APPROVED AS TO FORM: 3/i5/2a1J ASSI ANT CIT TORNEY DATE C10-20-021 ORDINANCE NO. _q `1 AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement between the City of Omaha and 85 Seabees, LLC for Flanagan Pointe, located northeast of 180th and Fort Streets, to allow 350 apartment units, exceeding the 250 apartment unit limit established in the Omaha Master Plan for this size Mixed Use Area,providing site development standards;and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health,safety,and welfare, desires to assure the property located northeast of 180th and Fort Streets is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Major Amendment to a Mixed Use Development Agreement is hereby approved. Section 4. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage. WITNESSETH: WHEREAS,the City and Developer have entered into a certain Mixed Use District Development Agreement,approved by the City Council of the City of Omaha on Mg,it In I Vi 2t2._I setting forth certain conditions with respect to the development of property owned by the Developers to be known as Flanagan Pointe. WHEREAS,The Developer desires to amend the Development Agreement to reflect layout changes on Lots 1 &2 and Outlot C,Flanagan Pointe as shown on Exhibit B. NOW,THEREFORE,the following is agreed between the parties hereto: 1. Exhibit A to the original agreement is repealed in its entirety and the attached Exhibit A is substituted in its place. 2. Exhibit B to the original agreement is repealed in its entirety and the attached Exhibit B is substituted in its place. 3. Exhibit B-1 to the original agreement is repealed in its entirety and the attached Exhibit B-1 is substituted in its place. 4. Exhibit D to the original agreement is repealed in its entirety and the attached Exhibit D is substituted in its place. 5. Except as specifically set forth herein,the Development shall remain in full force and effect.
