The attached Resolution approves a variance from the Present Development Zone specifications
of the Urban Development Element of the City of Omaha Master Plan, located northwest of
Kilpatrick Parkway and State Street and in conjunction with the proposed HUNZEKER subdivision
plat. The applicant is Jerry Torczon, Richland Homes, LLC.
CASE DESCRIPTION: The purpose of the variance is to allow a single family residential
development of HUNZEKER. A small area in the southwest portion of the site lies outside the.
Present Development Zone Boundary. The variance is supported as all impacted lots can be
served by gravity sewer lines as required by the Omaha Subdivision Ordinance.
DEPARTMENT RECOMMENDATION: Approval of the waiver to the Present Development Zone
boundary of the Urban Development Element of the City of Omaha Master Plan.
SUMMARY OF TESTIMONY: The Planning Board held a public meeting on this request March
7, 2018. A full summary of the proceedings is attached.
PLANNING BOARD RECOMMENDATION: Approval, as recommended by the Planning
Department, 7-0.

Request: Preliminary Plat approval of HUNZEKER, a subdivision outside the city
limits, with rezoning from AG-Agriculture District to R4-Single Family
Residential District (High Density), along with a request for a variance to
the Present Development Zone Boundary of the Urban Development
Element of the City's Master Plan.
Location: Northwest of Kilpatrick Parkway and State Street
I. GENERAL INFORMATION:
Purpose: To create a total of 251 residential lots and 9 outlots and to rezone the
property for residential use.
Existing Use(s): Agriculture (single family residence) Existing Zoning: AG
Adjacent Land Use(s): Adjacent Zoning
North: Agriculture (vacant) North: AG
South: Agriculture (single family residences) South: AG
East: Single family residential East: R4, DR
West: Agriculture (single family residences) West: AG
Future Land Use Designation(s): Low Density Residential
Applicable Regulations: If approved, the site is subject to compliance with the R4 District
regulations, as well as all other applicable regulations.
No building permits will be issued based on a site plan that does not comply with the
_provisions of the Zoning Ordinance.
II. SPECIAL INFORMATION:
Site The site is comprised of approximately 76.667 acres of primarily agricultural i
Characteristics: land. The property is also currently developed with one (1) single family
residence.
Development Submitted plans show development of the property with a total of 251.single
Proposal: family residential lots, 9 outlots for open space and drainage purposes, and
public right-of-way. The property is currently zoned AG District and, as
such, the applicant has also submitted a request to rezone the property to
R4-Single Family Residential District (high density). A portion of the
southwestern corner of the property is located outside the Present
Development Zone as identified on the Urban Development element of the
Omaha Master Plan and, as such, the applicant has also requested a
variance to the Present Development Zone boundary.
Public Right-of-Way: Traffic calming must be provided on all streets longer than
Improvements: 1,000 feet.

All street stubs must be paved to the property boundary and a temporary
turnaround must be provided.
The applicant must coordinate with Public Works on an acceptable General
Obligation Paving Plan.
Access: The Final Plat must be revised to include a note prohibiting access
to State Street for proposed Lots 220 through 234.
The proposed access onto State Street must meet proper site distance
criteria and incorporate all required intersection improvements as identified
in the City/county access policy. Any roadway improvements required as a
part of the driveway connection are the responsibility of the developer. For
evaluation purposes, the applicant must use the AASHTO Stopping Sight
Distance of 50 mph (425') for sight distance criteria.
Sidewalks: Sidewalks are required along all street frontages, including
along the State Street frontage. Maintenance of sidewalks on double
frontage lots must be addressed in the Subdivision Agreement.
Sanitary Sewer: Sanitary Sewer is being provided as required.
Storm Sewer: The development must comply with all applicable stormwater
management ordinances and policies, including providing for a no net
increase in stormwater runoff and treatment of the first'/2 inch of stormwater
for water quality.
All stormwater design computations and final plans addressing roadway
and site drainage within the development boundary adjacent to the State
Street right-of-way must be submitted to the Douglas County Engineers
office for review.
Utilities: Water, gas, and electricity will be provided as required by Chapter 53,
Subdivisions, of the Omaha Municipal Code.
Grading and Any grading, sewer or utility work carried out in conjunction with the
Drainage: development, in the State Street right-of-way, will require permits from the
Douglas County Engineer's office.
The proposed site grades along the southern boundary of the plat, adjacent
to State Street, must be coordinated with the future improvement of the
• roadway. The consultant will be required to submit cross section
information for review that shows the relationship of the proposed site
grading to the existing and future State Street improvements. Certification
of the grade coordination will be required prior to the City of. Omaha's
approval of the Final Plat.
Parks and Submitted plans must be revised to provide a minimum 25 feet of frontage
Open Space: along a public street for Outlot F.
The use, ownership, and maintenance of all outlots must be addressed as
a part of the Subdivision Agreement.

