Transmitted herewith is a Resolution proposing acceptance of a report concerning GRADE
CHANGES for the following:
PROJECT LOCATION
2004-1 South Main Street Improvements - Elkhorn
Freeholders, Mr. Thomas E. Stevens, Ms. Denise Bighia and Mr.. Joseph Dizona, submitted the
attached report concerning grade changes.
There were no damages awarded for the project. The report details the committee's
recommendations.
The Public Works Department requests your consideration and approval of the attached
Resolution.

The purpose of this report is to describe and answer complains received from property owners in
the district enumerated below. The Committee has estimated the loss in value, if any, sustained
by the individual parcels of real estate in this district due to the establishment or change of grade
abutting the street in the following location:

2006 Street Improvement Project
• South Main Street Improvement Project 2004-1 Elkhorn, Nebraska
Prior to the hearing dates on September 25,2008,and October 23,2008,the Committee made a
plan-in-hand inspection of the above captioned street on September 17, 2008. We observed the
construction which had been completed and studied each property for potential change of grade
damages.
Based on a letter sent to me by Rex J.Moats,Attorney at Law,for Alan Rolfs,one of the property
owners(see copy of letter attached).Mr. Moats indicated that they had received the letter notice
after the date of hearing,which was September 25, 2008. Based on my discussion with Harold
Flatoen,Engineering Services Manager with the Public Works Department of the City of Omaha
and the committee members, Denise Bighia and Joseph Dizona, we decided to hold another
hearing regarding the change of grade so that the owner, Alan Rolfs, and his attorney, Rex J.
Moats,would have an opportunity to provide information to the committee.
On Thursday, October 23,2008,Mr.Rex J.Moats,attorney at law,on behalf of Mr.Alan Rolfs,
property owner,appeared before the committee.Mr.Moats,attorney for Mr.Rolfs,and Mr.Rolfs
provided information to the committee as to why his client may be entitled to damages, which
was summed up as primarily the loss of trees and re-rocking of the driveway and parking area.
After Mr.Rolfs and his attorney,Rex Moats,left the meeting,the committee members discussed
the information provided and decided to have the engineering firm for the project appear at a
meeting to discuss the issues Mr. Rolfs and his attorney, Mr. Moats raised at the meeting. On
October 29, 2008, the committee, along with Harold Flatoen with the City of Omaha met with
Julia A. Ogden, P.E., with JEO Consulting Group, Inc. JEO Consulting were the engineers for
the project and supervised the construction. The committee went over the information for this
street project with Ms. Ogden and the issues that Mr. Rolfs and his attorney, Mr. Moats had
raised.
No other property owners for this project appeared at the meetings held September 25,2008,and
October 23, 2008.
Conclusion:After discussion and considering the issues raised by Mr.Rolfs and his attorney,Mr.
Moats and information provided by the engineering firm for the project,the Committee concluded
that there is no damages to Alan Rolfs' property adjoining the street resulting from the change
of grade of the street.In addition,the committee concluded that there is no damages to any of the
other three properties resulting from the change of grade of the street.

CONCLUSIONS
After carefully considering the effect of the construction and the change of grade on all the
properties in the district discussed in this report,the Change of Grade Committee made findings
as discussed above,and found no damage to any of the properties in the above-named district due
to change of grade.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Mr. Thomas E. Stevens, Ms. Denise Bighia and Mr. Joseph Dizona were
appointed by Resolution No.1430 approved on November 20, 2007,pursuant to Section 26-38 of
the Omaha municipal Code, to appraise the damages, if any, resulting from change of grade or
grading within the following:
PROJECT LOCATION
2004-1 South Main Street Improvements - Elkhorn
WHEREAS, Mr. Thomas E. Stevens, Ms. Denise Bighia and Mr. Joseph Dizona now
have completed their duties and filed their report of findings; and,
WHEREAS, there were no damages awarded for Project 2004-1 South Main Street
Improvements—Elkhorn; and,
WHEREAS, such finding were deemed proper and correct.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the Appraiser's Report of Findings with respect
to no damages arising by the reason of change of grade or grading within Street Improvement
2004-1, South Main Street Improvements — Elkhorn, a copy of which is attached hereto and
made a part hereof, be, and the same hereby adjudged proper, correct and legal, and the same
hereby is approved and accepted.
