Bids were received for this service on August 14, 2008 by Metropolitan Utilities District for joint barricading service with the City of Omaha. Attached are detailed bid specifications and bid proposals. Contractor • RIVER CITY BARRICADE CO. $ 798,835.00 (LOW BID) IOWA PLAINS SIGNING, INC. $ 986,000.00 , dba. Highway Signing, Inc. The total bid cost stated above reflects the unit costs for estimated quantities to barricade usage that may be placed over a twelve month period. The bid specifications provide that the work will be performed for an initial one year period and, further, that the work may be extended for two one year periods after the initial termination date. Section 2. That payments for the barricading services to be provided under this purchase order, involving appropriations of more than one year, are authorized in accord with Section 5.17 of the Home Rule Charter of 1956, as amended. be placed over a twelve month period. A mandatory Pre-Bid Meeting will be held on Wednesday, July 30 at 9:00 A.M. The meeting will be held at the Metropolitan Utilities District's Operating Center located at 3100 South 6151 Avenue, Omaha, Nebraska. The meeting will be held in Classroom A. Attendees shall follow 6151 Avenue north from Grover St. approximately two blocks to MUD Gate#1 (the farthest north MUD gate on 61st Avenue). Attendees shall enter the building through the main lobby entrance and check in with the guard at the security station. To be issued a visitor's pass each attendee will be required to provide a form of picture identification, such as a valid driver's license. Please plan on approximately 60 minutes to complete the meeting. Those planning to attend the Pre-Bid Meeting should contact Cory O'Brien at 402-504-7902 or by email at cory_obrien@mudnebr.com by 4:00 P.M. on Tuesday, July 29. It is a provision of this Contract that, in its performance, the Nebraska Fair Labor Standards, as defined in Neb. Rev. Stat. Section 73-104, as amended, shall be maintained. PURPOSE OF JOINT CONTRACT This contract is a joint contract for complete barricading services between the Contractor and both the Metropolitan Utilities District (District) and the City of Omaha (City). The purpose of this joint contract is for the Contractor to furnish, deliver, place, maintain, monitor and remove the specified traffic control equipment to the District and the City. Under this single provider contract, the District and the City seek to provide the following benefits to their respective constituents: a. greater efficiency and coordination between all parties b. elimination of duplicate delivery charges when one entity transfers responsibility for a specific construction site's barricades to the other entity c. provide uniform enforcement of the terms and conditions of this contract including the assessment of penalties for noncompliance d. provide for systematic monitoring of deployed traffic controlled equipment e. obtain economies of scale f. insure public safety at construction sites While the contract covers barricading services for the District and the City, the Contractor shall invoice each party separately for the services provided by the Contractor to that party. Neither the District nor the City is guarantor for the performance of the other. 2. SCOPE Both the District and the City have crews that are required to make numerous improvements or repairs to their respective infrastructures each year. Often, these improvements or repairs are located under paving in the form of parking lots, sidewalks, driveways, and streets. In these cases, barricade services are required to insure public safety. The District's infrastructure system is located throughout Douglas, Sarpy, Saunders and Washington Counties, and includes the local communities of Omaha (including Elkhorn), Springfield, Bennington, Bellevue, Ralston, La Vista, Waterloo, Yutan, Fort Calhoun and State of Nebraska R.O.W. The City's infrastructure system lies within its city limits and the three (3) mile jurisdictional limit. The work proposed under this specification shall include all services, material, personnel, tools and equipment necessary to provide complete barricading services. Complete barricade services shall include the site examination, interpretation of applicable codes to determine barricade and signage placement, barricade delivery, barricade placement, periodic site inspections as described herein, maintenance of barricade equipment and barricade removal. 3. CONTRACT PERIOD The initial term of this contract is one (1) year. This contract may be extended for an additional two (2) years in one (1) year increments with mutual written agreement of all three parties. The intent of extending or cancelling this contract must be made in writing sixty (60) calendar days prior to the end of this contract. 