Location: Northeast of U.S. Highway 75 and Interstate 680 I.GENERAL INFORMATION: Purpose: To allow a nursery(Robert's Nursery)and self-storage facility at this location. Existing Land Use: Undeveloped Existing Zoning:CC-ED Adjacent Land Use and Zoning: North Undeveloped DR-ED South Industrial/I-680 GI/— East Undeveloped DR-ED West Undeveloped GI-ED Zoning History:Case#C12-05-060,Preliminary Plat approval of Lone Peak Plaza along with a large project special use permit,approved by the City Council on December 20, 2005(Final Plat never approved). Future Land Use Plan Designation: The intersection of U.S.Highway 75 and Interstate 680 is designated as a Community Mixed Use Area(165 acres). Applicable Regulations: The subject property is required to comply with the regulations of the existing CC-Community Commercial District and the ED-North Hills Environmental Resources Overlay District, as well as all other applicable development regulations,including the following: Section 55-734-Off-street parking requirements. Agricultural sales and services/Warehousing and distribution(limited)-Schedule A Office space-1 space per 300 sq ft Indoor sales,display or service area-1 space per 500 sq ft Outdoor sales,display or service area-1 space per 2,000 sq ft Indoor or outdoor storage,or warehousing-1 space per 5,000 sq ft Convenience storage-1 space per 300 sq ft of office,with a minimum of 3 spaces per facility Section 55-765(e)-Supplemental use regulations for Convenience storage facilities: 1. Minimum size: The minimum site area for a convenience storage facility shall be two acres. 2. Limitation of activities: No activity other than the rental of storage cubicles and the administration of the facility shall be permitted within the facility. 3. Access to buildings:No storage buildings may open into required yards. ECE Recommendation Report Case#C7-17-015,C7-17-024,C8-17-016 Page 2 4. Driveway widths: All driveways within the facility shall provide a paved roadway with a minimum width of 24 feet. 5. Storage restrictions:All storage on the facility site must be within enclosed buildings. Storage of hazardous materials in a convenience storage facility is prohibited. 6. Landscaped bufferyards: Convenience storage facilities must maintain landscaped buffer yards of 35 feet adjacent to any public right-of-way and 20 feet adjacent to any other lot lines. Larger bufferyards may be required by the application of Sections 55-715 and 55-716. 7. Height limits:The maximum height for any structure within the facility is 20 feet. 8. Perimeter fencing:The perimeter of each facility shall be fully enclosed by fencing or screen walls.Perimeter fencing shall be provided at a minimum of six feet and a maximum of eight feet in height,of a material approved by the Planning Director. Fencing shall be constructed behind required bufferyards. 9. Application for conditional or special use permit: Any conditional or special use permit application shall include the following information,in addition to that required by Sections 55- 883 and 55-884: a. A development plan, showing location,design and layout of buildings, parking areas, circulation routes,fences and screen walls,lighting,signage,existing and proposed contours,and drainage and solid waste disposal facilities. b. Architectural elevations of all buildings,specifying height and construction materials. Section 55-770-Outdoor storage: a) Outdoor storage is prohibited in all zoning districts except the GI general industrial district and HI heavy industrial district,or where incidental to and for the primary uses associated with the following use types: (3)Commercial use types. (b)Outdoor storage is permitted where it is incidental to agricultural sales and services,automotive rentals,automotive sales,equipment rental and sales, construction sales and services,stables,and surplus sales. II.SPECIAL INFORMATION: Site Characteristics: This site consists of 16.34 acres of undeveloped land located northeast of U.S. Highway 75 and Interstate 680. The property,which has very little tree coverage,has a moderate slope falling from the north to the south. Development Proposal: The applicant proposes to operate an Agricultural sales and service business (Robert's Nursery)on 8.35 acres of the site. General operations will include the growing of plant material,sales of plant material and garden center items,rock,mulch,soils and other similar items. There will also be an accessory shop/service building housing the installation employees needed to service the purchase(s)by clients for before mentioned products. The hours of operation for the business would be as follows: Monday-Friday-7 am-7 pm Saturday-8 am-5 pm Sunday-loam-4pm Also on site would be a Convenience storage/Warehousing and distribution (limited)business on 4.53 acres. An office with one employee on staff will operate the estimated 95,000 square foot facility. A key entrance gate will guard the secured and enclosed facility. The hours of operation for the business would be as follows: ECE Recommendation Report Case#C7-17-015,C7-17-024,C8-17-016 Page 3 Monday-Friday-8 am-6 pm Saturday-9 am-4pm Sunday-10am-4pm Grading and Drainage: Development will be required to comply with all applicable stormwater management ordinances and policies;including providing for a no net increase in stormwater runoff and treatment of the first'/z inch of stormwater for water quality. Land Use and Planning:Agricultural sales and service is an allowed use in the CC District upon approval of a Conditional Use Permit in compliance with the base district development regulations and Section 55-885 review criteria. This operation will have a nursery showroom,greenhouse,nursery service building,plant display areas, storage bins for mulch materials and associated parking. There are 45 proposed parking stalls adjacent to the nursery showroom,with an additional 23 stalls adjacent to the accessory service building. The 68 total off-sheet parking stalls is code compliant with this portion of the development. The proposed building elevations and most components of the submitted landscape plan are acceptable. Warehousing and distribution(limited)is an allowed use in the CC District upon approval of a Conditional Use Permit and Convenience storage is an allowed use in the CC District upon approval of a Special Use Permit in compliance with the base district development regulations and Section 55-885 review criteria. The CUP for Warehousing and distribution(limited)is required for the westernmost 16,000 square foot storage building due to it being accessed by customers from the interior of the building rather than the standard outdoor-accessible storage bays that exists throughout the remainder of the property. In addition to the interior-accessed warehousing building,the site will have five traditional convenience storage buildings. The submitted plan is generally acceptable in regards to bufferyards/landscaping, parking and building elevations. It should be noted that the adjacent accessory nursery service building located to the east of the storage facility will be accessed through this facility. The applicant will need to work with city staff on finalization of an acceptable landscape plan to ensure that adequate screening is being provided along the south side of the accessory service building and convenience storage facility. There were no proposed signage exhibits provided with the submittal. All signage will be required to comply with all applicable codes and no pole signs will be allowed. III.ANALYSIS: Conditionally,the Conditional Use Permits and Special Use Permit requests comply with all aspects of the applicable base district development standards and the criteria in Section 55-885.
