GENERAL INFORMATION: Purpose: To subdivide 8.16 acres into three lots and one outlot; and to rezone to allow development of the site. Existing Use(s): Undeveloped Existing Zoning: LC Adjacent Land Use(s): Adjacent Zoning: North: Single family residential North: R4 South: Convenience store, gas sales, and single family residential South: R4, CC East: Single family residential East: R4 West: Financial services, multiple family residential West: R6, MU Future Land Use Designation(s): Office Commercial, within a MU Boundary area Applicable Regulations: If approved, development of the site will be subject to the requirements of the DR-Development Reserve and LC-Limited Commercial Districts, the MCC-Major Commercial Corridor Overlay design standards, as well as all other applicable regulations. No building permits will be issued based on a site plan that does not comply with the provisions of the Zoning Ordinance. II. SPECIAL INFORMATION: Site Characteristics: The site is comprised of 8.16 acres of undeveloped, grass covered land located northeast of 132nd and Fort Streets. Property to the north and east is developed with single family residences. Property to the west and south is developed with a mix of commercial and multiple family residential uses. Development Proposal: The applicant proposes to subdivide the site into three lots and one outlot. Lot 3 does not include access along a public street frontage and, as such, a waiver for Lot frontage has been included as a part of this request. Plans show easements are being provided for access to Lot 3 and to provide circulation throughout the site. This request for subdivision was initially submitted in association with a Conditional Use Permit to allow Food sales (general) to be developed on proposed Lot 1(Case #C7-19-156), but review of the request is ongoing and the item is not included on this agenda. Request: Preliminary and Final Plat approval of MARVELY, a minor plat inside the city limits, with a waiver to Section 53-8(4d), Lot frontage, along with rezoning from LC to DR and LC, and approval of the MCC Overlay District Location: Northeast of 132nd and Fort Streets Case Number: C10-19-148, C12-19-149 MARVELY Page 2 RML Public Improvements: Traffic Impact Study: Provide for all improvements identified in the final traffic impact study. Access: The following notes must be added to the Plat: • No access to Fort Street or 132nd Street from Outlot A. • One access to 132nd Street from Lot 1. • One access to Fort Street from Lot 2. • Location of permitted access points must be shown on the plat with callouts. • Fort Street and 132nd Street access shall be restricted to right- in/right-out only upon future improvements to the respective streets. Submitted plans show that the proposed access easement encroaches into parking spaces and through parking lot drive aisles throughout the site. A public access easement must be provided between the two arterial access points. The connecting street must be designed to City street standards and may not encroach into adjacent parking stalls or run through parking lot drive aisles. Provide an access easement between Outlot A and the public access easement. Sidewalks: Construct sidewalks along the subdivision’s 132nd Street frontage. However, additional improvements along Fort Street are anticipated in the near-term future and sidewalks will be provided as a part of that project. Provision of sidewalks along Fort Street are not required at this time. Subdivision Agreement: Provide for the use, ownership, and maintenance of the outlots in the subdivision agreement. Sanitary Sewers: Sanitary sewer will be provided as required by Chapter 53-Subdivisions, of the Omaha Municipal Code. Utilities: OPPD has existing distribution equipment running through the property. Coordinate with OPPD on removal of the equipment. Water, gas, and electricity will be provided as required by Chapter 53-Subdivisions, of the Omaha Municipal Code. Grading and Drainage: The development must comply with all applicable stormwater management ordinances and policies, including providing for a no net increase in stormwater runoff and treatment of the first ½ inch of stormwater for water quality. Land Use and Planning: The proposed LC zoning is appropriate in an office commercial land use designation. Fort Street is an identified MCC-Major Commercial Corridor and, as such, the applicant has included the approval of the MCC Overlay District as a part of this request. It should be noted that a preliminary site plan was submitted as a part of this request, but has not been reviewed for compliance with zoning regulations as a part of this request. ANALYSIS: Conditionally, the plat and rezone comply with the goals and objectives of the Omaha Master Plan and the requirements of Chapter 53, Subdivisions, of the Omaha Municipal Code. IV. RECOMMENDATIONS: Approval of the rezoning from LC to DR and LC. Approval of the MCC-Major Commercial Corridor Overlay District. Approval of the waiver to Section 53-8(4d), Lot frontage. Approval of the Preliminary Plat, subject to meeting the following conditions: 1. Provide for all improvements identified in the final traffic impact study. Place the following notes on the plat: • No access to Fort Street or 132nd Street from Outlot A. • One access to 132nd Street from Lot 1. • One access to Fort Street from Lot 2. • Location of permitted access points shall be shown on the plat with callouts. • Fort Street and 132nd Street access shall be restricted to right-in/right-out only upon future improvements to the respective streets. 2. Provide a public access easement between the arterial access points. The easement shall be designed to City standards and shall not encroach into parking spaces or parking lot drive aisles. 3. Provide an access easement between Outlot A and the public access easement. 4. Provide sidewalks along the 132nd Street frontage as required pursuant to Chapter 53 Subdivisions of the Omaha Municipal Code. 5. Provide for the use, ownership, and maintenance of the outlot in the subdivision agreement. 6. Compliance with all applicable stormwater management ordinances and policies. Approval of the Final Plat, subject to the conditions of the Preliminary Plat and submittal of an acceptable final subdivision agreement prior to forwarding the request to City Council. V.
