The proposed use will consist of a boarding facility with a capacity to house approximately 70 dogs and a small interior cattery. The kennel facility shall be the principal use and shall include accessory uses incidental to the boarding facility, including the sale of a small variety of products and the provision of grooming services for the convenience of boarding customers. The intended accessory uses will be completely contained within the proposed kennel facility and occupy less than 25 percent of the total floor area. The kennel facility will be a single building, set into the existing hillside to minimize visibility and any associated noise. The proposed facility will be approximately 14,000 square feet in size, with a paved circular entrance drive that will surround the site, as required by the Fire Marshal. Detailed plans for the site and building have been attached to this application. The remainder of the 7.2 acre site will remain in its current natural state, providing additional screening and buffering to the street and neighboring properties. Please note the attached aerial photo depicting the trees and shrubbery current existing on site. A small number of employees will be engaged to assist the applicant in operating the kennel and the proposed use will have minimal effect on the neighborhood traffic. Services will include suite boarding for up to 71 dogs with the average occupancy being 35 dogs or less, and an additional interior small cattery. Mrs. Brazer has been a professional groomer for 15 years and will continue to offer this service to clients. 2. All modem kennels today offer a small array of products for their customer's convenience. These products will include collars, leashes, shampoos, etc. There are absolutely no plans for a future pet crematorium and cemetery. 3. There are currently six large commercial businesses, three kennels and a cattery, being operated within one-mile of this proposed facility. These businesses have been a welcome part of the community for many years. 4. The facility has been carefully planned to minimize all outside noise. National standards for kennel occupancy at any given time is approximately 50%which would translate to a possible 35 dog occupancy at any given time in the facility. The noise issue has been addressed with the addition of insulated walls, planned staggered exercise times and one animal outside at a time with an individual handler. At no time will all dogs be outside at one time. 5. The facility's drive and building will be lit at night only by the building porch lights. As designed,the facility will have fewer outside lights than most of the surrounding properties. 6. There are no future expansions planned for the facility. The property in question has been zoned agricultural since 2003 and there are no plans to alter that parcel of land. 7. The facility will be located 40 feet above the road and will be on level ground. Soil erosion and water run off will be properly and totally regulated according to all statues and regulations. All water and sewer will be managed for the facility in accordance with all codes and just as all other properties in the area are managed. • 8. The entrance to the facility will be located over 2 football fields in length South of 230th Street and State Street. The average stay of an animal in a boarding facility is five days. N Southeast of 230th & State Streets for Pet Care Facility n w PUBLIC HEARING JANUARY 13, 2009 c1J Dear Members of the Omaha City Council: I represent Todd and Nancy Conley and Brad and Karen Underwood who are neighbors of the site of the proposed pet care facility. The Conleys are the first home to the south of the proposed project and the Underwoods are the first home to the north of the proposed project. My clients and many other neighbors are in opposition to the project and they and their properties will be substantially and detrimentally affected by the proposed project. Based on testimony and evidence given at the public hearing on November 5, 2008, the Omaha Planning Board denied the Brazers application for a Conditional Use Permit. The Brazers have appealed to the Omaha City Council, which appeal will be heard on January 13, 2009. On behalf of my clients, I am requesting that you uphold the Omaha Planning Board's decision to deny the conditional use permit. If you recall, some issues involved in this case were raised before you at a March 11, 2008 public hearing on the Brazers request for rezoning from AF-1 (Douglas County designation) to DR. At that time, you noted that an investigation should be undertaken as to what exactly was occurring at the Brazers property (because of an existing illegal kennel/grooming/retail sales facility in their home in violation of Douglas County zoning regulations) and because of the lack of information regarding their proposed use in the planned 14,000 square foot commercial facility they wanted to build. Since the layover of that request for rezoning, the Brazers (two days after the City Council's layover and request for an investigation) attempted to commence construction on the planned facility, claiming the right to do so under a building permit allegedly issued by Douglas County, Nebraska in