching Part
y and others
from violation hereof, it being agreed that otherwise irreparable harm would result for which
remedies at law would be inadequate. The Parties also shall be entitled to pursue any other
remedies for any breach or threatened breach of this Agreement, including, without limitation,
recovery of damages. The Parties agree if either party is necessitated to institute litigation to
enforce this Agreement and is successful in its Iitigation it shall be entitled to have its attorney fees
paid by the breaching party.
12. Entire Agreement. This Agreement contains the entire understanding and
agreement of the Parties with respect to the matters covered hereby and supersedes all other
understandings and agreements between the Parties, oral or written, relating to the subject matter
of this Agreement. No modification, alteration, or amendment of this Agreement and no waiver
of any provision of this Agreement shall be valid or effective unless in writing executed by both
Parties. The parties acknowledge that Number 4 of the City Planning Department letter dated
November 1, 2005 recommending approval of the Application stated, "4. Excavate the
unknown, improper fill areas and recycle and properly dispose of the material".

13. Successors and Assi ns. This Agreement shall be binding upon, inure to the

other grading techniques as necessary. Grading of the land
will be modified as necessary to ensure proper storm water
drainage pursuant to applicable law.

Personnel will be on-site during times that waste is
uncovered. Approximately 90% of the waste will be heavy
road demolition waste, consisting mainly of concrete.
Waste will be watered or covered as necessary to prevent
dust from blowing.
27. WHAT ARE YOUR PLANS IN THE EVENT OF
FIRE?
The cells of refuse will be limited to 1 acre or less to
minimize fire hazards.- In addition, at the end of each day,
the active faces of the landfill will be covered with a
minimum of 6 inches of dirt when wood or other
combustibles are placed in the landfill. When the fill
materials consist primarily of non-combustibles and there
are no voids in the fill, the landfill will be covered with dirt
at least weekly. Water trucks and dirt-moving equipment
will be available at all times. Additionally, personnel will
be on-site. Construction waste is not a known fire hazard.
The recycling company will take active measures to ensure
that the tree chipping is properly done to reduce fire hazard.
Fire extinguishing equipment will be available at all times.
In addition, the equipment located on site will be monitored
regularly to ensure that no combustible liquids leak, Proper
measures will be taken to ensure that leaks are handled as
required by law.

The initial landfill ditch is at least 1/8 of a mile from the
nearest road and even further from the nearest neighboring
property. The operator will spray as necessary and ensure
that waste that might attract vermin is promptly covered.
The intended waste is not known to be attractive for
vermin. Personnel will be on-site to detect vermin and
nuisance and to ensure prompt control. In addition,
the
access road is gravel, which will be replaced and added to
as necessary, at least 200 feet in length from the road to
help prevent dirt and mud from building up on the streets.
Streets will be inspected as materials are brought to the site
and will be cleaned immediately if mud, dirt or spilled
debris accumulates on the streets.

The closest groundwater is approximately 54 feet under
surface level. There is no surface water. The fill is not
known to create landfill gas. Public health is being
protected by limiting the type of material placed into the
ground to material that is not hazardous. In addition, a
baseline ground water reading has been taken. The ground
water will be tested regularly against the baseline.
34. WILL ANY RECYCLING BE DONE AT THIS
SITE? IF SO BE SPECIFIC.
A primary goal of the operator is to recycle as much
material as possible. The operator intends to recycle new
concrete and trees brought to the site. In addition, the
operator intends to dig out previously buried concrete for

crushed concrete and rock for new construction use and

OPERATING PLAN
Days & Hours of Operation The majority of the operations will take place Monday
through Friday between 0800 hours and 1700 hours. The
recycling and landfill operations will only be open during
the days and hours when necessary to dispose of, cover,
maintain, grade and recycle applicant's materials based
upon applicant's need to place materials on the site.
Employees One full-time employee and part-time employees, as
necessary. The full-time employee will be the site
manager. The site manager's duties will be the general
oversight of the landfill and recycling operations, including
site and waste inspections, maintenance of the landfill,
covering the landfill and the management of all other
matters required to operate the landfill. Rainwood Hill
Properties, LLC is affiliated with other companies,
including a grading company. Additional employees will
be available for Rainwood Hill Properties to utilize to
operate equipment, make inspections, and generally operate
the landfill and recycling operations as and when needed.
In addition, River City Recycling has been hired to assist
with the recycling operations.
Clients This is a private landfill that will be utilized by the
applicant and its affiliated entities. The main affiliated
entity using the landfill will be McArdle Grading
• Company. The landfill will not be available to the general
public.
Buildings There are no buildings.
Landscaping A majority of this site, as shown on the attached plans, is
• currently used for crops and there is no current intent to
disturb those areas or to modify that use. The street yards
consist mainly of plant material and there is no intent to
disturb those areas.
Services Waste which results from construction projects, land
clearing, the demolition of buildings, roads or other
structures, including, but not limited to, fill materials,wood