4. The requirement for the initial inspection shall not be required for District or City sites which do not affect motorized vehicular traffic. Periodic Site Inspections After Initial Placement: The Contractor shall make daily inspections utilizing a traffic control inspection form provided by the City for streets designated as Minor Arterials and above as defined by the MAPA Federal Functional Classification map. Neighborhood and residential streets shall be inspected once weekly regardless of site ownership. Inspections must include verification that all lights and flashers are operational. The Contractor shall maintain a daily record of the inspections performed including documentation of barricade equipment repaired, replaced or reset. The Contractor shall reset, repair or make other adjustments as necessary to the barricading, at the Contractor's expense, if the barricading has become noncompliant for any reason including wind, weather, traffic, vandalism or other causes. 6. PRICES AND SALES TAX If prices quoted in the Proposal are illegible, the total bid may be rejected or the unit price will be declared by the interpretation of the District's Vice President of Purchasing. The prices quoted in the proposal shall be firm, and shall not be subject to escalation clauses. The proposal shall include an itemization of all applicable State of Nebraska and local sales and use taxes. Upon the District's or City's request, the Contractor shall provide to the District and City the Contractor's calculation of applicable sales and use taxes or such information as will allow the District and City to calculate and verify applicable sales and use taxes. 7. EQUIPMENT The Contractor shall furnish all vehicles necessary to provide complete barricading services. All Contractor vehicles shall be properly licensed in the State of Nebraska and the City of Omaha except for rental vehicles or other out of state vehicles which can only be used on a temporary basis. All equipment shall meet the barricading standards established by the Federal Highway Administration's Manual on Uniform Traffic Control Devices and the City of Omaha manual Barricading Standards, Specifications Methods and Materials concerning size, shape, color, identification, structure, lighting and reflective material. At the time of delivery and installation all equipment shall be clean, the sheeting shall be in good condition, and the barricades shall be free of major damage. Flasher lenses shall be cleaned and flashers shall be equipped with batteries capable of operating until the equipment is again inspected, serviced or removed. All barrels shall have high intensity reflective sheeting (or equal). A flasher will not be required on barrels. All Type II and Type III barricades shall have engineer grade sheeting (or equal) on both sides of the barricades and shall be equipped with a • flasher. All other barricades shall be engineer's grade sheeting (or equal) and shall be equipped with a flasher. The cost of the sequence arrow panel shall be figured on a daily rate. Sequence arrow panels shall be maintained in good working order and shall not be placed unless all lights are functional. Sequence arrow panels may be used in a moving operation where District or City personnel pick up the equipment from the Contractor and tow said equipment with District or City vehicles. The cost of the sequence arrow panel shall be figured on a daily rate. "Grabber Cones" can only be used on longitudinal barricading. They are not to be used for excavations or tapers. Equipment ballast shall be considered incidental to the furnishing and placement of the barricading equipment. If additional ballast is needed then it shall be provided by the Contractor at no additional cost to the District or City. Special Note Concerning Dodge Street: Advance warning signs and sequence arrow panels placed in any of the three center lanes of Dodge Street between 315t Street and 68th Avenue shall be changed to the center lane or left lane closed mode every morning. The Contractor will be entitled to a delivery charge for this service. 8. AWARD OF CONTRACT The District and City will award this contract to the responsive, responsible bidder who submits the lowest and best bid, or at its sole discretion may reject any or all bids, and may waive any defects, irregularities or informalities. Other than Bid Security, bonding is not required for this contract. 9. BID SECURITY The Proposal for District and City work shall be accompanied by a certified check payable to the "Metropolitan Utilities District of Omaha" and the"City of Omaha" in the amount of ten percent (10%) of the base bid, including unit price totals, drawn on a Federal Reserve System member bank, or by a bid bond in a like amount on the form supplied by the District and executed by a surety authorized to engage in the surety business in the State of Nebraska ("bid security"). The District and City shall retain the bid security as liquidated damages if the Bidder is awarded the Contract and does not enter into the Contract within ten (10) days after notification of the Contract award. The District shall return the bid security to all except the three lowest Bidders within fifteen (15) days after the bid opening. The