February 2007 just prior to Omaha's annexation of Elkhorn, which had Inog since expired by its terms. My clients were forced to institute litigation which is currently on Members of the Omaha City Council December 31, 2008 Page Two appeal. I am submitting information regarding that litigation in order to give you sufficient information to understand what is occurring in that matter and what is pending before you. Prior to Omaha's annexation of Elkhorn in March 2007, the Brazers, in February 2007 submitted an unsigned, unstamped partial set of plans for a building, without submitting a site plan or septic permit, and the Brazers paid a fee to Douglas County, Nebraska and received what purported to be a building permit for construction of a "kennel" on their 9.21 acre parcel at 230`h & State Streets. The permit was issued despite language in Douglas County Regulations requiring that a site plan be submitted and septic permit be obtained before a building permit could be issued. The permit stated that it would expire in 90 days if no construction was commenced and in one year if construction was not completed. No construction was commenced on the Brazers property within 90 days or at any time thereafter. The 200Q International Building Code, which was in effect in Douglas County at that time, required a written request to be submitted by the permit holder and valid reason for any extension of the permit to be granted by the building official. No written requests for extension were ever submitted by the Brazers, their contractor or anyone on their behalf. At the time of receiving the permit, the Brazers property consisted of 9.21 acres on which they had their home and were operating a home-based business in their home which was at that time zoned AF-1 (pursuant to Douglas County zoning regulations), which business involved grooming, retail sales and some kenneling with a small number of dogs at any one time. That home-based business was in violation of existing Douglas County Zoning Ordinances due to its location within 300 feet of property zoned AF-2 (the Conleys' property) and, also possibly due to the fact that it provided pet services such as grooming and retail sales which were not allowed in AF-1 zoning. Despite these existing zoning violations, the permit was issued. Also at the time the permit was issued, Brazers had no final set of building plans, no formal site plan, no septic permit and no financing for their project. The building plans changed after they received the permit, yet as of March 2008, they had not submitted new plans to either Douglas County or the City of Omaha for approval. The septic permit was not obtained until August 2008, a year and a half after the building permit was issued. Financing for the project was not obtained until December 2007, ten months after the permit was issued. No substantial construction or substantial liabilities were incurred prior to Omaha's annexation of Elkhorn, which occurred less than one month after issuance of the permit, and the extension of Omaha's 3-mile zoning jurisdiction. Through the extension of Omaha's 3-mile extraterritorial zoning jurisdiction, which occurred on March 1, 2007, Omaha obtained jurisdiction over the Brazers'property. Thereafter, prior to obtaining financing,finalizing building plans, or obtaining a septic permit, the Brazers applied to the City of Omaha for an administrative subdivision of their 9.21 acre parcel into two lots, one totaling 7.20 acres which was undeveloped and which is now the subject of the appeal before you, and the other 2.01 acres on which their home is located. That administrative subdivision was approved in December 2007, before they closed financing for the 7.20 acre property with Comerica Bank. In early 2008, the Brazers also applied to the City of Omaha for rezoning to DR for their 2.01 acre parcel (possibly to try and eliminate the 300 foot separation requirement contained in AF-1 zoning in an attempt to legitimize their existing home-based operation), at the same time that Omaha's comprehensive rezoning of the area was being proposed and both of the Brazers parcels were included in that comprehensive rezoning. It was after this application was • Members of the Omaha City Council December 31, 2008 • Page Three submitted that the Conleys retained me as their attorney and the zoning violations and scope of the project were discovered. As indicated above, the rezoning request for the Brazers 2.01 acre parcel was laid over on March 11, 2008 by the Omaha City Council so that it could look into the issues including whether the February 2007 Building Permit was valid, and within days, the Brazers had construction equipment readied near the property and intended to proceed under the February 2007 Building Permit (which the Conleys submit was either invalid when issued or had long since expired), and that is the basis for the lawsuit that was filed by the Conleys against the Brazers. The Conleys are seeking to stop construction under the February 2007 Building Permit from proceeding, to have that permit declared invalid, void or expired and are asking for declarations that the Brazers submit to the City of Omaha's jurisdiction and that"pet services" such as grooming