Approved by City Council July 14, 2009. Applicable Regulations: If approved, the site is subject to compliance with the DR-Development Reserve regulations. No building permits will be issued based on a site plan that does not comply with the provisions of the Zoning Ordinance. II. SPECIAL INFORMATION: Site Characteristics: The site is currently comprised of 9.95 acres of unplatted property located within a primarily agricultural area northwest of the City. The site is currently undeveloped and used for agricultural purposes. Development Proposal: The applicant is proposing to turn the existing parcel into one (1) single family residential lot and rezone the property to DR District in order to allow development of the site with a single family residence. Public Improvements: No public improvements are proposed or required as a part of this subdivision. The final subdivision agreement must include agreement to waive the right to protest a future street or sidewalk improvement district. Date: July 25, 2018 Case Number: C10-18-164, C12-18-165 Applicant: Donald and Donella Sweazy Request: Preliminary and Final Plat of SWEAZY ACRES, a minor plat outside the City limits, with rezoning from AG-Agricultural District to DR-Development Reserve (a portion of the property is located within the ED-Environmental Resources Overlay District) Location: Southeast of Blair High Road and Pawnee Road Case Number: C10-18-164, C12-18-165 SWEAZY ACRES Page: 2 RML The final plat includes a note prohibiting direct access to Blair High Road from the property. Improvements or revisions to the approach connection at Pawnee Road require a permit from the Douglas County Engineer’s office. Land Use and Planning: The Future Land Use Plan shows that the property is located within the Future Development Zone. The property does not comply with the requirements of the AG-Agricultural District but it is recognized as a building site because it was transferred legally under prior County regulation. Proper subdivision of the parcel along with rezoning the site will bring it into compliance with the requirements of the City’s subdivision and zoning regulations. A note has been added to the final plat document stating that additional subdivision of the property will not permitted until such time as the property is located within the present development zone. The property is designated as appropriate for Low Density Residential Development on the City’s Future Land Use Plan. Single family residential development is appropriate in the Low Density Residential land use designation. Other: Submitted plans for the preliminary and the final plats show the north arrow incorrectly labeled. Prior to hearing by City Council, revised preliminary and final plat documents must be submitted showing the north arrow correctly labeled. III. ANALYSIS: Conditionally, the proposed minor plat generally complies with Chapter 53, Subdivisions, Chapter 55, Zoning, and the goals and objectives of the Omaha Master Plan. IV. RECOMMENDATIONS: Approval of the rezoning from AG District to DR District (a portion of the property is also located within an ED-Environmental Resources Overlay District). Approval of the Preliminary Plat, subject to the following conditions: 1. Submittal of an amended preliminary and final plat documents showing the correctly labeled north arrow. 2. The applicant agreeing to waive the right to protest a future street or sidewalk improvement district in the final subdivision agreement. Approval of the final plat, subject to the conditions of the preliminary plat and submittal of an acceptable final subdivision agreement. V.