District shall return the bid security of the three lowest Bidders within forty-eight (48) hours after the executed Contract and surety bonds have been delivered to and accepted by the District and City. 10. RIGHT TO TERMINATE THE CONTRACT If the Contractor is adjudged bankrupt, or makes a general assignment for the benefit of creditors, or if a receiver is appointed on account of insolvency, or if the Contractor repeatedly fails, except in cases for which extension of time is provided, to supply enough properly skilled workers or proper materials, or if the Contractor fails to make prompt payment to Subcontractors for materials or labor, or disregards laws, ordinances or the instructions of the District or the City, or otherwise is guilty of a substantial violation of any provision or part of the Contract Documents, the District or City may, without prejudice to any other right or remedy, and after giving the Contractor seven (7) days written notice, terminate the Contract. Upon breach of Contract the District or City may suspend future payments. 11. REPORTING OF CLAIMS The Contractor shall promptly report to its insurance carrier and to the District or City all alleged claims for personal injury or property damage arising during the Work. INSPECTIONS BY THE DISTRICT OR CITY The District or City, through their appointed representative(s), may inspect barricading equipment for compliance with this Contract. The District and City shall have the right to identify and mark, via spray paint, stickers etc, the Contractor's barricading equipment that does not meet the requirements of the Contract. The District or City will notify the Contractor of any barricading equipment identified and marked as deficient. Such notifications shall be made in the same manner as a routine service request. The Contractor shall correct such deficiencies within one (1) hour after receipt of notice from the District or City. The Contractor will not be paid a delivery • or removal charge for repair or replacement of defective/deficient barricade equipment. 13. SUPERVISION The Contractor shall have a supervisor(s) assigned to this Contract. The Contractor shall provide contact information for this supervisor(s) and this supervisor(s) shall be available to take calls 24/7/365. The supervisor(s) shall represent the Contractor and directions and notices given to the supervisor(s) shall be binding upon the Contractor. Additionally, the Contractor shall have office personnel available that the District or City can reach by telephone or email between the hours of 7:00 a.m. and 4:00 p.m., Monday through Friday (excluding District and City holidays). All Contractor personnel shall have a work zone certification from either the American Traffic ' Safety Services Association (ATSSA) or the International Municipal Signal Association (IMSA). 14. SERVICE REQUESTS Service Requests can consist of delivery and set-up, or removal of traffic control equipment. Service Request shall either be for daily service, extended service, emergency 24 hour service or replacement service. The Contractor shall maintain a business office with the necessary electronic service connections for the systems described below. This business office shall be located within the Omaha city limits. Service Requests shall be received and dispatched from this business office. Service Requests from the District will be made primarily by telephone, but fax machine may also be used. • Service Requests from the City will be made primarily by computerized work order, but telephone, email and fax machine may also be used on occasion. The City, at its expense, will install at the Contractor's business office a "Work Request System" computer, an internet connection, and email account and an email address to be used exclusively for the purpose of service request transactions and related communications on the City's email system. At the Contractor's business office the Contractor shall provide computer accessories supplies for the City's Work Request System computer. These accessories and supplies will include keyboard, mouse, toner cartridges, paper and other consumables. These accessories and supplies will be paid for by the Contractor. Additionally, the Contractor shall have a fax machine at the business office. The cost of the fax machine, dedicated phone line and all accessories and supplies will be paid for by the Contractor. The Contractor shall ensure that the City's Work Request System computer is protected from unauthorized access by use of access security, authorized passwords and log-on protocol. All software programs, hardware, accessories, supplies and internet access shall be approved by the City prior to installation. Use of the hardware, software, internet connection or other items associated with the Work Request System by the Contractor for any purpose not authorized by the City shall constitute 13 e Work. The Contractor shall pay the resulting costs from any damage to hardware, software or database information due to the misuse, accident, abuse or neglect. All Work Request System maintenance, repairs or system upgrades will be conducted by persons authorized by the City. Any upgrades to the City's Work Request System or related software shall be paid for by the City. All other costs will be paid for by the Contractor. 