Fanslau Planning Director Date: May 29, 2019 Subject: Final Plat approval of OPS PINE CREEK ADDITION, a subdivision outside the city limits, with rezoning from AG-Agricultural District to R5-Urban Family Residential District. Northwest of 156th and Ida Streets Case # C10-19-026, C12-19-027 The Preliminary Plat OPS PINE CREEK ADDITION, a subdivision outside the city limits, with rezoning from AG-Agricultural District to R5-Urban Family Residential District, was recommended for approval by Planning Board on February 6, 2019 and approved by the City Council on April 9, 2019. The applicant has submitted a Final Plat for review. The proposed Final Plat creates 3 lots and 3 outlots which is identical to the approved Preliminary Plat. The conditions of approval of the Preliminary Plat are listed below (with subsequent responses for this review included): 1. Provide for all improvements identified in the final approved traffic study (This condition of approval is still applicable). 2. Dedicate right-of-way and pave a public street between the Vane Street stub on the western boundary of the subdivision and the intersection of 159th and Ida Streets (Right- of-way has been dedicated for a public street between the Vane Street stub and 159th and Ida Street). 3. Between the street adjacent to Lot 3 and the intersection of 156th and Iowa Streets, either 1) dedicate right-of-way and pave a public street or 2) construct a private street to City standards within an outlot (with a public access, utilities, and sewer easement) (The submitted final plat shows a private street (Iowa Plaza) between 156th and Iowa Street and 159th Street, however, the draft subdivision agreement indicates this street will not need to be constructed to City standards. The private street must be constructed to City standards. This will need to be updated in the final subdivision agreement). 4. Place a note on the plat that there shall be no direct access to 156th or Ida Streets from any lots or outlots. This note may be adjusted to grant access to 156th Street from one of the outlots, if a private street connection is provided as the west leg of 156th & Iowa (Acceptable notes restricting access have been added). 5. Coordinate with the Planning and Public Works Departments to provide acceptable means of access to Lot 2, Sugars Place (Access to Lot 2, Sugars Place, is addressed in the draft subdivision agreement). 6. If Girard Circle and Hanover Street are constructed at this time, a maintenance agreement or annexation of those streets by S.I.D. 473 will be required before Douglas County will provide routine maintenance of the public streets. If not located in a Sanitary Improvement District, major maintenance activities are the responsibility of the adjacent property owner OPS PINE CREEK ADDITION Case Number: C10-19-026, C12-19-027 Page 2 PJB (The applicant has indicated that a maintenance agreement will be completed between OPS and Douglas County). 7. Coordinate with Douglas County Engineer’s Office and the Public Works Department regarding the reconstruction of the 159th Street median on the south side of Ida Street (Public Works has indicated the applicant will need to modify the median on the south leg of 159th Street and pave a northbound left turn lane. The applicant has indicated that they are continuing to coordinate with both departments regarding this condition). 8. Construct sidewalks along both sides of the internal public/private streets, and along the subdivision’s 156th Street and Ida Street frontages (The draft subdivision agreement states that the private drive (Iowa Plaza) does not have to have sidewalks on both sides of the street. Sidewalks are required on both sides of the street. This will need to be updated in the final subdivision agreement). 9. Comply with all applicable stormwater management ordinances and policies (A Post Construction Stormwater Management Plan has been included in the draft subdivision agreement). 10. The use, ownership and maintenance of the outlots must be provided for in the final subdivision agreement (The use of the outlots is addressed on the final plat document, however, the maintenance and ownership of Outlots A and C will need to be addressed in the final subdivision agreement). 11. Submittal of a letter from Douglas County Emergency Management confirming that acceptable emergency warning is being provided for the area (A letter has been submitted indicating a siren will need to be installed at a location which will be determined at a later date. The applicant will need to continue to coordinate with DCEM on an acceptable location). 12. Coordinate with the Planning Department regarding an acceptable tree canopy analysis and mitigation plan (An acceptable tree canopy analysis and mitigation plan have been submitted with the final plat. It is indicated that Lot 3 has a large amount of tree canopy being retained. In order to assure this canopy remains upon sale of this lot, the applicant will need to include Lot 3 in the use permit application for the school. Any trees that are removed as a result of development or otherwise will require an amendment to that use permit). 13. Submittal of a final wetland analysis and mitigation plan, if necessary (An acceptable Wetland Delineation and Assessment has been submitted stating that there are no Waters of the U.S. on the site). 14. Submittal of a letter of approval from Douglas County for a Noxious Weed Plan (An acceptable letter has been submitted). Analysis: Conditionally, the proposed subdivision is consistent with and carries out the goals and objectives of the City of Omaha Master Plan. The site is planned for a Secondary educational facility which requires a Conditional Use Permit in the R5 zoning district. The applicant will be required to obtain a Conditional Use Permit (which includes Lot 3) prior to submitting a building permit for the school. Recommendation: Approval of the rezoning from AG-Agricultural District to R5-Urban Family Residential District. Approval of the Final Plat, subject to submittal of an acceptable final subdivision agreement prior to forwarding the request to the City Council for final action. C10-19-026 C12-19-027 Mark Warneke, Douglas County School District 001 REQUEST: Final Plat approval of OPS PINE CREEK ADDITION, a subdivision outside the city limits, with rezoning from AG to R5 LOCATION: Northwest of 156th and Ida Streets At the Planning Board meeting held June 5, 2019, Mr. Eric Englund, Acting Assistant Director, stated that the Preliminary Plat of OPS Pine Creek Addition was approved by the Planning Board at the February 6, 2019 meeting and by the City Council at their meeting on April 9, 2019. He advised that the request will create three lots and three outlots for a new Omaha Public Schools high school. Mr. Englund also advised that in addition to submitting an acceptable final subdivision agreement, the applicant will also need to apply for a Conditional Use Permit prior to forwarding the request to the City Council for final approval. Mr. Englund stated that the Planning Department recommended approval. Mr. Pate moved for approval of the rezoning from AG-Agricultural District to R5-Urban Family Residential District and approval of the Final Plat, subject to submittal of an acceptable final subdivision agreement prior to forwarding the request to the City Council for final action. Mr. Moore seconded the motion which carried 7-0.