and retail sales are not allowed on the Brazer property (based on the Brazers written statements that they intend to service approximately 200 existing pet grooming customers at the facility who may or may not be using the kennel facilities at that time which would be a violation of DR zoning regulations). The Brazers applied for the CUP from Omaha which was denied by the Omaha Planning Board on November 5, 2008, and are still fighting on the February 2007 Building Permit because if they don't ultimately get the CUP, they apparently intend to try and undertake the project under the February 2007 Building Permit. The Brazers attempt to claim that somehow, the City of Omaha ceded some of its extraterritorial jurisdiction to Douglas County, Nebraska through a one page agreement signed by an Omaha employee and a Douglas County employee that purported to allow Douglas County to continue inspections of active permits it had issued. However, that agreement was never reviewed or approved by the Omaha Planning Board, the Omaha City Council or the Mayor. Nor was it reviewed or approved after public hearing by the Douglas County Board of Commissioners. Further the agreement does not state that the Douglas County permit officers have jurisdiction to renew, alter or extend any permits and, it does not appear that the existence of the Brazers' purported permit (under which they had not commenced construction and which was issued without required documentation and a septic permit) was not disclosed to the City of Omaha. In March 2008, after hearing a full day of testimony from witnesses such as Nancy Conley, Kathy Brazer, Buster Brown, Tom Blair and Jay Davis (of City of Omaha Planning and Permits Departments), Mark Ekberg and Barb Frohlich (both of Douglas County),Tom Baker(of the Douglas County Health Department), Chester Black (of the Douglas County Air Quality Department), the Brazers' architectural designer who had designed the plans, the Brazers' contractor, and a registered surveyor and receiving many exhibits into evidence (including the Brazers' February 2007 Building Permit and the agreement regarding permit inspections), the Honorable Russell Bowie of the Douglas County District Court, entered a temporary injunction against the Brazers, prohibiting them from proceeding under the February 2007 Building Permit and the Conleys were required to post a bond. In August 2008, at the request of the Brazers' attorney, Don Dworak, and pursuant to written evidence only, that same judge dismissed the case and vacated the injunction because he found that the Conleys should have somehow appealed the issuance of that permit to the Douglas County Board of Adjustment (despite the fact that no notice of the permit was given to the Conleys at the time it was issued and that Douglas County Board of Adjustment has not had jurisdiction over the property since February 2007 and the Brazers have submitted themselves to the jurisdiction of the Omaha Zoning Board of Appeals to obtain their administrative subdivision). The Conleys disagree with the court's decision, believe it does not comport with the law or the facts of this case and have appealed it to the Nebraska Court of Appeals. As part of that appeal, they posted a bond in excess of $5,000 which is based on 1/2 Members of the Omaha City Council December 31, 2008 Page Four of their net worth (which has been substantially diminished due to legal costs incurred in fighting not only the February 2007 Building Permit, but also the request for rezoning and now • the request for conditional use permit and the effect of this proposed project on their property value). The bond continues the temporary injunction against the Brazers' use of the February 2007 Building Permit pending the outcome of the appeal. The reason your vote on the Brazers' Application for Conditional Use Permit is crucial, is because if the CUP is granted, they could apply to the City of Omaha and obtain a new building permit and proceed with this project, which is contrary to the Elkhorn Special Development Zone protections and relevant Omaha ordinances and rules and contrary to the character of the neighborhood. A substantial commercial use of this property has never been contemplated under either Douglas County regulations or Omaha ordinances. In fact, the Douglas County regulations were amended within two weeks of Omaha's annexation of Elkhorn and extension of its 3-mile extraterritorial jurisdiction and eliminated AF-1 zoning (which is what the Brazers' property was zoned prior to Omaha's rezoning it to DR), changing it to RR-1 and neither kennels nor pet services are allowed in RR-1 zoning. Whether under the 2007 Building Permit or under a CUP and new Omaha building permit, this project is not appropriate for this environmentally constrained area designed as urban residential in Omaha's Land Use Element (and previously designated as residential and environmentally constrained under Douglas County's Land Use Plan). The Brazers seek to construct a substantial commercial pet care facility on their 7.20 acre parcel of undeveloped land, which would include not only a kennel, but also pet services such as grooming, retail sales, and doggie daycare, and massage