15. DELIVERY AND REMOVAL TIME LIMITS Delivery: The Contractor shall deliver and begin performing barricading services within one (1) hour of receipt of a service request. Removal: The Contractor shall begin removal of traffic control equipment within one (1) hour of receipt of a service request for sites on streets designated as Minor Arterials and above as defined by the MAPA Federal Functional Classification map. The Contractor shall begin removal of traffic control equipment within twenty-four (24) hours of receipt of a service request for all other sites. In all cases the billing period for the site shall end upon receipt of the service request. 16. LIQUIDATED DAMAGES FOR DELAY Delivery and set-up time is of the essence to this Contract. If the Contractor should neglect, fail or refuse to make delivery and begin set-up of traffic control equipment within the time herein specified, or any proper extension thereof granted by the District or the City, the Contractor shall be liable therefore and does hereby agree, as part of the consideration for the awarding of this Contract, pay to the District or City, not as penalty but as liquidated damages for such breach of Contract, the following sums: A. Fifty dollars ($50) for traffic control equipment not delivered within the first hour after receipt of a service request. An additional fifty dollars ($50) will be charged for each additional hour that the delivery is late with a maximum amount of five-hundred dollars ($500) per service request. B. Fifty dollars ($50) for deficient or noncompliant traffic control equipment nor repaired, reset or replaced within the first hour after receipt of a service request. An additional fifty dollars ($50) will be charged for each additional hour that the delivery is late with a maximum amount of five-hundred dollars ($500) per service request. C. Two-hundred-fifty dollars ($250) per calendar day per site for repeated use of noncompliant traffic control equipment. D. Two-hundred-fifty dollars ($250) per calendar day for failure to correctly change the advance warning signs and sequence arrow panels in Dodge Street, from 31s Street to 681h Avenue. E. Fifty dollars ($50) per calendar day for failure to provide programmable sequencing message signs. F. Fifty dollars ($50) for Type II barricades not delivered to the District's Construction Center on the day of receipt of a service request. An additional fifty dollars ($50) will be charged for each additional calendar day that the delivery is late with a maximum amount of five- hundred dollars ($500) per service request. These sums are fixed and agreed upon by and between the District, the City and the Contractor as the estimated additional expense that the District and City will incur in its normal operation as a result of such delay. The District and City shall have the right to deduct such damages from any amount due, or that may become due the Contractor, or to collect such damages from the Contractor. These sums are specifically related to delay and shall not limit the District's or City's right to actual damages for any breach of Contract other than for delay. 17. RESETTING BARRICADES OF OTHER CONTRACTORS There are times when the City receives reports of downed or defective barricades in the street R.O.W. If the City is unable to determine the owner of the barricades or unable to contact the owner then the City may make a service request to have the Contractor inspect the site and report conditions to the City. BILLING PROCEDURES Unless otherwise directed the Contractor shall submit separate invoices, on a weekly basis, to the District and the City. The invoices shall include at a minimum: • Date of service request Location Description of equipment and/or services provided Person requesting delivery Date of delivery Person requesting removal Date of removal request All work shall be invoiced according to the unit prices listed on the proposal. 19. UNIT PRICES • The unit prices for items 1, 2, 3 and 4 on the Proposal shall be for the daily rental of the equipment only. The unit price for item 3 should not include movement of the panel or fueling costs. Delivery, pickup, other transportation and fueling costs for this item only will be the responsibility of the District or City. The unit prices for items 5, 6, and 7 shall be the price per project. 20. DELIVERY CHARGE The delivery charge shall be the charge for delivery of the traffic control equipment to each construction site Monday through Friday from 6:00 a.m. to 5:00 p.m. The time that the Contractor was notified shall be the time used for invoicing. 