site. In addition, all waste will be First placed on the site•
piles, not placed in the landfill area. Each pile will be 35
visually inspected prior to recycling or placement of
material in the landfill. All improper materials will be
hauled away from the site.
Landfill Cells Landfill cells will be closed annually or as needed to keep
open cells to approximately 1 acre or less. Based upon the
anticipated type and volume of material to be placed in the
landfill, it is anticipated that only 3 inches of depth will be
used annually for fill in a 1 acre cell.
Site Security Access to the site is limited to a gravel access road off 120th
Street. This road will be gated and locked. Additionally,
access to the site is controlled by the use of berms, trees,
and fencing.
Dust Control Personnel will be on-site during times that waste is
uncovered to spray water using water trucks, as necessary,
to prevent blowing dust. Personnel will monitor dusk
regularly throughout operations to ensure proactive dust
control. Approximately 90% of the waste will be heavy
road demolition waste, consisting mainly of concrete.
Waste will be covered promptly to prevent blowing dust.
In the event unacceptable levels of blowing dust are
encountered, personnel will promptly use water trucks to
spray the area creating the dust and discontinue the
operations causing the dust until such time as the dust can
be controlled.
Noise Control Personnel will limit the use of the site to the clients
mentioned above, limit equipment use to those times when
necessary for the safe operation of the landfill and limit the
use of multiple equipment simultaneously to those times
when necessary. Personnel will regularly monitor noise
levels and take measures to reduce equipment use and other
noise generating uses as reasonable. In the event
unacceptable levels of noise are encountered, pe-scnnel
will asses the cause of the excess noise levels and take all
reasonable steps to reduce noise, including without
limitation turning off idling vehicles, limiting the number
of vehicles and noise producing equipment in operation at
any one time, or removing noise causing equipment from
service.

Properties, LLC is affiliated with other companies,
including a grading company. Additional employees will
be available for Rainwood Hill Properties to utilize to
operate equipment, make inspections, and generally operate
the landfill and recycling operations as and when needed.
In addition, River City Recycling has been hired to assist
with the recycling operations.

other than yard waste,wall coverings (incluoting wall paper,
paneling and tile),drywall, plaster, non-asbestos insulation,
roofing shingles and other roof coverings, plumbing
fixtures, glass, plastic, carpeting, electrical wiring,pipe and
metals will be brought to the site for recycling and, as
necessary, fill. It is anticipated that approximately 90%of
the waste placed in the landfill will be waste resulting from
the demolition of roads, mainly consisting of concrete. A
primary goal of the operator is to recycle as much material
as possible. The operator intends to recycle new concrete
and trees brought to the site. In addition, the operator
intends to dig out previously buried concrete for recycling.
The recycled materials will be used to create crushed
concrete and rock for new construction use and mulch.
Traffic GeneratedNolume It is anticipated that the site could generate approximately 5
trucks per day, on average. It is anticipated that 10 tons of
material per week will be placed in the landfill. It is
• anticipated that up to 200 tons of material may be brought
to the landfill site per week with the remaining tons being
recycled. It is estimated that approximately 90% of the
material brought to the site will consist of heavy road
construction waste, primarily consisting of concrete.
Equipment The following equipment will be on site at all times:
Backhoe with a 3 cubic yard bucket, 20 cubic yard scraper,
loader with a 3 '/z cubic yard bucket, and a water truck with
a minimum capacity of 3,000 gallons. Other equipment will
be brought to the site for use as necessary.
Types of Waste Allowed Waste which results from construction projects, land

