The attached Ordinance would adopt the 2006 edition of the International Building Code. The
City currently uses the 2000 edition of that Code. :Adoption of the new 2006 edition will update
the City's regulation of construction. The Ordinance provides for several local modifications to
the International.Building Code.
• The ordinance also adds some other changes to the City's Building Code, regarding the Building
Board of Review and the handling and processing Of building plans.
•
The Planning Department and a committee of local architects, engineers, and contractors
reviewed the 2006 International Building Code, and developed the local ainendments contained
in this Ordinance. The City's.Building Board of Review has also reviewed this Ordinance and
has expressed its support for it.

1 AN ORDINANCE to amend certain sections of Omaha Municipal Code Chapter 43 dealing with
2 the building code, building board of review, and building plans; to adopt the 2006 edition
3 of the International Building Code, along with certain amendments thereto; to suspend,
4 for the purposes of section 7 of this ordinance only, the requirement of City Council Rule
5 of Order VII-B that new material be shown underlined and deleted material be shown
6 lined out; to repeal §§ 43-54, 43-63, 43-73, 43-74, 43-78, 43-121 and 43-126 as
7 heretofore existing; and to provide the effective date thereof.
8 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
9 Section 1. That § 43-54 of the Omaha Municipal Code is hereby amended to read as
10 follows:
11 Sec. 43-54. Term of members.
12
13 The members of the board shall be appointed for a term of three years. Members shall serve
14 until their successors are appointed and qualified. Members may be appointed to successive
15 terms.
16
17 Section 2. That § 43-63 of the Omaha Municipal Code is hereby amended to read as
18 follows:

20 Sec. 43-63. Fee for appeals.
21
22 Every request for a hearing filed under the provisions of this chapter shall be accompanied by a
23 fee of$30.00 $100.00,payable to the city.

25 Section 3. That § 43-73 of the Omaha Municipal Code is hereby amended to read as
26 follows:

28 43-73. Application.

30 To obtain a permit, the applicant shall first file an application in writing on a form furnished in a
31 format approved by permits and inspections for that purpose. Every such application shall:

1. Identify and describe the work to be covered by the permit for which application
2 is made.
3 2. Describe the land on which the proposed work is to be done by legal description,
4 street address or similar description that will readily identify and definitely locate the
5 proposed building or work.
6 3. Indicate the use or occupancy for which the proposed work is intended.
7 4. Be accompanied by plans, diagrams, computations, specifications and other data
8 as required by the building official.
9 5. State the construction valuation of any new building, structure, addition,
10 remodeling or alteration to an existing building.
11 6. Be signed by the applicant or the applicant's authorized agent.
12 7. Give such other data and information as may be required by the building official.
13
14 Section 4. That § 43-74 of the Omaha Municipal Code is hereby amended to read as
15 follows:
16
17 43-74. Submittal documents.
18
19 Plans in triplicate, specifications, engineering calculations, diagrams, soil investigation reports,
20 special inspection and structural observation programs and other data shall constitute the
21 submittal documents and shall be submitted with each application for a permit. Individuals or
22 firms performing special inspections and structural observations shall be identified.
23
24 Plans, computations, and specifications shall be prepared by an engineer or architect as required
25 by the current State of Nebraska Engineers and Architects Regulation Act. The building official
26 may require plans, computations and specifications to be prepared and designed by an engineer
27 or architect licensed by the state to practice as such even if not required by state law.
28
29 When it is required that documents be prepared by a licensed engineer or architect, the building
30 official shall be authorized to require the owner to engage and designate on the building permit
31 application the name of the licensed design professional who shall act as the licensed design
32 professional in responsible charge of the project. If circumstances require, the owner shall
33 designate a substitute licensed design professional in responsible charge who shall perform the
34 duties required of the original. The building official shall be notified in writing by the owner if
35 the licensed design professional in responsible charge is changed or is unable to continue to
36 perform the duties.

38 The licensed design professional in responsible charge shall be responsible for reviewing and
39 coordinating submittal documents prepared by others, including phased and deferred submittal
40 items, for compatibility with the design of the building.
41
42 Exception: The building official may waive the submission of plans, calculations, construction
43 inspection requirements, and other data if it is found that the nature of the work applied for is
44 such that reviewing of plans is not necessary to obtain compliance with the building code.

6 One set of approved plans, specifications and computations shall be retained by the building
7 official for a period of three years after the issuance of the permit.

9 Exception: Plans containing sensitive or confidential information in accordance with state or
10 federal security standards may be exempted from retention as determined by the building
11 official.

13 Two Remaining sets of approved plans and specifications shall be returned to the applicant.

1 Sections of these codes are modified, amended or deleted elsewhere in the this article. Three
2 Two copies of the International Building Code, the International Residential Code and the
3 International Energy Conservation Code are to be retained on the file with the city clerk. These
4 codes shall be in effect within the limits of the city and its three-mile jurisdictional limits.

6 Section 7. That § 43-126 of the Omaha Municipal Code is hereby amended to read as

6 Section 3410.2, Applicability. Change the first sentence to read as follows: Structures existing
7 prior to the effective adoption date of this code, in which there is work involving additions,