21. EMERGENCY DELIVERY/REMOVAL CHARGE The emergency delivery/removal charge shall be the charge for delivery or removal of the traffic control equipment to or from each construction site between 5:00 p.m. and 6:00 a.m. Monday through Friday and anytime on Saturday, Sunday or any District or City holiday. The time that the Contractor was notified shall be the time used for invoicing. 22. REMOVAL CHARGE • The removal charge shall be the charge for removal of the traffic control equipment from each construction site Monday through Friday from 6:00 a.m. to 5:00 p.m. The time that the Contractor was notified shall be the time used for invoicing. 23. BARRICADE SUPPLY AT DISTRICT FACILITY The Contractor shall provide the District with thirty (30) Type II barricades with flashers. These barricades shall be delivered to the District's Construction Center located at 3100 South 61 s' Avenue. These barricades are to be used by District personnel for small emergency projects. When these barricades are placed in-service the District will notify the Contractor by 9:00 a.m. on the next regular business day of the site location and number of barricades used. The barricade per day unit price will apply while the barricades are deployed. The Contractor will then deliver replacement barricades to the Construction Center. The Contractor will be paid a delivery charge for the initial supply and each delivery of replacement barricades thereafter. There will be no charge for the barricades while they are stored at the Construction Center. The Contractor shall remove the barricades from the construction site when notified by the District and will be paid a removal charge. . • 15 These sums are fixed and agreed upon by and between the District, the City and the Contractor as the estimated additional expense that the District and City will incur in its normal operation as a result of such delay. CONTRACTOR MINIMUM INVENTORY OF SIGNS The Contractor shall have the following minimum number and types of signs (unmounted) on hand throughout the life of this contract. Signs to be repaired or replaced shall not be included in these inventories. Minimum placement height is 40". All signs shall conform to the standards set forth in the Manual On Uniform Traffic Control • Devices. Neither the District nor the City will provide any signs to the Contractor as part of this contract. If the District or City supplies any of the above listed signs due to emergency situations • then the Contractor shall pay the cost plus 10% for handling. A minimum of two (2) portable programmable sequencing message signs shall be made available when requested by the District or City. The cost of the message sign shall be the daily rate as listed on the proposal page. 25. SPECIAL EVENTS • Each year there are six (6) or seven (7) special events that require a large number of signs and/or barricades to be placed at various intersections around a particular location. Almost all of these events are one (1) day events. The Contractor should anticipate that approximately seventy-five • (75) signs and/or barricades will be needed for each event. Payment shall be made at the unit prices listed on the Proposal. A separate delivery charge will be used for each intersection. 26. NON-PAYMENT FOR EXCESSIVE TRAFFIC CONTROL EQUIPMENT Neither the District nor the City shall make payment for traffic control equipment that is in excess of that required unless specifically approved in advance in writing. Any approved excessive traffic • control equipment shall be identified separately on the invoice. 27. HOLIDAYS The District observes the following holidays. New Year's Day Martin Luther King Day President's Day Memorial Day Independence Day Labor Day Thanksgiving Day and the following Friday • 16 1 ll apply while the barricades are deployed. The Contractor will then deliver replacement barricades to the Construction Center. The Contractor will be paid a delivery charge for the initial supply and each delivery of replacement barricades thereafter. There will be no charge for the barricades while they are stored at the Construction Center. The Contractor shall remove the barricades from the construction site when notified by the District and will be paid a removal charge. . • 15 These sums are fixed and agreed upon by and between the District, the City and the Contractor as the estimated additional expense that the District and City will incur in its normal operation as a result of such delay. The District and City shall have the right to deduct such damages from any amount due, or that may become due the Contractor, or to collect such damages from the Contractor. PAYMENT Payment for barricading services shall be made monthly by the District and City. Payments shall be made within thirty (30) calendar days after receipt of the Contractor's invoice. The payment requested shall be based on the actual quantities of work performed and the unit prices quoted on the Proposal. After each invoice has been approved by the District or City, the Contractor will be paid one hundred percent (100%) of the amount of each invoice. 