structures, including,but not limited to, fill materials, wood

site. In addition, all waste will be first placed on the site in
• piles, not placed in the landfill area. Each pile will be
visually inspected prior to recycling or placement of
material in the landfill. All improper materials will be
hauled away from the site.
Landfill Cells Landfill cells will be closed annually or as needed to keep
open cells to approximately 1 acre or less. Based upon the
anticipated type and volume of material to be placed in the
landfill, it is anticipated that only 3 inches of depth will be
used annually for fill in a 1 acre cell.
Site Security Access to the site is limited to a gravel access road off 120'h
Street. This road will be gated and locked. Additionally,
access to the site is controlled by the use of berms, trees,
and fencing.
Dust Control Personnel will be on-site during times that waste is
uncovered to spray water using water trucks, as necessary,
to prevent blowing dust. Personnel will monitor dusk
regularly throughout operations to ensure proactive dust
control. Approximately 90% of the waste will be heavy
road demolition waste, consisting mainly of concrete.
• Waste will be covered promptly to prevent blowing dust.
In the event unacceptable levels of blowing dust are
encountered, personnel will promptly use water trucks to
spray the area cleating the dust and discontinue the
operations causing the dust until such time as the dust can
•
be controlled.
Noise Control Personnel will limit the use of•the site to the clients
mentioned above, limit equipment use to those times when
necessary for the safe operation of the landfill and limit the
use of multiple equipment simultaneously to those times
when necessary. Personnel will regularly monitor noise
levels and take measures to reduce equipment use and other
noise generating uses as reasonable. In the event
unacceptable levels of noise are encountered, personnel
will asses the cause of the excess noise levels and take all
reasonable steps to reduce noise, including without
limitation turning off idling vehicles, limiting the number
of vehicles and noise producing equipment in operation at
any one time, or removing noise causing equipment from
service.

Contingency Plans Fire: The cells of refuse will be limited to 1 acre or less to
minimize fire hazards. In addition, at the end of each day,
the active faces of the landfill will be covered with a
minimum of 6 inches of dirt when wood or other
combustibles are placed in the landfill. When the fill
materials consist primarily of non-combustibles and there
are no voids in the fill, the landfill will be covered with dirt
at least weekly. Water trucks and dirt-moving equipment
will be available at all times. Additionally, personnel will
be on-site. Construction waste is not a known fire hazard.
The recycling company will take active measures to ensure
that the tree chipping is properly done to reduce fire hazard.
Fire extinguishing equipment will be available at all times.
In addition, the equipment located on site will be monitored
regularly to ensure that no combustible liquids leak. Proper
measures will be taken to ensure that leaks are handled as
required by law.
Nuisance and Vermin: The initial landfill ditch is at least
• 1/8 of a mile from the nearest road and even further from
the nearest neighboring property. The operator will spray
as necessary and ensure that waste that might attract vermin
is promptly covered. The intended waste is not known to
be attractive for vermin. Personnel will be on-site to detect
vermin and nuisance and to ensure prompt control. In
addition, the access road is gravel, which will be replaced
and added to as necessary, at least 200 feet in length from
the road to help prevent dirt and mud from building up on
the streets. Streets will be inspected as materials are
brought to the site and will be cleaned immediately if mud,
dirt or spilled debris accumulates on the streets.
Ground Water and Gas: The closest groundwater is
approximately 54 feet under surface level. There is no
surface water. The fill is not known to create landfill gas.
Public health is being protected by limiting the type of
material placed into the ground to material that is not
hazardous. In addition, a baseline ground water reading
has been taken. The ground water will be tested regularly
against the baseline.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Section 55-884 of the Omaha Municipal Code,provides for the granting
of a Special Use Permit; and,
WHEREAS,an application has been submitted by Rainwood Hill Properties,LLC for
a Special Use Permit to allow a Nonputrescible Landfill in an AG-Agricultural District, located
Southwest of 120th Street and Rainwood Road, Omaha,Nebraska; and,
WHEREAS,the City Planning Board has recommended that said permit be granted
pursuant to the application,a copy of which is attached hereto as Exhibit"A",and made a part hereof
by this reference,and the conditions set out in Exhibit"B"attached hereto and made a part hereof by
this reference.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT,the Special Use Permit application submitted by Rainwood Hill Properties,
LLC for permission to allow a Nonputrescible Landfill in an AG-Agricultural District, located at
Southwest of 120th Street and Rainwood Road, Omaha, Nebraska, is hereby approved and the
Permits and Inspection Division is directed to issue the necessary permit therefor, provided the
conditions set out in Exhibit "A" of the above referenced application, conditions set out in Exhibit
"B", and all applicable local or state statutes, ordinances or regulations are complied with.
BE IT FURTHER RESOLVED:
THAT,the proposed Special Use Permit has been reviewed and evaluated pursuant
to, and meets each of, the criteria set forth in Section 55-885 of the Omaha Municipal Code.