therapy. They have placed ads in the yellow pages of the 2008 and 2009 Dex phone book for their planned business which lists the various services they wish to provide. No business has ever been operated on this 7.20 acre parcel. However, as previously mentioned, the Brazers operated a home-based business on an adjacent 2.01 acre parcel of property which previously was zoned AF-1 (pursuant to Douglas County zoning regulations)and attached to the 7.20 acre parcel (prior to administrative subdivision of that parcel by the Brazers in December 2007), which business involved grooming, retail sales and some kenneling with a small number of dogs at any one time. That home- based business was in violation of existing Douglas County Zoning Ordinances due to its location within 300 feet of property zoned AF-2 and, also possibly due to the fact that it provided pet services such as grooming and retail sales which were not allowed in AF-1 zoning. Despite those zoning violations, the Brazers have attempted to claim grandfather rights for those uses which is not supported by applicable law. The Conleys were clients of Kathy Brazer at her home-based grooming business until early 2008 when they learned of the zoning violations and that the Brazers wanted to install a substantial commercial facility next door to their residential acreage and that Brazers planned to substantially increase the business and number of dogs and services. At that time, the Conleys stopped using Kathy Brazer for grooming services for their dog. The 7.20 acre property is currently zoned DR, which zoning classification identifies that a kennel may be allowed with a conditional use permit, however, in no event does DR zoning allow pet services as a permitted, conditional or special use. The terms "kennel" and "pet services," are both specifically defined by the Municipal Code. "Pet services" include grooming and retail sales and are not permitted in DR zoning. In fact,pet services are only allowed under LC, CC, NBD, GC, CBD, DS, CH, LI, GI (conditional), and MU zoning. In order to avoid this limitation, the Brazers have attempted to claim that pet grooming, retail sales, doggie daycare and other services are accessory uses. However, those uses are not uses that will be provided e appealed it to the Nebraska Court of Appeals. As part of that appeal, they posted a bond in excess of $5,000 which is based on 1/2 • Members of the Omaha City Council December 31, 2008 • Page Five solely for the convenience of boarding customers. None of those services are allowed as accessory uses in DR zoning, though retail sales are specifically identified as accessory uses for horticulture and agricultural uses. Brazers' claim that the pet services uses will be accessory uses is not supported by the code or by any facts. In fact, prior to this application until approximately March 2008, Brazers operated a pet grooming business out of their home, in violation of zoning ordinances and Kathy Brazer recently stated in a letter to neighbors: "I have been a professional groomer for 15 years and will continue to offer this service to my clients as I have in the past." Further, Brazers have failed to provide any information regarding the projected percentage and amount of grooming services, retail sales, doggie daycare and kenneling that would be generated by the operation to enable a review of its statement that grooming, retail sales and other uses would be accessory uses, despite the fact that they have a 30-page business plan from 2007 which would show this information and submitted a few selected pages of it in the pending litigation, and despite promises by one of Brazers' attorneys, such business plan has not been produced to my clients or me. Brazers' claim that average occupancy would only be 35 dogs for kenneling is irrelevant and misleading as 35 dogs in a 14,000 square foot facility with access to the outside for the dogs would also be a substantial commercial operation and create issues with noise, odor, traffic and groundwater concerns. Moreover, the daily occupancy and traffic for grooming, retail sales, and doggie daycare clients were not included in those estimations, and occupancy would be highest on weekends and holidays when my clients are at home trying to enjoy their property. As indicated by the Dex ads, a review of internet sites for grooming services, and an affidavit of Kathy Brazer submitted in the litigation, the Brazers intend to offer grooming services any of the other services to anyone who comes in the door, including Kathy Brazers existing 200 clients that she has built up over the past several years. Prior to the rezoning of the Applicant's property to DR, it was zoned AF-1 (agricultural family) under the Douglas County zoning regulations. Since Omaha annexed Elkhorn and extended its 3-mile extraterritorial zoning jurisdiction, Douglas County has adopted new ordinances and changed the AF-1 zoning designation to RR-1 (rural residential), which does not allow kennels or pet services. There has never been any intent under any zoning classification applicable to the Applicant's property to allow for a substantial commercial use such as the 14,000 square foot pet care facility that has been proposed by the