Boulevard plans and cost estimates must be approved by the Parks and
Recreation Advisory Board prior to bidding.
The applicant must coordinate the design for Park#P24 with adjacent SIDs
and the Omaha Parks Department. Neighborhood Park fees should be
negotiated with adjacent SIDs as well.
Lots adjacent to common space or parks must provide a continuous round
rail fence a minimum of 1 foot inside the park lot boundary pursuant to the
Parks Department standard detail.
Lots 13-16 are adjacent to Sunflower Street as well as Kilpatrick Parkway.
Kilpatrick Parkway is an identified parkway. Lots may not back onto
Kilpatrick Parkway. Prior to submittal of a Final Plat application, the
Preliminary Plat must be revised to ensure lots do not back onto a parkway.
Emergency The applicant will be required to submit a letter from Douglas County
Management: Emergency Management confirming that acceptable emergency warning
is being provided for the area.
Environmental: A wetland analysis was not provided with the submittal, but will be required
to ensure there isn't damage being done to such natural features within the
development. If the analysis indicates that mitigation will be necessary, a
3:1 mitigation plan will need to be submitted prior to application of a final
plat.
Financing: The taxable valuation of the development is estimated at $67,996,250.00.
The projected total general obligation debt is estimated at $2,860,400.00.
The projected debt ratio is estimated at 4.21 percent. An acceptable debt
ratio is 4 percent or less.
Land Use and The rezoning from AG to R4 District is consistent with the Future Land Use
Planning: Element of the City's Master Plan.
This subdivision is accompanied by a request for a variance to the Present
Development Zone boundary of the Urban Development Element of the City
of Omaha Master Plan to include proposed Lots 195-201 and Lots 213-232.
The proposed lots are impacted by the existing Development boundary but
are adjacent to/bisected by the ridgeline. All impacted lots can be served
by gravity sewer line as required by the Omaha Subdivision Ordinance.
III. ANALYSIS:
Conditionally, the proposed rezoning and subdivision complies with the requirements of
Chapter 53 Subdivision of the Omaha Municipal Code and the Omaha Master Plan.
IV. RECOMMENDATIONS:
Approval of the rezoning from AG to R4.
Approval of the waiver to the Present Development Zone boundary of the Urban Development
Element of the City of Omaha Master Plan.
Approval of the Preliminary Plat, subject to the following conditions:
1. Provide a note on the plat stating that access to State Street from any adjacent lot or
outlot is prohibited.
2. Provide a minimum 25 feet of frontage for proposed Outlot F.

3. Revise the plat so residential lots do not back onto Kilpatrick Parkway.

turnarounds for all stubs.

8. Provide the standard noise attenuation easement language on the final plat.
9. Provide for sidewalks as required on all street frontages, including along State Street.
10. Provide maintenance of sidewalks on double frontage lots in the Subdivision Agreement.
11. Coordinate with the Douglas County Engineers office for the grading of the subdivision to
match the ultimate buildout of State Street. All proposed grading, sewer or utility work
proposed within the State Street right-of-way must obtain a permit.
12. Coordinate with Douglas County for the design of proposed access to State Street.
13. Provide for the use, ownership and maintenance of all outlots in the final subdivision
agreement.
14. Compliance with all applicable stormwater management ordinances and policies.
15. Boulevard plans and cost estimates must be approved by the Parks and Recreation
Advisory Board prior to bidding.
16. The applicant must coordinate the design for Park #P24 with adjacent SIDs and the
Omaha Parks Department.
17. Lots adjacent to common space or parks must provide a continuous round rail fence a
minimum of 1 foot inside the park lot boundary pursuant to the Parks Department standard

18. Submittal of a letter of approval of a noxious weed plan.