29. CHANGE IN OWNERSHIP OF A CONSTRUCTION SITE Upon notification, via normal service request, from either the District or the City, the Contractor shall change the party being billed for the site as appropriate. The District and City shall each be billed for one-half the daily charge for the site for this one day only regardless of when the service request is received during the day. If applicable, agency identification signs will be changed by the Contractor at no additional cost to the District or City. The agency identification sign shall be changed on the day the service request is received. 30. PAYMENT WITHHELD The District or the City may withhold payment or, based on subsequently discovered information, nullify the whole or part of any invoice to the extent necessary to protect themselves from loss from: A. Defective workmanship or materials not remedied. B. Claims filed or reasonable evidence indicating probable filing of claims. C. Failure of the Contractor to make proper payments to Subcontractors or for material or labor. D. Any other failure to comply with the Contract Documents. When the above grounds are removed the District or City shall make the payments withheld due to them. 31. UNEMPLOYMENT COMPENSATION AND FINAL PAYMENT The Contractor shall pay to the Unemployment Compensation Fund of the State of Nebraska unemployment contributions and interest due under the provisions of Neb. Rev. Stat. Sections 48-601 through 48-671, as amended, on wages paid to individuals employed in the performance of the Contract. 32. NON SEGREGATED FACILITIES AND EQUAL OPPORTUNITY AGREEMENT The Contractor shall, during the performance of any Contract with or Purchase Order from the Metropolitan Utilities District or the City of Omaha, comply with all applicable provisions of the Civil Rights Act as amended, Section 504 of the Rehabilitation Act of 1973 as amended, Executive Order 11246, the Americans with Disabilities Act, as amended, and any applicable regulations pursuant to those Acts and Order, and agrees that the Equal Opportunity Clause set forth in paragraph C below, shall become a part of every Contract or Purchase Order between the Contractor and the Metropolitan Utilities District. • A. NON-SEGREGATED FACILITIES i. The Contractor does not and will not maintain or provide for its employees any segregated facilities at any of its establishments, and does not and will not permit its employees to perform their services at any location, under its control, where segregated facilities are maintained. B. REPORTS AND ACTION PLAN. i. The Contractor agrees to file, on or before March 31 of each year or within 30 days of acceptance of the Contract if not presently filed, complete and accurate reports on Standard Form 100 (EEO-1)with its contracting compliance agency. ii. The Contractor affirms that it has developed and is maintaining current an affirmative • action program to identify, correct, and improve any and all problem areas inherent in minority employment and evaluation of opportunities for utilization of minority employment and minority group personnel. If such a program has not been established, it will be within 120 days of the acceptance of the Contract. The program established will include each establishment under control of the Contractor. C. EQUAL OPPORTUNITY CLAUSE. During the performance of any Contract with the Metropolitan Utilities District or the City of Omaha, Contractor or supplier agrees as follows: i. The Contractor and any Subcontractors will not discriminate against any employee or applicant for employment because of handicap, disability, race, religion, sex, color, or national origin. The Contractor shall take affirmative action to insure that applicants are employed and that employees are treated, during employment without regard to their handicap, disability, race, religion, sex, color, or national origin. INSURANCE A. Evidence of Insurance Coverage. As soon as possible after the award of the Contract and before the Contractor's execution of the Contract Documents, the Contractor shall furnish written evidence that the minimum insurance required by the Contract Documents has been obtained including the District and City as an additional insured as its interests may appear. For workers' compensation insurance, automobile liability and property damage insurance and comprehensive public liability insurance, the Contractor shall furnish written evidence in the form of a certificate of insurance executed by the Contractor's insurance carrier(s) describing such insurance coverage to be in force for the specified period or by furnishing copies of the actual policies, as may be requested by the District or the City. Each certificate or policy shall contain a statement that the insurance carrier shall give the District and City thirty (30) days written notice by certified mail prior to the cancellation of or the reduction of any insurance coverage. The District and City shall approve all insurance and the Contractor shall maintain insurance coverage until final payment is made. Risk of loss shall remain upon the Contractor until final payment.
