No building permits will be issued based on a site plan that does not comply with the provisions of the Zoning Ordinance. II. SPECIAL INFORMATION: Site Characteristics: The 22.4 acres of land is a proposed replat of Lot 1, Smelter Plant Replat into five (5) lots and one (1) outlot. The site, Lewis and Clark Landing, consists of open grass area, a concrete boardwalk along the Missouri River on the eastern edge of the property, and surface parking situated along Riverfront Drive, which spans a majority of the length of the property from north to south. The property is generally flat and slopes downhill from the west to the east. Development Proposal: This plat is a part of the Omaha Riverfront Revitalization project. This public open space revitalization focuses on the renewal of three civic spaces downtown - Gene Leahy Mall, Heartland of America Park and Lewis & Clark Landing. Based on input received through public workshops, each park is being renovated to resolve access issues and improve connectivity, increase usable area, introduce a variety of new programs and provide improved activation and management. Date: May 27, 2020 Case Number: C10-20-077 C12-20-075 Applicant: City of Omaha Request: Preliminary and Final Plat approval of SMELTER PLANT REPLAT 2, a subdivision inside city limits, with a waiver to Section 53-4(d), Lot frontage, along with rezoning from HI to CBD (property is located within an ACI-1 Overlay District). Location: Northwest of I-480 at the Missouri River SMELTER PLANT REPLAT 2 Case Number: C10-20-077, C12-20-075 Page 2 GS This plat is specific to Lewis and Clark Landing. The applicant proposes to replat the existing lots into five (5) lots with one (1) outlot and rezone the property to CBD. The applicant is also requesting a waiver of Section 53- 4(d) Lot frontage. The replat also dedicates the necessary right of way for Riverfront Drive. Utilities: Omaha Public Power District has a transmission line that runs along the western edge of the property. OPPD should be contacted to coordinate any grading, construction or vegetation management plans proposed near this line. OPPD also has existing distribution equipment on this property. Coordinate with OPPD on removal/relocation of equipment, if necessary. Grading and Drainage: All development must comply with all applicable stormwater management ordinances and policies, including providing for a no net increase in stormwater runoff and must treat the first 1/2” of stormwater for water quality. Flood Hazard: A Floodplain Development Permit must be obtained for all development in the Special Flood Hazard Area. The Flood Plain Development Permit must be approved before submittal of any building/grading permits. Land Use and Planning: The waiver of Section 53-4(d) Lot frontage is necessary for Outlot A and Lot 5. The proposed Outlot A will contain flood control measures and Lot 5 will contain related park improvements. The lot frontage waiver is acceptable. Urban Design: The ROW width north of Lot 4 does not graphically illustrate the required 18 feet of sidewalk width along the proposed diagonal parking. All development of the site must be minimum ACI-Area of Civic Importance Overlay District requirements as identified in Chapter 55, Article XXII of the Omaha Municipal Code. III. ANALYSIS: Conditionally, the plat is consistent with and carries out the goals and objectives of the City of Omaha Master Plan and subdivision ordinance. IV. RECOMMENDATIONS: Approval of the rezoning from HI to CBD. Approval of the waiver of Section 53-4(d), Lot frontage. Approval of the Preliminary Plat, subject to the following conditions: 1. Coordinate with OPPD on any grading, construction, or vegetation management near the existing transmission line. 2. Compliance with all applicable stormwater management ordinances and policies. 3. Coordinate with City staff on the right of way width north of Lot 4. 4. Approval of a Floodplain Development Permit, if necessary. Approval of the Final Plat, subject to the conditions of the preliminary plat approval and submittal of an acceptable agreement final subdivision agreement prior to forwarding to City Council. C10-20-077 C12-20-075 City of Omaha REQUEST: Preliminary and final plat of SMELTER PLANT REPLAT 2, a subdivision inside city limits, with a waiver to Section 53-4(d), Lot frontage, along with rezoning from HI to CBD (property is located within an ACI-Area of Civic Importance Overlay District) LOCATION: Northwest of I-480 at the Missouri River At the Planning Board meeting held June 3, 2020, Mr. Chris Koenig of HDR, 1917 South 67th Street, appeared to summarize this portion of the Riverfront Revitalization project. Mr. Koenig explained that, when the Lewis & Clark Landing was remediated in the 1990’s, there was no right-of-way designated for Riverfront Drive so this request will address that issue. Additionally, Mr. Koenig stated that the Corps of Engineers has specific requirements regarding the flood wall which will also be addressed with this project. This request will also designate the area of lot 1 for development. Mr. Koenig advised that the City of Omaha will maintain ownership of the property and that the zoning will be changed from Heavy Industrial to downtown, Central Business District zoning for this project. No one appeared in opposition. Mr. Rosenbaum closed the public meeting. Mr. Eric Englund, Acting Assistant Director, stated that the department is supportive of the requested waivers. He advised that the staff believed it is a good project and will add interest to the riverfront area of the city. Mr. Englund stated that the department recommended approval subject to the conditions in the recommendation report.
