If any statement discloses that the actual gross sales transacted by the Lessee exceed those reported,then the Lessee shall pay Lessor such additional Percentage Rent as may be so shown to be payable,and, if the excess so disclosed shall be more than three percent(3%),Lessee shall also then pay the reasomble cost of such audit and examination. 36. REAL ESTATE TAXES: Annually, Lessee shall pay Lessor, as additional rent, the proportionate part of any increase in real estate taxes levied on the land and building of which the leased premises is a part over the amount of real estate taxes for the year 2006-2007. Lessee shall also pay its proportionate share of any special assessments levied on the property after the date of this lease. Lessee's proportionate share of such increase shall be 4 % Base year being 2006- 2007 (or else that proportion which the total number of square feet of floor space in the leased premises bears to the total number of square feet of floor space in the entire building). Such amount shall be paid within five(5)days after Lessor's demand. Tax bills shall be sufficient evidence of the amount of such taxes and shall be used for calculating the amounts to be paid by Lessee. All increases resulting from taxes levied during the lease term but payable in whole or installments after the lease term,shall be adjusted and prorated,so that the Lessee shall pay its prorated share only for the lease term. Lessee shall have no obligation to pay for any increases in real estate taxes resulting from improvements to the building when those improvements were not those of the Lessee and were effected after commencement of the lease term. 37. LATE PAYMENT CHARGES: A penalty of$50.00 per day will be assessed for each day after the 10th of the month during which that month's rent shall be due. Page-6 of 7 hat if the demised premises above described shall not be available for occupancy at the date named in said lease as the time when the lease term is to commence,then said lease shall commence on the date when said premises shall be available for occupancy,and a pro rata abatement of the rental herein provided shall be made until said premises are available for occupancy but the expiration of said lease shall remain the same;and the Lessor shall not be liable for any loss or damage of any kind whatsoever that the Lessee may sustain or claim to have sustained by reason ofsuch delay. LATE PAYMENT CHARGES: A penalty of$50.00 per day will be assessed for each day after the 10th of the month during which that month's rent shall be due.
