Fanslau Planning Director Date: August 29, 2018 Subject: Case #C10-18-131, C12-18-132 WOOD VALLEY WEST 2 North of Military Road and west of 147th Street The Preliminary Plat of Wood Valley West 2, a subdivision outside the city limits, with rezoning from AG-Agricultural District to R4-Single Family Residential District (high density) was recommended for approval with conditions by the Planning Board at their regular meeting July 7, 2018. The preliminary plat was approved by the City Council on August 28, 2018. The applicant has submitted a final plat for review. The conditions of approval of the preliminary plat are listed (with subsequent responses for this review included): 1. Provide access from Outlot A to Leeman Circle, and from Outlot C to 147th Avenue Circle. (During review of the request, it was determined that Outlots A and C will be used for tree mitigation purposes only and, as such, minimal access would be acceptable and can be provided through the Military Trail frontage. This condition is no longer applicable.) 2. Coordinate the closure of Military Road with the Douglas County Engineer’s office. Barricades shall be provided at the intersection of Military Road and Sheffield Drive to ensure that vehicular traffic cannot access the Military Trail right-of-way. (Coordination of the closure of Military Road will be addressed through the final subdivision agreement.) 3. Coordinate access/trail connectivity from Outlots A, B, or C to the Military Trail right-of- way with the City and the Douglas County Engineer’s office. All site grading, storm sewer design, access, and utility work completed as a part of this subdivision regarding Military Road shall obtain a permit from the Douglas County Engineer. (This condition is still applicable. Final design of the proposed trail will be addressed through the final subdivision agreement.) 4. Coordinate the design of the trail crossing at 144th Street and Wyoming Street with Public Works and Omaha Parks and Recreation. (The design of trail crossings will be addressed through the final subdivision agreement.) 5. Submit an acceptable final tree mitigation plan that shows that all tree mitigation planting is occurring within identified outlots. (A tree mitigation plan has been submitted.) 6. Provide for the use, ownership, and maintenance of the outlots in the subdivision agreement. (The use, ownership, and maintenance of the outlots will be addressed as a part of the subdivision agreement.) 7. Compliance with all applicable stormwater management ordinances and policies. (Sidewalks have been provided as required by Chapter 53, Subdivisions.) 9. Meet an acceptable debt ratio of 4 percent or less. (General obligation debt is $763,288.74. Total valuation is $19,152,000.00. Debt ratio is 3.99 percent.) The following additional comments have been included: Grades for a trail connection through Outlot B are shown as steep as 20 percent, which is not an acceptable slope for a publicly accessible trail. Outlot B must be designed to be in compliance with all accessibility requirements. If an acceptable trail design cannot be provided through Outlot B in its current location, the plat must be revised to relocate Outlot B to a location that will accommodate an acceptable public trail connection. ANALYSIS: Conditionally, the final plat is consistent with the approved preliminary plat and ordinances of Chapter 53, Subdivisions of the Omaha Municipal Code. RECOMMENDATION: Approval of the rezoning from AG to R4. Approval of the final plat, subject to the conditions of preliminary plat approval and addressing the following items prior to forwarding the request to City Council: 1. Submittal of an exhibit showing that a trail connection in compliance with all design standards can be provided through Outlot B or revising the plat to relocate Outlot B to a position that can accommodate an acceptable public trail connection. 2. C10-18-131 C12-18-132 Loren Johnson, Celebrity Homes REQUEST: Final Plat approval of WOOD VALLEY WEST 2, a subdivision outside the city limits, with rezoning from AG to R4 LOCATION: North of Military Road and west of 147th Street At the Planning Board meeting held on September 5, 2018, Eric Englund, Manager of Current Planning, stated that the preliminary plat was heard and approved by the Planning Board on July 7, 2018 and approved by the City Council on August 28, 2018. He stated that all of the conditions have been adequately addressed. Mr. Englund explained that the development will have an access trail to connect to Military Road which will become a public trail in the future. Department calculations indicate that the grade for the trail is unacceptable at this time, the applicant will need to either provide documentation that this outlot will be acceptable for ADA access to the trail, or the outlot will need to be moved to an acceptable location. Mr. Englund stated that the department recommends approval of the rezoning from AG to R4 and approval of the final plat subject to the conditions of the preliminary plat and addressing the two items listed in the report prior to forwarding to City Council for final approval. Mr. Pate moved for approval of the rezoning from AG to R4. Approval of the final plat, subject to the conditions of preliminary plat approval and addressing the following items prior to forwarding the request to City Council: 1) Submittal of an exhibit showing that a trail connection in compliance with all design standards can be provided through Outlot B or revising the plat to relocate Outlot B to a position that can accommodate an acceptable public trail connection; 2) Submittal of an acceptable final subdivision agreement.