Applicant. According to the Omaha Master Plan/Future Land Use Map, the Applicant's property is included in the Elkhorn/Ponca Special Development Zone which furthers the intent that this area is not to be commercialized in this way. Further, it is impossible to buffer noise and odors from the proposed project. On April 11, 2008, the Brazers hosted an informational meeting for the neighborhood in an effort to gain support for their proposed pet care facility. Over 30 neighbors attended and voiced their concerns and overwhelming opposition to the proposed project. Despite promises by the Brazers to the neighbors, the neighbors have never received a full set of plans, an environmental study, or a traffic study from the Brazers. My clients, along with a majority of other neighbors, are very concerned about the proposed pet care facility based on noise, odor, increased traffic, groundwater effects, environmental impacts, valuation and aesthetic concerns, especially in light of the facts that the Land Use Element in the Douglas County Comprehensive Plan reflects it as urban residential property completely surrounded by environmentally constrained areas and the Omaha Future uses are not uses that will be provided e appealed it to the Nebraska Court of Appeals. A conditional use permit for this proposed project would be (a) inconsistent with the land use maps which reflect it as a residential/environmentally constrained area, (b) inconsistent with the character of the neighborhood, (c) create traffic and nuisance issues, (d) interfere with established slopes and environmentally sensitive features, (e) possibly interfere with the safety of the groundwater supply and (f) substantially impact property values of neighboring parcels. As the nearest homeowner to the north of the subject property, I can attest that our rural residential neighborhood has been united in opposition to the proposed project for the better part of a year. I would refer you to the minutes of the November 5, 2008 Planning Board meeting where a group of 16 neighbors attended and spoke against the project. Prior to the vote, Board Member R.J. Neary summarized the 14,000 sq. ft. kennel and its vinyl tent structure as "a plastic building on the hill" and "a square peg in a round hole." The convoluted development process the Applicant has followed allowed them to play off an opportunity created by Omaha's annexation of Elkhorn on March 1, 2007 and the sensitive issues of City/County jurisdiction that followed: • Despite not being ready to build or having financing, the Applicant paid for and received a Douglas County Building Permit three weeks prior to being annexed by Omaha. (February 8, 2007) This contested permit was issued with only a partial set of building prints and no site plan. To this day, it is unclear if engineer stamped plans as required for the Building Permit have ever been completed. • Ten months later, they applied for and received waivers from the Omaha Zoning Board of Appeals for a smaller than minimum lot width. They split their parcel, secured financing, and transferred ownership of the property. (December 2007) • In the spring of 2008, they requested early DR rezoning from the City Council. • Our opposition was successful in getting a layover to allow the Council time to investigate. Two days later, the Applicant attempted to start construction with heavy machinery in blatant disregard of the Council's decision. (March 13, 2008) This action unfortunately lead to a lawsuit between neighbors to stop construction, and finally to this Council vote on a Conditional Use Permit—the outcome of which is likely to be a moot point in the view of the Applicant. By attempting to exhaust the financial resources of opposing neighbors and by betting on their assumption that Omaha won't exert jurisdiction over their questionable claims of County rights, it is very possible the Applicant will build and operate this business in our rural residential community as they wish (open 7 days a week, 24-hour animal pickup/drop-off, offering standalone grooming services prohibited in DR zoning), neighbors will be forced to bear the consequences (noise from 70+ dogs, odor, increased traffic, property devaluations), and the City will be handed a nuisance enforcement issue with no enforceable conditions. It's difficult for those of us who have made significant investments in our rural acreage homes to accept the fact that such an ill-conceived commercial project can be built despite the protests of so many neighbors, despite its conflict with Omaha Land Use Maps and the Master Plan, despite its protected setting on a loess soil bluff in an Omaha designated "environmentally constrained area", despite the decision of the Planning Board, and now potentially despite the vote of the Omaha City Council. The Applicant is effectively saying that Omaha has no authority over their project. On behalf of myself and our neighborhood, I would encourage Council Members to ask the Applicant if they intend to abide by your decision, and to insist that the appropriate City of Omaha departments uphold the Council's motion — either for conditional approval or denial — by enforcing the City's unquestionable right of jurisdiction.
